Re:

What Can Disqualify You From Unemployment Benefits?

Unemployment eligibility depends on the state handling your claim. Learn how quitting, a firing, refused work, weekly availability, wages, reporting, and appeals can affect benefits.

You can be denied unemployment benefits—or lose eligibility for particular weeks—if you do not meet your state’s rules. Common reasons include quitting without state-recognized good cause, being fired for work-related misconduct, refusing suitable work, being unable or unavailable to work, missing required work searches or certifications, or having insufficient covered wages. A firing or a quit does not automatically settle the claim: the state handling it applies its own rules to the facts.

Why your state matters

Unemployment insurance is a federal-state program, but the state handling your claim applies its own monetary and nonmonetary eligibility rules. The U.S. Department of Labor says every state has nonmonetary eligibility requirements and disqualification provisions; the definitions, exceptions, and consequences vary. Treat the reasons below as common issues to check, not a nationwide prediction of your outcome.

First identify the state agency handling your claim, then read its current instructions and any determination letter. Separate two questions: whether your wages qualify you for benefits, and whether a particular separation or weekly circumstance makes you ineligible. Those are different grounds for denial.

Can quitting disqualify you?

It can. A voluntary quit may disqualify you if the state decides you left without good cause recognized by its law. What counts as good cause—and whether it must be attributable to the employer—depends on the state and the evidence. A reason that sounds compelling in everyday terms is not automatically a qualifying legal exception.

Illinois, for example, recognizes employer-attributable good cause and lists examples that can include health, sexual harassment, domestic violence, unsuitable work, accepting another job, and relocation with a military spouse. That is an Illinois illustration, not a list of exceptions guaranteed in every state.

Explain the circumstances accurately and provide relevant records, such as messages, schedules, medical documentation, or notices. Do not assume a quit permanently bars benefits: state rules determine the disqualification and any conditions for requalifying.

Can you get unemployment if you were fired?

Being fired by itself does not necessarily disqualify you. The agency generally examines why you were discharged and applies the state’s standard for work-connected misconduct or, in some states, substantial fault. The employer’s description of the separation is not automatically the final decision; the agency may consider evidence from both sides.

Be precise about what happened, including dates, instructions, warnings, and your response. Preserve relevant employer communications, schedules, policies, and separation notices. Some state laws also identify particular job-connected conduct—such as certain felony or theft discharges—as a separate disqualifying issue; Illinois lists such cases in its guidance.

What if you refuse a job or do not look for work?

Refusing suitable work without good cause, failing to apply when required, or not meeting work-search requirements can affect eligibility. Whether a job is suitable may depend on factors such as pay, hours, safety, working conditions, skills, and local conditions. Illinois, for instance, identifies safety, wages, hours, union status, and collective-bargaining considerations. The applicable test is the one used by your state.

Keep records of job applications and contacts, and retain the details of any offer you decline, including the reason. Follow your agency’s instructions about what searches to complete and what records to submit; requirements can depend on the state and claim status.

What does “able and available” mean each week?

Eligibility can change from week to week. For each week claimed, the U.S. Department of Labor’s certification guidance says a person must be able to perform suitable work, be available for suitable work, and look for suitable work. A circumstance that prevents you from accepting suitable work may affect that week’s eligibility.

  • Ability to work: Illness or another condition may matter if it prevents you from doing suitable work.
  • Availability: Vacation, caregiving, school, transportation limits, incarceration, or leaving the labor market may matter if they unduly restrict your ability to accept work. State rules and the facts determine the result.
  • Weekly answers: Answer each certification for the specific week it covers. Report work and earnings accurately, keep any required search records, and respond to agency notices.

Georgia, for example, says claimants must remain available without undue restrictions and identifies lack of child care or transportation as potential issues. It also addresses refusal of suitable work without good cause. These are Georgia examples, not a universal definition.

Can you be denied for wages, paperwork, or other legal exclusions?

Yes. Not every denial is about why you left a job. A claim may fail the state’s monetary test if you do not have enough covered wages in the relevant period. Separately, missing certifications, interviews, work searches, or requested information—or failing to contact the agency when instructed—can cause an eligibility problem.

State guidance also identifies other statutory exclusions or limits. Depending on the law and circumstances, these can include a labor-dispute work stoppage, employment excluded from coverage, duplicate unemployment benefits, or offsets involving certain pensions or separation pay. Check the specific state determination rather than assuming one of these rules applies everywhere.

State handbooks illustrate how the issues differ. Wisconsin treats sufficient base-period wages, an acceptable separation, and being able and available as separate eligibility requirements; its handbook also addresses quitting without good cause, misconduct or substantial fault, refusing work, work searches, and availability. Idaho lists issues including leaving the labor market, school conflicts, incarceration, failure to seek work or report searches, failure to provide requested information, and failure to contact the agency. Neither state’s rules should be applied to a claim governed by another state.

What happens if you give false information or fail to report earnings?

Knowingly giving false information, concealing wages, or claiming benefits while ineligible can lead to more than a denial. The U.S. Department of Labor describes claimant fraud as potentially including knowingly submitting false information. Depending on applicable law and the facts, consequences can include recovery of overpaid benefits, a statutory penalty, prosecution, or loss of future eligibility.

Report work and earnings as the state instructs, even if the amount or timing seems unclear. If you discover an error, contact the state agency promptly and keep records of your communications. An overpayment decision is distinct from an initial eligibility denial and should be handled according to its own notice and review instructions.

What should you do if the state says you are disqualified?

  1. Read the determination letter promptly. Identify the issue decided, the weeks affected, any stated requalification conditions, and the appeal deadline.
  2. Follow weekly instructions while the matter is pending. Continue certifications if the agency tells you to, report all earnings, and comply with work-search or interview requirements that still apply.
  3. Gather evidence tied to the issue. Depending on the dispute, this may include separation notices, schedules, wage records, job offers, work-search logs, medical or caregiving records, and messages with the employer or agency.
  4. Use the official state appeal process. Deadlines and hearing procedures are state-specific, so follow the instructions in the determination and the agency’s current guidance.
  5. Get qualified local help when the stakes or facts warrant it. Consider legal aid or an employment lawyer if the facts are disputed, fraud or overpayment is alleged, or a hearing is scheduled.

The agency’s current determination and appeal instructions control the next steps for an individual claim. This article provides general information, not a prediction of eligibility.
