The Department of Education has not been abolished. As of October 7, 2026, the change affecting colleges is a series of announced agreements that assign or support selected federal education functions through other agencies. Colleges should distinguish those announcements from completed operational changes—and continue following current Title IV requirements unless the Department issues applicable new guidance.
What is changing—and what is not
In November 2025, the Department of Education (ED) announced six agreements with four agencies: Labor, Interior, Health and Human Services, and State. ED described the agreements as a way to streamline selected federally funded activities and move toward returning education responsibilities to states. The announcement establishes what ED said it planned; by itself, it does not establish that every function has moved or that the Department has ceased to exist.
ED announced four additional agreements on June 16, 2026, concerning disability-related programs and civil-rights enforcement. The Department said it remained committed to enforcing federal protections. The announcement does not, on its own, verify how services or enforcement are working at a particular college.
ED also says its agreements do not change funding, eligibility, or legal protections. That is the agency’s stated position, not a documented before-and-after finding for individual institutions.

Which functions have been identified?

What colleges should do now
For institutional compliance, the most useful distinction is between a reorganization announcement and a change in the rules a college must follow. The current Federal Student Aid Handbook continues to describe institutional responsibilities; it directs readers to detailed chapters and the relevant statutes and regulations for complete guidance.
- Continue using the applicable handbook chapter, statutes, regulations, and latest Federal Student Aid notices for live compliance decisions.
- When a new agreement is relevant to your institution, identify the specific program and duty it covers, then look for operational guidance from ED or the agency taking on the function.
- Do not infer a new college process from an announcement alone. The materials reviewed do not establish that every announced transfer is complete or that institutions should change procedures without applicable instructions.
What the Treasury role means for student-loan operations
The March 19, 2026 ED-Treasury announcement concerns collections on defaulted federal student-loan debt and operational support for ED’s efforts to return borrowers to repayment. It is a division of operational responsibilities for those activities, not evidence that Treasury has taken over all federal student aid or college Title IV oversight.

In that March 2026 announcement, ED described its federal student-loan portfolio as nearly $1.7 trillion, said fewer than 40 percent of borrowers were in repayment, and said almost 25 percent were in default. These are figures reported by ED at the time of its announcement, not figures independently audited here.
What the Supreme Court order did—and did not—decide
Executive Order 14242, signed March 20, 2025, directed the Secretary of Education to facilitate closure of the Department “to the maximum extent appropriate and permitted by law,” as recited in the Supreme Court’s published order. On July 14, 2025, the Supreme Court stayed a district court preliminary injunction while the government’s appeal and any timely petition for certiorari continued. That was an interim procedural ruling, not a final decision that the Department could be abolished.

Justice Sonia Sotomayor, joined by Justices Kagan and Jackson, dissented. Her dissent stated, “Only Congress has the power to abolish the Department.” The sentence is the dissent’s view; it was not the majority’s holding in the interim order.

The announcements and handbook materials described here do not establish how quickly agencies will process grants or borrower matters under the agreements, whether college workloads will rise or fall, or what students at a particular institution will experience. They also do not independently confirm completion of every announced transfer. Those practical effects depend on implementation and institution-specific circumstances, so colleges should rely on current agency instructions rather than infer outcomes from the reorganization announcements alone.
