It is often presented as a yes-or-no trade, but “event contract” is a description of the underlying subject, not one fixed legal product. Depending on its terms, an event contract may be structured as a swap, futures contract, or option.
A swap is a specific legal category of derivative. The practical answer to “are event contracts swaps?” is therefore: sometimes, but not always. You must examine the contract’s statutory structure, payout, listing venue, settlement rules and trading mechanics rather than rely on the label.

What is an event contract?
The Commodity Futures Trading Commission (CFTC) uses “event contract” for derivative contracts based on the outcome of an occurrence or event. The term is not defined in the Commodity Exchange Act (CEA) or in CFTC regulations. In a proposed rule published March 16, 2026, the CFTC said it has used the term since at least 2008 for derivatives “typically with a binary payoff structure” tied to an underlying event.

Many contracts ask a question with two possible outcomes, such as whether a specified event will happen by a stated deadline. Other contracts can have variable payouts or different settlement formulas. The event might involve a financial index, economic indicator, weather, political or international development, scientific or cultural occurrence, current event or sporting result.

How does a yes/no event contract pay out?
The “Will it rain tomorrow?” example
The CFTC’s consumer explanation uses a simple weather question: “Will it rain tomorrow?” A trader can buy a “yes” or “no” position. In the illustration, the “yes” position trades at 70 cents and the “no” position at 30 cents. Those prices reflect the market’s expectations at that moment; they are not a guaranteed probability or forecast.
At settlement, the contract rules determine whether the specified rain event occurred. The winning side receives the contract’s stated payout, while the losing side does not. A trader’s result is the settlement payout minus the purchase price, before any fees or other charges. If a “yes” position costs $0.70 and pays $1 when the event is confirmed, the gross gain is $0.30. If the event does not occur, the position’s gross loss is the $0.70 purchase price. This is only an illustration; actual prices, payout amounts and costs vary.
Settlement details that can change the result
Before trading, identify all of the following:
- The exact event definition, including thresholds such as a measured amount, vote total or index level.
- The deadline or observation window.
- The authoritative data source or official decision maker.
- Whether the payout is binary, variable or subject to a formula.
- What happens if data are revised, delayed, unavailable or contradictory.
- Whether a tie, cancellation, postponement or partial occurrence produces a payout, refund or other result.
A market price can move before expiration as new information arrives. Leaving a position before settlement may produce a gain or loss based on the available market price and transaction costs, if the venue permits an offsetting trade.
Are event contracts swaps?
Not automatically. “Event contract” describes what the derivative is based on; “swap” describes one possible legal structure. The CEA’s swap definition includes certain payments that depend on an event or contingency associated with a potential financial, economic or commercial consequence. An event-dependent contract can therefore fall within the swap definition when its terms meet that statutory language.

The same CFTC proposal also describes event contracts that may be options or binary options. Other event contracts can be listed as futures contracts. Futures contracts, and options on those futures, are excluded from the CEA’s definition of “swap.” Consequently, an event contract that is legally a future is not a swap merely because its payoff depends on an event.
CFTC Staff Letter No. 26-14 likewise emphasizes that the structure and terms—including the underlying event—determine whether a particular contract is a swap, future or option. Statements that all event contracts are swaps, or that event contracts can never be swaps, are both inaccurate.
How is an event contract different from a swap?
| Comparison point | Event contract | Swap |
|---|---|---|
| What the term describes | A derivative linked to an occurrence, contingency, index or other event. It is not one statutory product type. | A legal category of derivative defined by the CEA and related rules. |
| Possible legal form | May be structured as a swap, future or option, depending on the terms. | Must satisfy the applicable statutory and regulatory definition; futures are excluded from the swap definition. |
| Underlying | Could be weather, a financial or economic measure, politics, science, culture, current events or sports. | Can reference many financial, economic or commercial variables; an event-linked payment may qualify when the statutory conditions are met. |
| Payout | Often binary, but not necessarily. The contract rules control the formula. | May involve exchanges of cash flows, contingent payments or another structure specified by the agreement. |
| Trading venue | May be listed on a designated contract market (DCM) or handled through another permitted market structure, depending on classification. | Swaps may be traded or executed through regulated venues such as swap execution facilities (SEFs), where required, or through other permitted arrangements. |
| Ability to exit | Some standardized, exchange-listed contracts can be offset before settlement; others may have different restrictions. | Exit, assignment, termination and close-out depend on the swap agreement and venue rules. |
| What establishes the answer | The complete contract specification, including legal terms and settlement process. | The statutory definition, regulatory requirements and the particular swap documentation. |
The legal label does not always predict the trading experience. Staff Letter No. 26-14 notes that certain fully collateralized, binary-payout contracts listed on DCMs may meet the swap definition while also using standardized terms, exchange protocols, fungibility and offset features that resemble futures and options on futures. That overlap is why both classification and market mechanics matter.
What should you examine in a particular contract?
1. Legal classification
Look for language identifying the product as a swap, future, option or another instrument. Check whether a statutory exclusion applies. A marketing page or a yes/no question is not enough to establish the classification.
2. The underlying event
Write the event in precise terms. “Will inflation fall?” is incomplete unless the contract identifies the inflation measure, release, reference period and threshold. For a sports or political contract, confirm which official result, governing body or certification controls settlement.

3. Payout and collateral
Determine the maximum payout, the amount required to open the position and the conditions for receiving money. A fully collateralized binary contract may limit the amount at risk to the amount paid or posted, but that is not a universal rule for every event-linked derivative. Read the contract’s margin, collateral and liquidation provisions.
4. Settlement authority and disputes
Find the source that determines the outcome and the timetable for that decision. Review correction procedures, emergency powers and treatment of unavailable or revised data. A seemingly obvious real-world outcome can still produce a different contractual result if it does not meet the specified definition.
5. Trading and offset
Check whether the contract is standardized and fungible, where it trades, and whether you can sell or otherwise offset it before expiration. An exchange-traded contract may have a visible order book and opposing bids and offers; a privately negotiated swap can have different liquidity and termination terms.
6. Fees and other costs
Include commissions, exchange or clearing charges, bid-ask spread, funding or collateral costs and any withdrawal or settlement fees. A favorable payout formula can still produce a poor result after costs.
Where do event contracts fit in current CFTC regulation?
The CFTC’s March 16, 2026 document is a proposed rule, not a final determination that classifies every event contract. It asks for input on how prediction-market products offering swaps or futures to the general public should be classified and regulated. The agency’s position and any related court decisions can change, so the proposal should not be described as settled law.

The proposal states that a prediction market offering swaps or futures to the general public must register with the CFTC as a designated contract market. It also discusses swap execution facilities and the difference between SEF access and DCM markets. The CFTC Futures Glossary defines a SEF as a trading system or platform that enables multiple participants to execute or trade swaps by accepting bids and offers made available to multiple participants.
Registered venues have general obligations when listing derivatives, including a requirement that listed contracts not be readily susceptible to manipulation. The CEA also gives the Commission authority to prohibit certain event contracts if it determines that they are contrary to the public interest. These are oversight powers, not an endorsement of every listed contract and not a guarantee that a forecast or settlement will be correct.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. How common are event contracts?
The CFTC’s proposed rule reports a sharp increase in the number of event contracts certified for listing, while warning that listing counts are not the same as trading volume, active users or continuing activity.
| Period | Figure reported by the CFTC | What it measures |
|---|---|---|
| 2006–2020 | Approximately five event contracts per year on average | Average annual contracts described in the CFTC’s historical review |
| 2021 | 131 newly listed event contracts | New listings during that year |
| 2025 | Approximately 1,600 event contracts certified for listing | Contracts certified for listing, not trading volume or users |
The listed subjects included financial indices, economic indicators, weather, political and international events, scientific and cultural events, current events and sporting events. A certification or listing does not prove that a contract attracted liquidity or remained available throughout the period.

What are the main risks for individual traders?
Outcome and pricing risk
The event may not occur as expected, and a market price can be wrong. A 70-cent “yes” price is an expression of market demand and expectations, not a promise that the event has a 70 percent chance of occurring.

Definition and settlement risk
You can lose because the contract’s technical definition differs from your everyday understanding of the event. A delayed report, revised statistic, canceled contest or disputed official result can matter if the rules address it in a particular way.
Liquidity and exit risk
A position that appears easy to trade may have a wide spread or few opposing orders. If you cannot offset at a reasonable price, you may have to hold until settlement.
Leverage, collateral and fee risk
Some derivatives require margin or collateral and can create obligations beyond the amount initially paid. Other fully collateralized binary products may have a defined maximum loss. Never infer your exposure from the headline price; calculate it from the contract specification.
Regulatory and operational risk
Venue rules, registration status, legal interpretations and court decisions can change. Technical outages, delayed data feeds or a venue’s emergency procedures can also affect trading and settlement.
Consumer checklist before placing a trade
The CFTC advises customers to review market and contract-specific rules, understand risks, monitor open positions or use stop-loss orders where appropriate, and understand fees and costs. Apply that guidance with this checklist:
- Read the full contract specification and the venue’s market rules.
- Record the event definition, deadline, data source and settlement formula.
- Calculate the maximum possible loss, maximum payout and total fees.
- Confirm whether the position is collateralized, margined or subject to liquidation.
- Check normal trading hours, liquidity, bid-ask spread and the process for offsetting.
- Understand how corrections, ties, cancellations, postponements and disputed results are handled.
- Monitor open positions and set a risk limit before trading.
- Use only risk capital—money that can be lost after living expenses, emergency needs and savings goals are covered.
Bottom line for comparing an event contract with a swap
Start with the contract’s legal terms, not its yes/no wording. An event contract identifies a derivative tied to an occurrence; it may be a swap, a future or an option. Futures are excluded from the CEA’s swap definition, while some event-dependent payments and binary options can meet that definition. Then compare the underlying event, payout, settlement authority, venue, ability to offset, collateral and costs. Because the CFTC’s March 2026 rule is still a proposal, confirm the latest rulemaking and court status before relying on a classification for a specific product.
