A GST show-cause notice (SCN) is a formal statement of an allegation and a proposed action, not a final finding that the business owes the amount claimed. Read the complete notice, identify its legal section, tax period, grounds, calculations and response deadline, then answer each allegation with relevant records. The applicable procedure and time limits depend on the notice and the law in force for the relevant period.
What a GST show-cause notice means
An SCN tells a person or business what action a tax authority proposes to take and gives the recipient an opportunity to explain why it should not be taken. In a tax-demand case, the authority may allege that tax was not paid or was short-paid, that a refund was issued erroneously, or that input tax credit (ITC) was wrongly availed or utilised. A demand notice may propose tax, interest and a penalty.

The notice is the authority’s stated case; it is not, by itself, proof that the allegations are correct or an order confirming the demand. The recipient’s task is to understand what is actually alleged and respond to those grounds. Do not assume every GST SCN is a tax-demand notice: different GST provisions use show-cause notices for different issues. The relevant provision and the complete notice determine what the authority is proposing. The CGST Act text published by CBIC includes demand provisions in sections 73 and 74, as well as procedural provisions in section 75.

First establish what kind of notice you received
Read the complete notice, not just the portal summary
A summary can help you orient yourself, but it is not a substitute for the full notice, its enclosures or the records available through the GST portal. The prescribed DRC-01 summary fields provide a practical checklist: case facts, grounds, tax period, statutory section and figures for tax, interest and penalty. Check that the summary corresponds to the notice and that you have all referenced documents. CBIC’s FORM GST DRC-01 sets out those summary fields.

Record the GSTIN, issuing officer, notice reference number and date, service date, financial year and tax period. Note the section and subsection cited, each factual allegation, the proposed amounts and the method or documents used to calculate them. Also note the response instructions and the stated deadline. If an amount is not explained, a period appears inconsistent, or a referenced enclosure is missing, identify that issue rather than guessing what the authority intended.
Do not infer the case from a label alone
Sections 73 and 74 distinguish between allegations about the reason for a tax shortfall or credit/refund issue. In the retrieved Act text, section 73 covers cases other than fraud, wilful misstatement or suppression to evade tax; section 74 addresses allegations involving those grounds. The distinction matters: the statutory basis and alleged facts affect the way the case should be answered and the consequences proposed.
| Provision in the retrieved CGST Act text | Alleged basis | What to check in the notice |
|---|---|---|
| Section 73 | Tax not paid or short-paid, erroneous refund, or wrongly availed or utilised ITC for reasons other than fraud, wilful misstatement or suppression to evade tax. | Whether the facts, tax period and calculation support the stated non-fraud basis. |
| Section 74 | The corresponding issue is alleged to involve fraud, wilful misstatement or suppression to evade tax. | Which specific conduct the notice alleges and what evidence it relies on. |
This comparison describes the provisions surfaced in the CBIC Act material; it is not a complete guide to the law for every tax period. The material does not establish the current consolidated wording or commencement and applicability of section 74A. Do not assume sections 73 and 74 are the only provisions relevant to a current notice, or apply an older time limit or penalty framework without checking the law that applies to the notice and its tax period. Check the relevant Act text and amendments, and obtain advice on applicability where the provision or period is unclear.

The materials discussed here focus on the central CGST demand framework; procedures may also involve corresponding State or Union Territory provisions, or Integrated GST provisions. Use the cited provision, issuing authority, tax period and current applicable law to identify the route that actually governs the case.
How to prepare and file a reply
1. Confirm the deadline and filing route
Find the response date and filing instructions in the complete notice and on the portal. There is no single safe reply period to infer from the words “show-cause notice”: the applicable procedure depends on the notice type, legal provision and law in force. Do not calculate a deadline from a general article or assume the date printed on a short summary is the only relevant date. Keep a copy of the full notice, portal documents, evidence of when it was served and any later directions.

CBIC materials describe electronic viewing of notices and orders and online submission of replies, but portal screens and workflows can change. Follow the current instructions shown for your case and retain the filing acknowledgement or other proof of submission. If the portal does not show an expected document or the filing route is unclear, seek prompt assistance rather than allowing the stated date to pass while you wait.
2. Reconcile every allegation against the business records
Work through the notice allegation by allegation and period by period. Compare the authority’s account with relevant returns, invoices, credit notes, e-way bills, ledgers, payment records, earlier replies and supporting contracts or correspondence. Identify which transactions or figures are accepted, disputed or not understood. Make a separate calculation for each disputed amount and record how it differs from the notice’s figure.

For example, if the notice questions ITC, trace the transactions and documents relevant to the specific credit challenged; do not respond only with a general statement that the business complied. If the dispute concerns a return or payment figure, reconcile the relevant period and calculation rather than combining unrelated months into one explanation.
3. Organise the response so it can be checked
A useful reply follows the sequence and grounds in the notice. For each allegation, state the business’s position, explain the relevant facts, address the legal basis cited, and point to the records that support the explanation. If an amount or document in the notice is unclear or unavailable, say precisely what is unclear and why it matters. Avoid unsupported assertions and avoid treating silence on one ground as agreement with it.
Attach records in a clear, indexed order and use labels that make it easy to connect each attachment to a paragraph or allegation in the reply. Keep the filed version of the response and attachments, along with proof of filing. Where the notice’s summary is uploaded electronically in DRC-01, rule 142(4) specifies FORM GST DRC-06 for the representation or reply. The rule appears in CBIC’s Chapter XVIII: Demands and Recovery, in the CGST Rules as amended on 1 January 2022. Because that publication is dated, check the current rule and the portal instructions for your particular notice before filing.

In practical terms, DRC-01 is the summary of the show-cause notice, while DRC-06 is the specified reply or representation form in the rule described above. They serve different purposes; seeing a DRC-01 summary does not mean the business has already submitted its answer. Confirm that the full notice and supporting material are available, and use the current portal route and applicable instructions for the response.
What happens after the reply
A hearing may be part of the process
The retrieved text of section 75 provides for a hearing opportunity if the person makes a written request or if an adverse decision is contemplated. It also addresses adjournments for sufficient cause, with reasons recorded and a limit on adjournments in that text. Read any hearing communication carefully, prepare around the issues actually in dispute, and bring or organise the records needed to explain the response. If you need an adjournment, make the request in writing and explain the sufficient cause; do not assume it will be granted.
Keep a record of hearing notices and submissions, and note any directions or further documents requested. If the department relies on a point not addressed in the notice or the proposed demand changes, obtain advice on how to respond under the applicable procedure. A hearing is not a substitute for filing a written reply by the stated deadline.
The authority may issue an order
After considering the matter, the authority may issue an adjudication order. The retrieved section 75 text says the order should set out the relevant facts and the basis of the decision. It also provides that the demand cannot exceed the amount in the notice or be confirmed on grounds outside it. Compare the order with the notice and the reply: check the findings, grounds, period and calculations, and see whether the reasoning addresses the business’s material submissions.
Rule 142 describes electronic upload of an order summary in FORM GST DRC-07 and treats the order as a notice for recovery. The DRC-07 summary is not a reason to postpone reading the full order. Save both documents and note any payment, recovery or appeal instructions that apply. The rules source is CBIC’s Chapter XVIII: Demands and Recovery.

If you dispute the order, check the appeal route immediately
Section 107 provides an appeal route for an adjudication order, and the CBIC appeal rules identify FORM GST APL-01. The applicable deadline, preconditions and procedure must be checked against the actual order and current law; do not rely on a generic time limit or wait for recovery action to begin before seeking advice. CBIC’s Appeal Rules identify the form, but the particular order and current provisions govern the next step.
At this stage, keep the order, DRC-07 summary, earlier notice, filed reply, hearing record and supporting documents together. Check the figures and legal grounds in the order against the amount and grounds in the notice, and note any instructions and dates stated in the order. If considering an appeal, promptly establish the applicable filing deadline and any preconditions from the current law and the order itself; the form name alone does not tell you those details.
Common mistakes that can weaken a response
- Replying only to the summary. The underlying notice and enclosures may contain the facts and grounds that need an answer. Obtain and compare the full record.
- Assuming the notice proves the demand. Treat it as the authority’s case to be answered, not as a final order; address the evidence and calculations.
- Using a generic reply. A broad denial may fail to engage with separate grounds, transactions or periods. Respond point by point and link records to each issue.
- Overlooking the cited section. The provision and alleged basis matter. Check the actual section and facts rather than inferring them from the amount or a short heading.
- Guessing at deadlines or current law. The notice label alone does not establish the response period or the applicable demand framework. Verify the current provisions for the relevant tax period, including whether section 74A applies.
- Failing to keep proof. Preserve the notice, enclosures, reply, attachments, portal acknowledgements, hearing records and order in one case file.
- Confusing the notice summary with the reply. DRC-01 summarises the show-cause notice; DRC-06 is the reply form specified in rule 142(4) for the relevant electronically summarised notice. Check the current filing instructions.
- Leaving the order unread after seeing DRC-07. The order summary is not a substitute for reviewing the full order, its reasoning, figures and next-step instructions.
When professional help is sensible
A business may be able to organise its records and identify factual errors internally, but a complex or high-value notice can turn on statutory interpretation, calculations, evidence, or procedural deadlines. Consider consulting a GST practitioner or chartered accountant promptly if the notice alleges fraud, wilful misstatement or suppression, covers multiple periods, proposes a substantial demand, raises unfamiliar legal issues, or if the business is unsure how to respond or appeal. A professional can help assess the case and applicable procedure; no adviser can guarantee a particular result.
Not every recipient necessarily needs paid assistance. The decision depends on the complexity and value of the matter, the evidence available and the business’s ability to address the cited grounds and procedure. For a cross-law or unclear section issue, or a proposed demand with significant consequences, getting case-specific advice early can help the business understand what needs to be answered and which current deadlines must be verified.
Frequently Asked Questions
Does a GST show-cause notice mean my business has to pay the amount shown?
No. An SCN states the authority’s allegations and proposed action and gives the recipient an opportunity to respond. It is not, by itself, proof of the allegations or an order confirming the demand. Read the full notice and address its grounds and calculations.

What are DRC-01 and DRC-06?
FORM GST DRC-01 is the summary of a show-cause notice. Where the notice summary is uploaded electronically in DRC-01, rule 142(4) specifies FORM GST DRC-06 for the representation or reply. Check the current rule and portal instructions for your notice.
How long do I have to reply to a GST show-cause notice?
There is no single reply period to infer from the phrase “show-cause notice.” The applicable deadline depends on the notice type, provision and law in force. Check the complete notice, portal record and any later directions, and verify the current procedure promptly.
What happens after I submit my GST notice reply?
A hearing opportunity may be required if you make a written request or if an adverse decision is contemplated, under the retrieved section 75 text. The authority may then issue an order. Review the full order as well as any DRC-07 summary; if you dispute it, section 107 provides an appeal route and the CBIC appeal rules identify FORM GST APL-01. Verify current deadlines and preconditions against the order and applicable law.

What is the difference between sections 73 and 74?
In the retrieved CGST Act text, section 73 concerns the listed tax, refund or ITC issues for reasons other than fraud, wilful misstatement or suppression to evade tax; section 74 addresses allegations involving those grounds. Check the precise section, alleged facts, tax period and current law, including whether section 74A applies.
The Bottom Line
A GST SCN is an allegation and proposed action, not a final decision. Check the full notice, cited provision, tax period, calculations and deadline; respond point by point with supporting records, retain filing proof, and review any later order promptly. Verify the law and time limits that apply to the particular notice.
