Whether you receive a bonus, when it must be paid and how much arrives in your account depend on the written bonus plan, the promises made to you, the conditions you met and the wage law where you work. There is no single federal rule that guarantees every bonus or sets one nationwide payday.
For tax purposes, the IRS treats bonuses and commissions as supplemental wages. The familiar 22% figure is generally an optional federal withholding method for qualifying separately identified supplemental wages—not a special final tax rate. A predetermined bonus can also affect overtime for a nonexempt employee.

What determines whether you are eligible for a bonus?
Start with the plan, offer letter, employment agreement, commission schedule or other written promise that describes the payment. Eligibility usually turns on four questions:
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitches- Was a bonus or incentive actually promised, or did the employer retain genuine discretion over both paying anything and deciding the amount?
- What measurement period, performance targets, attendance rules or other conditions apply?
- Did you satisfy those conditions, and can you document that fact?
- Which state or local wage-payment law governs your work?
| Plan feature | What to check | Why it matters |
|---|---|---|
| Eligibility condition | Sales, productivity, quality, safety, attendance or company-results targets | Missing a stated condition can change whether the payment was earned. |
| Employment-status clause | Whether you must be employed on the payout date, measurement-date end or another stated date | A separation clause may affect payment, subject to applicable law. |
| Amount calculation | Formula, percentage, tier, cap or management determination | A fixed or calculable amount is different from an amount left entirely to discretion. |
| Adjustment language | Clawbacks, cancellations, company-performance gates or corrections | These terms can alter the amount or timing if valid under governing law. |
Discretionary versus nondiscretionary bonuses
For Fair Labor Standards Act (FLSA) overtime analysis, the U.S. Department of Labor says a bonus is discretionary only when the employer keeps sole discretion, until at or near the end of the relevant period, over both whether to pay and how much to pay, and there was no prior contract, agreement or promise that caused employees to expect regular payments.

A plan that announces a productivity target, quality score, attendance threshold, safety goal or other formula before work is performed generally points toward a nondiscretionary bonus. A payment made under a predetermined formula can therefore be treated differently from a surprise award announced after the period ends. The agency states: “The label assigned to the bonus and the reason for the bonus do not conclusively determine whether the bonus is discretionary.”
This FLSA classification addresses whether the payment may be excluded from the regular rate used for overtime. It does not, by itself, decide every contract or state-law question about whether your employer owes you the money. An employer cannot make an earned payment disappear simply by calling it “discretionary”; the actual plan language, promises and facts control.

- Mark the measurement period. Note the start and end dates and whether results are measured monthly, quarterly or annually.
- List every condition. Record targets, minimum service periods, attendance rules, disciplinary exclusions and any company-level gate.
- Identify the earning date. Some plans say the bonus is earned when the period closes; others require later verification or approval.
- Locate the payout date. Distinguish a date stated in the plan from wording such as “normally paid” or “subject to processing.”
- Check separation language. Look for “active employee,” resignation notice, termination for cause, prorating or forfeiture terms.
- Keep proof. Retain performance dashboards, sales reports, schedules, manager messages and pay statements showing the relevant work.
When should a bonus be paid?
Federal sources do not establish one payday for every bonus. The practical sequence is to identify when the bonus was earned under the plan and applicable law, then determine whether a state wage-payment rule sets a deadline for delivering earned wages.
Use the plan’s timeline
Separate these dates: the last day of the performance period, the date results are certified, the date the amount becomes payable and the actual payroll date. A plan may allow time for audits or customer cancellations before the amount is final. If language is unclear, ask payroll or human resources to identify the clause they are applying and request the answer in writing.
If you resign or are terminated
There is no federal answer that resolves every post-separation bonus dispute. The result can depend on whether the bonus was already earned, whether the plan required employment on the payout date, why employment ended and which state’s wage law applies. A resignation before the measurement period ends is different from leaving after all performance conditions were met but before the scheduled payday.

The IRS classifies bonuses and commissions as supplemental wages. Publication 15 (2026) defines supplemental wages as “wage payments to an employee that aren’t regular wages.” Employers must withhold federal income tax under the supplemental-wage rules and also apply applicable Social Security and Medicare taxes. State and local withholding follow their own rules.
Federal withholding methods
| How the bonus is paid | Federal withholding treatment described by the IRS for 2026 | What the figure means |
|---|---|---|
| Separately identified supplemental wages paid with regular wages or in a separate payment | An employer may use the optional flat 22% method when the requirements are met, or use the aggregate method. | 22% is payroll withholding, not a special final tax rate. |
| Regular and supplemental wages combined without separate identification | The combined amount is generally treated as regular wages for withholding calculations. | The result can differ from a 22% calculation. |
| Supplemental wages from the same employer above $1 million in a calendar year | Mandatory 37% withholding applies to the excess over $1 million. | This is a withholding requirement for the excess, not necessarily your final tax rate. |
| Aggregate method | The employer adds the supplemental payment to regular wages and calculates withholding using the employee’s payroll information and withholding certificate. | The amount withheld may be higher or lower than 22% depending on the payroll calculation. |
Withholding is a prepayment credited on your federal return. Your final income-tax liability is determined from your complete return, including total income, deductions, credits, filing status and other circumstances. A large amount withheld does not prove that the bonus is taxed at a permanently higher rate, and a smaller amount does not guarantee that no additional tax will be due.

Illustrative withholding example
Suppose an employer separately identifies a one-time $5,000 bonus and uses the optional 22% federal method. Federal income-tax withholding on that payment would be $1,100 ($5,000 × 0.22), before Social Security, Medicare, state or local deductions. The $1,100 is not a final assessment of the tax on those dollars; it is the amount sent through payroll under that method.
Check your pay statement for the gross bonus, federal withholding method if shown, Social Security and Medicare deductions, and state or local withholding. Ask payroll which method was used if the result is unexpected.

For most nonexempt employees, the FLSA requires overtime of at least one and one-half times the regular rate for hours over 40 in a workweek. A nondiscretionary bonus tied to services or performance generally belongs in the regular-rate calculation unless a specific statutory exclusion applies.

When the bonus is calculated or paid after the workweeks in which it was earned, the employer may need to allocate the bonus back across those weeks and pay additional overtime. The precise calculation depends on the bonus terms, hours, regular wages, exclusions and whether you are nonexempt. Exempt employees are analyzed under different rules.
| Bonus pattern | Typical FLSA regular-rate question | Practical implication |
|---|---|---|
| Predetermined formula based on units, sales, quality or attendance | Often nondiscretionary because employees can expect the payment if they meet stated criteria. | It may need to be included in the regular rate and allocated to the earning weeks. |
| Employer decides near period-end whether to pay and how much, without a prior promise | May meet the narrow discretionary test. | It may be excluded from the regular rate if all statutory conditions are satisfied. |
| Plan uses a discretionary label but announces a formula or target in advance | The label does not control; the actual promise and criteria are examined. | Ask how the employer analyzed the payment rather than relying on its name. |
The Department of Labor’s Fact Sheets 56A and 56C explain the regular-rate principles. Its January 2026 opinion letter FLSA2026-2 illustrates how predetermined, quantifiable incentive criteria can make a payment nondiscretionary on the facts presented. That letter is not a universal ruling for every plan.
Illustrative overtime allocation
Assume, solely as an example, that a nonexempt employee receives a $600 performance bonus earned evenly over four weeks, works 40 regular hours and five overtime hours each week, and no exclusion applies. Allocating $150 to each week adds $3.75 to that week’s regular rate ($150 ÷ 40 hours). The extra overtime premium attributable to the bonus is one-half of that increase for each overtime hour: $1.875 × five hours, or $9.375 per week. Across four weeks, the additional premium would be $37.50. An actual payroll calculation can differ when hours or allocation are uneven.

What to do if the payment looks wrong
- Re-read the governing document. Highlight the earning conditions, calculation, payout date and separation clause.
- Reconcile the numbers. Compare your records with the employer’s reported sales, hours, quality results or attendance data.
- Ask targeted questions in writing. Request the specific plan provision, the measurement results used, the tax-withholding method and, if relevant, the overtime allocation.
- Check your classification. Determine whether you are treated as nonexempt for overtime and whether the bonus relates to work performed during particular weeks.
- Escalate appropriately. If payroll cannot resolve the issue, contact the wage agency for the state where you worked. For substantial amounts or disputed separation terms, obtain qualified legal advice.
- Keep a complete file. Store the plan, amendments, offer letter, pay statements, time records, performance reports and all correspondence.
A practical checklist for your next bonus conversation
- What exact event makes the bonus earned?
- Is the amount formula-based or genuinely discretionary?
- Must I still be employed on a specified date?
- When are results certified and when is payment scheduled?
- How was the gross amount calculated?
- Was the bonus separately identified from regular wages?
- Which federal withholding method was used?
- Were state, local, Social Security and Medicare deductions applied?
- If I am nonexempt, was the bonus included in the regular rate for overtime?
- Which state wage agency governs my work location if the plan and payroll answer conflict?
