Valerie Bertinelli Agreed to Pay Ex Tom Vitale $2.2 Million in 2022 Divorce Settlement

Valerie Bertinelli’s divorce from Tom Vitale was finalized on November 22, 2022, under an agreement that required Bertinelli to pay Vitale $2.2 million. The reported payment was a one-time, full-and-final settlement of claims between the former spouses—not reported ongoing alimony awarded after a trial.

The reported judgment also said both parties waived spousal support under their prenuptial agreement.   • Separate living arrangements: Vitale was reportedly required to leave Bertinelli’s Malibu residence by December 31, 2022, provided the settlement had been paid.
  • Potential rent: If Vitale remained in the home after payment, reports said the agreement set rent at $50,000 per month—approximately $1,666 per day.

The Malibu provision was an occupancy and rent arrangement. It was not reported as a transfer of ownership of the property to Vitale. The move-out deadline and rent terms were reported by Us Weekly and TMZ. Public reporting does not establish whether Vitale ultimately moved out by the deadline or whether the parties later litigated enforcement of the judgment.

Why was Bertinelli paying Vitale if they had a prenup?

A prenuptial agreement does not necessarily prevent spouses from negotiating a payment when they divorce. It can define the parties’ rights, but one spouse may still challenge the agreement, dispute how it applies, or assert other claims. The parties can then settle those disputes rather than proceed through a trial.

Bertinelli and Vitale signed a prenup before their January 1, 2011, marriage. Reports said it addressed property and included a waiver of spousal support. During the divorce litigation, however, Vitale reportedly challenged the agreement’s validity. He also sought $50,000 per month in spousal support and $200,000 in attorney fees, according to reports about court filings. Those figures were requests—not confirmed final awards. Bertinelli reportedly asked for a separate proceeding concerning the validity of the premarital agreement and related financial issues. The dispute was ultimately resolved through a private settlement, rather than a publicly reported merits ruling that declared the prenup invalid or fully upheld it after trial.

California law provides several grounds on which a premarital agreement can be challenged, including questions involving voluntariness, unconscionability, disclosure, independent counsel, and execution procedures. California Family Code section 1615 describes those standards. That statute explains the general legal framework; it does not establish whether Vitale’s particular challenge would have succeeded.

The financial logic is therefore more precise than the typical headline suggests: Bertinelli agreed to pay a lump sum to resolve disputed claims, while the reported final terms waived ongoing spousal support. The $2.2 million should not automatically be labeled alimony.

Settlement versus court-ordered alimony

The distinction matters. An alimony or spousal-support award generally refers to payments made to support one spouse after separation or divorce. In this case, the reports describing the final paperwork said both parties waived spousal support. They separately described the $2.2 million as a settlement payment.

A more accurate description is:

The safest conclusion is that the public reports identify $2.2 million as the settlement payment and separately report the earlier $500,000 transfer. It would be imprecise to say that the final settlement itself totaled exactly $2.7 million unless the underlying judgment expressly classified the earlier transfer as part of the settlement.

Timeline of the Bertinelli–Vitale divorce

2004–2011: Relationship, engagement, and marriage

Bertinelli and Vitale reportedly met in 2004, became engaged in 2010, and married at Bertinelli’s Malibu home on January 1, 2011. They signed a prenuptial agreement before marrying. They did not have children together. Bertinelli has a son, Wolfgang Van Halen, from her prior marriage.

December 2019: Disputed separation date

Bertinelli’s divorce filing reportedly listed December 1, 2019, as the date of separation. Later reporting about Vitale’s filings said he disputed that date and claimed the separation occurred in December 2021. Because the parties reportedly gave different dates, the disagreement should not be presented as an uncontested fact.

November 2021: Legal-separation filing

Bertinelli filed for legal separation in November 2021, citing irreconcilable differences. Reports said the filing sought to prevent either party from receiving spousal support and referenced the prenup. TMZ reported on that filing.

May 12, 2022: Divorce filing

Bertinelli filed for dissolution of marriage in Los Angeles Superior Court on May 12, 2022. The filing cited irreconcilable differences and reportedly described the prenup as binding or in full force and effect.

May 24, 2022: Reported $500,000 transfer

According to later coverage of the final documents, Bertinelli transferred $500,000 to Vitale’s checking account on May 24. Public reports do not give a complete explanation of the payment’s legal category or whether it was credited against a specific claim.

June–July 2022: Support and prenup dispute

Vitale reportedly sought $50,000 per month in spousal support and $200,000 in attorney fees while challenging the prenup. Some coverage also described his claims about an employment gap, a lapsed financial-planning license, and low-paid work. Those statements came from reports about litigation filings and represent Vitale’s position, not independently established financial findings.

September 2022: Private settlement

By late September, the parties had settled the financial and prenup-related disputes in proceedings handled by private judge Hank Goldberg. Reports said neither party appeared in court. At that point, the precise financial terms were not yet widely reported. Extra reported on the September private settlement.

November 22, 2022: Divorce finalized

The dissolution was finalized on November 22, 2022, when the reported judgment was signed and filed. On that date, Bertinelli also publicly celebrated being “happily divorced” in an airport video. ABC News covered her reaction and the finalization.

The reported settlement terms answer the headline question but not every financial question. Available public coverage does not establish:

  • How the $2.2 million was calculated.
  • Whether it represented property equalization, a compromise of support claims, potential attorney-fee exposure, reimbursement, or some combination.
  • Whether the $500,000 transfer was credited against a particular claim or obligation.
  • The tax treatment of either payment.
