As of the latest reported court update, a judge had extended an administrative stay through October 13, 2026, pausing deadlines in certain reassignment letters while he considered whether to issue a broader preliminary injunction. The legality of the plan remains unresolved.
What the court pause does—and does not do
The temporary stay holds deadlines in management-directed reassignment letters covered by the court’s order. It is a procedural pause while the judge considers the employees’ request for a preliminary injunction; it is not a final ruling that USDA’s plan is unlawful. Government Executive reported the extension on September 30, 2026, with the stay then set to run through October 13, 2026 (Government Executive’s report).
The reported request for a preliminary injunction is broader than the existing temporary stay. Government Executive said such an injunction could affect relocation plans for about 2,600 employees. That is reported context about the potential reach of the requested relief, not a confirmed count of employees who will ultimately relocate or leave.
What USDA announced and why
On July 24, 2025, Agriculture Secretary Brooke Rollins announced a phased reorganization that would relocate much of USDA’s agency headquarters and National Capital Region staff to five hubs. USDA said the move would bring staff closer to the people and communities the department serves and offer employees a more affordable cost of living (USDA’s announcement).

USDA also cited the condition and use of its Washington headquarters: approximately $1.3 billion in deferred maintenance and average daily occupancy below 1,900 in a building that can house more than 6,000 employees. Those figures are USDA’s 2025 figures, not independent estimates established here. The department’s public page describes the process as phased and says some logistics remain subject to union negotiations (USDA’s reorganization page).
What the lawsuit challenges
The plaintiffs’ challenge centers on whether provisions in FY2026 appropriations law restrict USDA’s ability to carry out the reorganization, and on how clauses requiring committee approval operate. A court order filed August 21, 2026, directed the parties to provide supplemental briefing on constitutional and severability questions. That order asked for more argument; it did not decide the dispute or rule for either side (August 21 court order).

Timeline: announcement to temporary stay
- July 24, 2025: Rollins announced the phased plan and USDA stated its mission and cost rationale.
- April 30–May 30, 2026: USDA says it notified Congress on April 30 and that the 30-day notification period ended May 30. This is the department’s account of its process, not a resolution of the court challenge.
- August 21, 2026: The district court ordered supplemental briefing on appropriations restrictions and constitutional and severability questions.
- September 30, 2026: Government Executive reported that Judge Vince Chhabria had extended the administrative stay through October 13 while considering the request for a preliminary injunction.
What USDA employees should understand
The stay’s reported effect is limited to covered reassignment-letter deadlines. It does not establish what will happen to every employee who does not relocate, and the available sources do not provide a complete employee-by-employee account or a final count of people who will move, remain, or leave. Employees should distinguish the deadlines covered by the court’s order from other communications or obligations, and consult their agency and union for guidance specific to their position.
The status described here reflects the latest located report, dated September 30, 2026. Because the stay was set to expire October 13 and court proceedings can change quickly, check for a newer court order or agency notice before relying on that date.
