US expands export blacklist to keep advanced computing technology out of China

The US is expanding export controls to restrict China’s access to advanced AI chips, semiconductor tools, EDA software and computing infrastructure. Here is what the Entity List does, what remains licensable and how the rules evolved through August 2026.

The United States has not imposed a blanket ban on Chinese technology companies. Instead, Washington is tightening a layered export-control system aimed at limiting China’s access to the chips, software, manufacturing equipment, data centers and technical services needed for large-scale artificial intelligence and military computing.

The headline most likely refers to the Commerce Department’s March 25, 2025 addition of 80 entities to the Entity List. That action is one step in a policy campaign that began in 2022 and continued through new licensing rules and guidance issued in 2026.

What happened on March 25, 2025?

The Bureau of Industry and Security (BIS) added 80 organizations across China and several other jurisdictions to the Entity List. BIS said the targets were connected to advanced artificial intelligence, high-performance and exascale computing, quantum technology, military modernization, hypersonic weapons and technology diversion.

The announcement was primarily an Entity List expansion, not a single worldwide prohibition on every transaction involving China. The broader restrictions come from several BIS rules covering advanced-computing chips, semiconductor equipment, foreign-produced items, end uses and access to computing capacity. BIS’s announcement is available at its March 25 release.

What the Entity List actually means

The Entity List identifies organizations that BIS considers a national-security or foreign-policy risk. A listed party generally needs a BIS license to receive items subject to the Export Administration Regulations (EAR). The exact requirement depends on the individual listing, including the items covered and the applicable license-review policy.

“Subject to the EAR” can include more than U.S.-made products. Certain foreign-produced goods, software and technology can fall under U.S. jurisdiction through foreign-direct-product rules, de minimis provisions or Entity List-specific provisions.

Entity List placement is therefore not identical to a total embargo or sanctions designation. A listed company may still conduct some business, but ordinary access to controlled U.S. technology can become impractical or unavailable without authorization. The list also differs from investment restrictions, procurement bans and sanctions, which are separate legal regimes.

Which Chinese organizations are being targeted?

The policy focuses on functions in the computing supply chain rather than one industry alone. Targeted categories include:

  • AI-model developers and advanced-computing researchers;
  • designers of advanced AI accelerators;
  • cloud-computing and data-center operators;
  • supercomputing centers and military-linked universities;
  • semiconductor manufacturers, lithography companies and foundries;
  • electronic-design-automation (EDA) providers and users; and
  • organizations accused of procuring or diverting controlled technology for military, quantum or weapons programs.

The entities added in March 2025 were part of this wider pattern. Earlier and later actions also named chip designers, research bodies and semiconductor-related organizations.

What technology is covered?

AI chips and complete systems

Controls cover advanced AI accelerators and other high-performance integrated circuits, including items classified under ECCNs such as 3A090.a and 3A090.b. Depending on the rule, thresholds can involve total processing performance, memory bandwidth, interconnect capability and system configuration. A server containing a controlled chip can be restricted even when the transaction is marketed as a complete system rather than a chip sale.

Semiconductor manufacturing and design

BIS also controls advanced manufacturing equipment, lithography and multi-patterning tools, and the software and technology used to design and produce advanced-node chips. The Cadence case demonstrates that enforcement reaches beyond finished processors: BIS said Cadence transferred EDA hardware, software and design technology to Chinese entities tied to military supercomputing. The company agreed to a $95 million BIS penalty, alongside a separate $45 million forfeiture agreement with the Justice Department. See BIS’s enforcement announcement.

Cloud and data-center capacity

Physical shipment is not the only issue. Advanced-computing commodities and access used to train AI models can raise licensing questions when a provider knows of military-intelligence or weapons-of-mass-destruction end uses. Who owns the chips, where they are installed, who can log in and what workloads are run can all matter.

U.S. persons and use of Chinese chips

In May 2025, BIS warned that using specified Chinese advanced-computing integrated circuits, including certain Huawei Ascend products, could create exposure under General Prohibition 10 if the chips were developed or produced in violation of U.S. controls. The guidance is not a declaration that every Ascend chip is illegal; it describes potential liability for transactions involving items known to be made in violation of the EAR. Why Washington is targeting computing capacity

BIS says advanced computing can support military modernization, hypersonic weapons, nuclear and other weapons research, intelligence operations, surveillance and quantum programs. The strategic logic is that leading AI capability depends on an entire ecosystem:

  • accelerators and high-bandwidth memory;
  • fast networking and interconnects;
  • large, reliable data centers;
  • model-training and inference software;
  • EDA tools and advanced manufacturing equipment; and
  • specialized engineers and cloud operations.

Restricting one processor model would leave many alternative routes open. The United States is instead trying to raise the cost of obtaining the highest-value components and services across that stack.

How the policy evolved

Date Development
October 2022 BIS introduced major controls on advanced computing, supercomputer-related end uses and semiconductor-manufacturing equipment for China. See BIS’s overview.
October 2023 The United States updated advanced-computing and equipment controls and added Chinese AI-chip and supercomputing entities to the Entity List. The public-inspection notice is at BIS.
January 15, 2025 BIS updated semiconductor controls, added 11 Chinese entities and strengthened foundry due diligence. See the announcement.
March 25, 2025 BIS added 80 entities linked to AI, advanced computing, quantum technology, military applications and diversion.
May 13, 2025 BIS issued General Prohibition 10 guidance concerning specified PRC advanced-computing ICs.
July 28, 2025 BIS announced the Cadence EDA enforcement case.
August 29, 2025 BIS closed a loophole involving foreign-owned semiconductor fabs in China and the Validated End-User program. See the release.
January 2026 A final rule created a case-by-case licensing route for some advanced-node IC exports to China or Macau, subject to technical and security conditions. The rule is at Federal Register.
May 31, 2026 BIS clarified that licensing requirements can follow an entity headquartered in China, Macau or another Country Group D:5 jurisdiction even when shipment or installation occurs elsewhere. See the guidance.

How Washington is closing workarounds

Third-country routing and parent companies

A shipping address outside China does not settle the analysis. BIS’s May 2026 guidance addresses recipients headquartered in, or ultimately controlled by a parent headquartered in, China, Macau or another D:5 destination. Companies must examine ownership and control, not just the invoice address.

Cloud access and resellers

Cloud hosting, intermediaries and resellers can still create export-control questions. The relevant facts include chip ownership, installation site, user identity, workload, technical support and knowledge of a prohibited end use.

Foreign-owned fabs and validated users

The Validated End User (VEU) framework can authorize specified entities to receive specified items without an individual license for every shipment. It is facility-specific, not a blanket exemption. BIS evaluates compliance history, technology-control plans, physical security, ownership, on-site review, chip accounting and where computing capacity may be installed or transferred. Part 748 of the EAR describes licensing and VEU provisions: BIS Part 748.

What may still be permitted?

Some transactions can remain possible, but permission depends on the exact item, destination, end user, end use and rule in force:

  • BIS licenses, including the January 2026 case-by-case route for certain chips below 21,000 total processing performance (TPP) and 6,500 GB/s of total DRAM bandwidth, with U.S. third-party testing and customer safeguards;
  • VEU authorizations for specifically approved facilities and activities;
  • license exceptions such as NAC or ACA where every eligibility condition is met; and
  • lower-performance or otherwise non-controlled products after classification and end-use review.

The January 2026 rule did not restore unrestricted sales. Its thresholds and safeguards include physical security, know-your-customer controls and restrictions on infrastructure-as-a-service access. Part 740 sets out license exceptions and their limitations: BIS Part 740.

What the restrictions mean for China and U.S. businesses

For China, the controls can make access to leading foreign accelerators, manufacturing tools and design software slower, more expensive and less predictable. They do not prove that Chinese companies have lost the ability to develop AI. Domestic chips, older equipment, alternative suppliers and new software remain potential sources of capability, although performance, production scale and manufacturing access differ by product.

For U.S. companies, the policy can reduce sales in China and increase classification, screening, licensing and audit costs. Multinational cloud and semiconductor businesses also face uncertainty when ownership, data-center location and technical support cross borders. Controls may encourage China to accelerate domestic substitutes and can invite retaliation. Whether the strategic benefits outweigh those costs remains a policy debate; the available rules establish constraints, not a definitive outcome.

A practical compliance checklist

Companies evaluating a chip, server, software, cloud or semiconductor-equipment transaction should document the following before proceeding:

  1. Classify the item. Determine the ECCN and jurisdiction; do not rely only on a product’s marketing name.
  2. Measure technical specifications. Check processing performance, memory bandwidth, interconnects and complete-system configuration.
  3. Map destinations. Identify final destination, intermediate locations and the site where the item or capacity will be installed.
  4. Screen the full organization. Review the customer, parent, subsidiaries, universities, laboratories and beneficial owners against the Entity List and other restricted-party lists.
  5. Assess end use. Investigate AI training, supercomputing, military, intelligence, nuclear, hypersonic and surveillance applications.
  6. Analyze foreign-produced content. Check foreign-direct-product, de minimis and Entity List provisions for software, technology, equipment and components.
  7. Review cloud arrangements. Establish who owns the chips, who can access them and which workloads are allowed.
  8. Preserve evidence. Keep technical specifications, certifications, customer representations, screening results and escalation records.
  9. Confirm an authorization. Verify that a license, exception or VEU authorization actually covers the item and transaction.
  10. Recheck the rules. BIS changes Entity List entries and technical controls; an old classification may no longer be reliable.

Transaction-specific decisions should be reviewed by qualified export-control counsel. The free BIS Consolidated Screening List and BIS’s SNAP-R licensing system are useful starting points, but neither replaces classification, ownership and end-use analysis.

Bottom line

The United States is trying to deny China access to the most strategically valuable parts of the AI-computing ecosystem. The March 2025 Entity List expansion is an important milestone, but the policy is a continuing licensing and enforcement regime—not a universal ban on Chinese companies or every technology transaction involving China. It raises the cost and complexity of obtaining leading-edge capability while leaving room for licensed trade, approved users and China’s own efforts to build alternatives.

Frequently Asked Questions

Does being on the Entity List prohibit all business with a Chinese company?

No. It generally creates a license requirement for specified items subject to the EAR. The exact listing, item, destination, end user and end use determine whether a transaction can proceed.

Are all Chinese-made AI chips illegal for U.S. companies to use?

No. BIS’s May 2025 guidance addresses potential General Prohibition 10 exposure for specified chips believed to have been developed or produced in violation of U.S. controls. Legality depends on the particular chip, circumstances and applicable EAR provisions.

Can a company avoid the rules by shipping to a third country?
