US blindsides states with surprise Live Nation settlement during Ticketmaster trial

The DOJ’s mid-trial settlement with Live Nation did not end the states’ case. Six states joined the proposal; 34 states and D.C. continued to trial and won a liability verdict, with remedies still to be determined.

The U.S. Department of Justice announced a proposed settlement with Live Nation during the antitrust trial, but the deal did not end the case for the states that refused to join it. Six states signed on; 34 states and the District of Columbia continued to trial and won a jury liability verdict on April 15, 2026. The states’ remedies and financial penalties remained to be decided, while the DOJ settlement was still described in a proposed judgment rather than a confirmed final order in materials available through Oct. 8, 2026.

Why states called the settlement a surprise

The DOJ’s Antitrust Division and state co-plaintiffs sued Live Nation Entertainment and Ticketmaster in the Southern District of New York on May 23, 2024. Their complaint alleged anticompetitive conduct involving primary ticketing at major concert venues, concert promotion and large amphitheaters. Those were allegations at the time, not findings of liability.

The trial began in March 2026. During the trial, the DOJ and Live Nation announced a proposed settlement. States that did not join reportedly felt blindsided by the mid-trial announcement; “surprise” describes their reaction to the timing, not a finding about whether the proposed terms were adequate.

The DOJ’s March 9 notice attached a term sheet discussed in court. It said Ticketmaster would enable venues using its back-office system to distribute primary tickets through third-party marketplaces selected by the venues, with terms intended to limit restrictions on venue choice. It also addressed exclusivity and other venue and ticketing commitments. The notice said the agreement could not be final until reduced to a proposed final judgment signed by the parties and the Tunney Act requirements were met.

What the proposed DOJ deal covered—and who joined

Six states joined the proposed settlement: Arkansas, Iowa, Mississippi, Nebraska, Oklahoma and South Dakota. The other 34 states and the District of Columbia continued their claims at trial. The settlement proposal and the continuing state case therefore had different participants and different procedural paths.

Ticketing and venue terms The March term sheet addressed third-party marketplace access through Ticketmaster’s back-office system, venue choice and exclusivity. NAAG’s summary of the proposed remedies also included a 15% cap on ticketing service fees. The jury later found liability on state claims involving primary ticketing at major venues, among other findings; the states’ remedies were left for a separate stage.
Structural measures NAAG’s summary included divestiture of long-term booking agreements for 13 amphitheaters. The proposed terms described here did not provide for a breakup of Live Nation. Tennessee’s attorney general said a breakup was among the remedies that could be considered. No final remedy had been established in the materials available through Oct. 8, 2026.
Money and status A proposed final judgment filed June 12, 2026 listed payments to the six settling states. Filing a proposed judgment does not by itself establish that it was entered or that payments were made. The jury returned a liability verdict on April 15, 2026. Remedies and financial penalties were to be addressed separately.

The access, fee-cap and amphitheater provisions are proposed settlement terms, not evidence that those changes had already taken effect. The deal was not a single resolution binding every state plaintiff.

What the jury decided in the states’ case

On April 15, 2026, the jury found Live Nation and Ticketmaster liable for antitrust violations in the case pursued by the states that stayed in. Tennessee Attorney General Jonathan Skrmetti said the jury found unlawful monopoly maintenance in primary ticketing for major venues, a Live Nation monopoly in large amphitheaters, and unlawful conditioning of artists’ use of company-controlled amphitheaters on their use of Live Nation promotion services.

Skrmetti characterized the verdict by saying, “A jury determined that Live Nation and Ticketmaster are an illegal monopoly.” He also said a breakup was “absolutely on the table.” Those are the attorney general’s descriptions and view of possible relief; the verdict was a liability finding, not a final order specifying remedies. The states’ coalition said remedies and financial penalties would be heard separately.

What the proposed judgment says about payments

The DOJ case page listed a proposed final judgment filed June 12, 2026. Its state-specific provisions set out these proposed settlement payments, which the document says resolve specified monetary-relief and civil-penalty claims:

These are amounts in a filed proposal, not proof of final approval or payment. The available materials do not establish a later court order entering the judgment.

How to read Live Nation’s account of the jury award

Live Nation’s public response said the jury awarded $1.72 per ticket for a limited group of tickets sold at 257 venues—about 20% of total tickets, according to the company. It said the calculation covered fan purchases, excluding brokers, in certain states over five years. These scope descriptions and figures are Live Nation’s characterization, not an independently established final damages calculation in the materials cited here.

Based on that account, Live Nation estimated aggregate single damages below $150 million before trebling, and said it had accrued $280 million toward state damages and civil-penalty claims in connection with the DOJ settlement. The company also said it planned to renew its motion for judgment as a matter of law and challenge the damages testimony. Those statements describe the defendant’s position and reported accounting, not a final court ruling on damages or the motions.

What ticket buyers should—and should not—take from the case

The proposed settlement focused on ticketing access, venue choice, exclusivity, service fees and amphitheater booking agreements. If approved and implemented, those provisions could affect the choices available to venues and the way tickets are distributed. But the announcement alone did not establish that venues had gained new marketplace options, that fees had changed, or that competition had increased.

Likewise, the states’ liability verdict did not itself set a final remedy or establish a final consumer refund. The distinction matters to ticket buyers: proposed conduct changes, a jury’s liability findings and an entered remedy are separate legal events. The later remedy orders and the final status of the DOJ settlement would determine what changes, if any, become binding.
