UnitedHealthcare Calls Doctor Mid-Surgery About Patient’s Overnight Stay: What’s Known

Dr. Elisabeth Potter said a UnitedHealthcare-related call about her patient came to the hospital while she was performing breast reconstruction, and she chose to leave the operating room to return it. UnitedHealth Group later said the outpatient surgery and overnight observation had already been approved, and that its medical director was seeking clarification about a separate inpatient request. The two accounts differ about the circumstances and purpose of the contact, and the available reporting does not independently settle that dispute.

What Potter said happened during surgery

Fox News reported on January 17, 2025, that Austin plastic surgeon Dr. Elisabeth Potter was performing a DIEP flap breast reconstruction when a nurse supervisor brought her a message about a UnitedHealthcare call concerning the patient. Potter said she decided to scrub out and return the call because she feared a coverage denial. She said the patient remained safe with another surgeon and the anesthesia team, and told Fox News: “I made that judgment call and I stand by that — I think it was the right thing to do for the patient.” Fox News reported that Potter also said the insurer did not require her to leave the operating room or threaten to deny coverage.

The report included Potter’s estimate that she had performed 520 surgeries for cancer patients in the prior year and her concern that she had seen patients face potential bills of $80,000–$100,000. Those are Potter’s reported figures and concerns; they are not a verified bill for the patient in this incident.

How UnitedHealth Group described the call

In a February 19, 2025 statement, UnitedHealth Group said it approved the outpatient surgery and post-surgical overnight observation on December 27, 2024, within two hours of receiving the request. The company said a separate inpatient-stay request was submitted after those approvals, called that request erroneous, and said a medical director contacted the hospital to clarify it. UnitedHealth Group said the caller sought to speak with the nurse caring for the patient, not to be transferred to the operating room or to speak with Potter during surgery. That is the company’s account; the underlying authorization records and communications are not available in the cited material. UnitedHealth Group’s statement said: “UnitedHealthcare approved the outpatient surgery and the post-surgical overnight observation stay on 12/27/24 within two hours of the request being submitted.”

Why an overnight hospital stay may still be outpatient

“Overnight stay” describes how long a patient remains at the hospital; it does not, by itself, establish inpatient status. Under Medicare guidance, inpatient status follows a formal admission based on a doctor’s order. A patient having outpatient surgery or receiving observation services can stay overnight and still be classified as an outpatient. Observation is an outpatient service used while clinicians decide whether to admit a patient or discharge them.

The status distinction can affect what a patient owes after discharge. Medicare advises patients and caregivers to ask the doctor or hospital whether the patient is an inpatient or outpatient. Medicare Advantage costs and coverage can differ from Original Medicare, and the applicable plan documents govern a member’s specific benefits.

Authorization and hospital status are related but separate questions

In the company’s account, the outpatient procedure and overnight observation were approved, while a later request concerned a separate inpatient classification. Those are not interchangeable approvals: approval for outpatient surgery or observation does not, on its own, answer whether an inpatient admission is authorized. Nor do the accounts establish what the patient’s actual plan required or what the medical record supported.

For Medicare, CMS’s Two-Midnight Rule generally supports Part A payment for inpatient admissions when the admitting practitioner expected hospital care to cross two midnights and the medical record supports that expectation. CMS also describes case-by-case review for some shorter expected stays when documentation supports inpatient necessity. This is Medicare guidance, not a universal rule for commercial insurance or a way to determine this patient’s benefits.

UnitedHealthcare’s 2026 Care Provider Administrative Guide describes medical-necessity review and says providers may be asked for more information. Its provisions vary by plan and section, so a member’s own plan documents—not a general provider guide—are the place to check specific coverage, authorization, and appeal terms.

What patients and caregivers can ask if a stay’s status is unclear

When a hospital stay may be classified as observation or inpatient, ask the hospital team to identify the current status and explain whether a formal admission order has been entered. If the plan is involved in an authorization review, ask which service and status the decision concerns; an outpatient procedure, observation stay, and inpatient admission can be separate requests.

  • Ask the hospital whether the patient is currently an inpatient or receiving outpatient observation, and request an explanation of any status change.
  • Ask the insurer or plan administrator which specific service or admission request was approved, denied, or is awaiting information.
  • Review the member’s plan documents for cost-sharing, medical-necessity rules, and appeal procedures; do not infer an individual entitlement from Medicare rules or a general provider guide.
  • Keep written notices and note the date, contact, and reference number for calls about authorization or status.

What remains unresolved in this incident

Potter’s account and UnitedHealth Group’s later explanation differ on the contact’s circumstances and purpose. Fox News reports Potter said the insurer did not demand that she leave surgery or threaten denial, while the company said it did not ask to speak with her during surgery. The available sources do not include a call recording or the underlying authorization and order documents, so they do not establish exactly how the message reached the operating room or whether the patient’s clinical documentation supported inpatient status.
