Unemployment benefits are payments from a state program for eligible workers; severance is money paid by a former employer after a job ends. They have different rules and payers, and receiving severance does not have one nationwide effect on unemployment eligibility or when benefits can start. State law and the way the employer pays severance matter.

What severance means—and whether an employer must pay it
Severance is a payment or other compensation connected with ending employment. Its terms may be set out in a severance agreement, employment contract, or another applicable arrangement. Check the written terms for the amount, payment schedule, conditions, and any release or other obligations tied to accepting the offer.

Federal wage law does not generally require severance pay. The U.S. Department of Labor states, “There is no requirement in the Fair Labor Standards Act (FLSA) for severance pay.” Whether you are entitled to a payment therefore depends on the agreement or other applicable rules, not on a universal federal severance formula. Possibly, but there is no single answer that applies across the United States. The IRS says a person receiving severance may also be eligible for unemployment compensation, while noting that in most states unemployment compensation is not payable while a former employee is receiving severance. A lump sum, installments, or salary continuation may be treated differently under state rules. Do not assume you must wait for severance to run out, or assume that you can receive both payments at once. Contact the unemployment agency for the state where you should file, explain exactly how the employer is paying you, and report the payment as the agency instructs.
Who qualifies for unemployment, and where should you file?
Unemployment insurance is a federal-state program, but each state administers its own program and sets eligibility requirements under state law. File with the appropriate state unemployment agency and ask it to assess your circumstances. Contact the agency promptly after losing your job rather than waiting for severance payments to end. The state can explain when to file and how to report the severance arrangement; waiting may complicate your claim or leave you unsure about state filing requirements.
When might unemployment payments start, and how long can they last?
The Department of Labor says it generally takes two to three weeks after filing to receive a first unemployment benefit check. That is general guidance, not a promise about an individual claim or a timeline that accounts for every state’s process. State law sets benefit amounts and duration. The Department of Labor’s Employment and Training Administration says benefits may be paid for a maximum of 26 weeks in most states, with possible additional weeks in some circumstances. Both are generally subject to federal income tax. Severance is generally paid through payroll and reported by the employer as wages. Unemployment compensation is generally reported to you on Form 1099-G and included in federal income. IRS: Unemployment Compensation IRS: What if I lose my job?

You may request federal income-tax withholding from unemployment compensation; IRS Publication 525 (2025) describes optional withholding at 10% when requested. You may instead need to make estimated tax payments, depending on your overall tax situation. Check the current IRS instructions for the tax year that applies to your payments.
Keep your severance agreement, final pay statements, unemployment payment records, and tax forms together. They can help you check what was paid and reported when you file your return or ask the state agency to review your claim.
