Yes, open-source software can be subject to U.S. export controls. The label “open source” does not decide the issue. Under the Export Administration Regulations (EAR), some unclassified software or technology may fall outside the EAR when it is genuinely published for the public without restrictions on further dissemination. But the rule has exceptions, and encryption, restricted access, foreign-person access to controlled material, and end-use or end-user restrictions can change the analysis.
When does the EAR treat software or technology as published?
The EAR’s publication rule turns on how material is made available, not on whether its license calls it open source. BIS says in EAR §734.7 that unclassified “technology” or “software” is “published,” and thus not subject to the EAR, when it has been made available to the public without restrictions upon its further dissemination. BIS gives public libraries, public websites, and other unrestricted dissemination as examples.
That rule is not a blanket exemption for everything posted online. The material must meet the rule’s conditions, and the EAR contains explicit exceptions. The exact material, how it is shared, its destination, and its intended end user and end use all matter. A public repository may support a publication analysis for some unclassified code, but a repository’s visibility alone does not resolve every export-control question.
Does putting code on GitHub count as an export?
A public repository can make code available to the public, but the platform name is not a legal conclusion. Assess whether the specific code or technology is unclassified and available without restrictions on further dissemination, and whether an exception applies. A private repository, invite-only project, or other restricted channel does not have the same public-access facts as an unrestricted public release.

Also identify exactly what the release contains. A repository can include source code, object code, technical documentation, models, or access to a service; those items should not be treated as interchangeable. A determination about one component does not automatically settle the status of the rest.
How do encryption and incorporated open-source code differ?
Encryption is a key exception to any assumption that publicly available code is automatically outside the EAR. BIS explains that open-source code itself may be publicly available and not subject to the EAR, while an item that incorporates or calls that code is not considered publicly available merely for that reason. Encryption source code and object code may remain subject to the EAR unless the relevant public-availability conditions or other applicable requirements are met.

Depending on the item and circumstances, the applicable path may involve classification, notification, access controls, a license exception, or BIS authorization. License Exception ENC has destination and recipient limits, including restrictions involving Country Groups E:1 and E:2. Do not assume that an encryption library’s public status settles the status of a product built with it, or that a license exception permits distribution to every recipient or destination.
When can contributor access be a deemed export or reexport?
A release of EAR-controlled technology or source code to a foreign person in the United States can be a deemed export to that person’s most recent country of citizenship or permanent residency. BIS also describes a deemed reexport when controlled technology or source code is released in one foreign country to a national of another foreign country.

For a project involving controlled material, access is not limited to downloading a release. Consider who can view private repositories, issue discussions, build and deployment systems, documentation, support channels, or other project information. A contributor’s ability to see controlled technology or source code may require analysis even if the software is not being shipped as a physical product.
How do access and distribution choices affect the analysis?

These are screening distinctions, not automatic outcomes. Source versus object code, ordinary versus encryption functionality, U.S.-person versus foreign-person access, destination and country group, and recipient and intended use can all affect the required analysis.

Why can end users and end uses matter even after publication?
Publication analysis does not erase every export-control restriction. EAR Part 744 includes controls for specified military end uses and military end users, including controls involving certain microprocessors and associated software and technology. Restrictions can depend on the recipient and intended use, so evaluate them separately rather than treating a public release or a potentially applicable license exception as universal permission.

A practical review before releasing code or inviting contributors
- Inventory the material. Identify the exact technology, source code, object code, model, documentation, or service involved; note which components provide encryption functionality.
- Assess publication. Determine whether the material is unclassified and genuinely available to the public without restrictions on further dissemination.
- Check exceptions. Review the relevant provisions in EAR Part 734, including the exceptions concerning encryption and firearm-production technology or software.
- Review access by foreign persons. Identify who can access controlled technology or source code, where the release occurs, and whether a deemed export or deemed reexport analysis is needed.
- Screen destination, recipient, and use. Evaluate applicable destination and country-group limits under Part 740, as well as end-user and end-use restrictions under Part 744.
- Keep a record of the decision. Document the classification and any applicable notification, access-control, license-exception, licensing, or authorization decision. If the facts do not clearly fit a rule, seek guidance from BIS or qualified export-control counsel.
What to remember
- “Open source” is not an EAR classification; the publication rule and its exceptions are what matter.
- A public code release may qualify for the publication rule in some circumstances, but encryption and other exceptions require separate attention.
- Access to controlled technology or source code can create deemed-export or deemed-reexport issues, including in collaborative software projects.
- Destination, end user, and end use remain part of the compliance analysis.
