Depending on the help needed, alternatives such as supported decision-making, a power of attorney, or a representative payee may provide assistance while preserving more of the person’s decision-making authority.
What is conservatorship?
A conservatorship is a legal arrangement in which a court appoints someone to make or manage decisions for another person in the areas stated in a court order. The order—not the label alone—defines the conservator’s authority.
State law controls the terminology and process. Some states use “guardian” for personal decisions and “conservator” for property, while others use these terms differently. The Uniform Law Commission describes the Uniform Probate Code’s general distinction this way and notes that state usage varies: Uniform Law Commission overview of the Uniform Guardianship, Conservatorship, and Other Protective Arrangements Act.
Needing help, having a disability, or receiving a diagnosis does not by itself establish that conservatorship is appropriate. The relevant question is what decisions need support and whether a less restrictive option can meet that need.

What are the different types of conservatorship?
California provides a useful example of how authority can differ by both breadth and subject matter. These categories should not be assumed to apply in the same way in other states.
General conservatorship
In California, a general conservatorship gives the conservator broad powers and responsibilities, except for powers the court determines are unnecessary. The court order sets the actual authority. California Courts: Conservatorships.

Limited conservatorship
California uses limited conservatorships for people with developmental disabilities when the arrangement is necessary to promote and protect their well-being. The judge considers requested powers individually and grants only those found necessary. Possible powers include decisions about residence, medical consent, contracts, education, and specified personal matters. The person retains rights that the court order does not transfer. The stated aim is to encourage maximum self-reliance and independence. California Courts: Limited conservatorships.
Conservatorship of the person or the estate
A conservatorship of the person concerns care and protection. A conservatorship of the estate concerns management of finances or property. A case may involve one or both, depending on the person’s needs and the court’s order.

Mental health or LPS conservatorship
California’s general conservatorship guidance does not cover LPS conservatorships, which are a separate, specialized subject. Their eligibility and procedures should be checked in current state law and official local resources rather than inferred from the general or limited categories.
What are alternatives to conservatorship?
Alternatives address different kinds of support and confer different levels of authority. California Courts compares them by the assistance provided and the oversight involved; the fit depends on the decisions at issue and applicable legal requirements.

- Scope: Is help needed with health care, daily care, benefits, bills, other finances, or several areas?
- Decision-making authority: Can the person make the decision with support, or does someone else need authority to act?
- Oversight: What court, agency, or other review applies, if any?
- Flexibility: Can the arrangement or appointed authority be changed or ended, and what legal steps apply?
- Fit: Does the option address the actual need without granting broader authority than necessary?
California’s Judicial Council form GC-312 asks a conservatorship petitioner to consider alternatives—including supported decision-making, a health care surrogate, an advance health care directive, a power of attorney, and a trust—and explain why they would not meet the proposed conservatee’s needs. That is a California procedure, not a universal checklist. California Judicial Council form GC-312.
Where to get jurisdiction-specific guidance
Because state law defines the available arrangements and their procedures, consult official court or government resources in the relevant state. For advice about a particular person or case, California Courts recommends speaking with a lawyer. A qualified local attorney can explain which options are available and how the court order would affect the person’s rights.
