H-1B, L-1, and O-1 visas serve different purposes: H-1B is for specialty-occupation work, L-1 is for a qualifying transfer within a related multinational organization, and O-1 is for people who meet an extraordinary-ability standard in a covered field. The right category depends on the job, the employer’s structure, and the worker’s qualifications and record—not simply on which visa sounds most attractive.
Use the comparison below to identify which route may fit the facts. It is a screening guide, not a legal determination: each petition is assessed under the requirements of the specific classification requested.

How do H-1B, L-1, and O-1 differ?
The defining difference is the legal basis for the temporary U.S. work. H-1B focuses on the occupation and the work to be performed. L-1 focuses on a qualifying relationship between U.S. and foreign organizations, plus the worker’s prior employment abroad and proposed role. O-1 focuses on the worker’s extraordinary ability in a covered field.

USCIS describes Form I-129 as an employer petition for a beneficiary to come temporarily to the United States to perform services or labor, or to receive training. The instructions for that form, dated January 17, 2025, identify H-1B, L-1, and O-1 among the covered classifications. That shared petition framework does not make the visa categories interchangeable: the eligibility case and supporting evidence differ.

In practical terms, the first comparison is not which label sounds most flexible. It is whether the proposed position, corporate structure, and worker’s record fit a category’s particular legal basis. A worker may potentially meet the requirements for more than one classification, but the petition must establish eligibility for the one being requested.
When might H-1B fit?
The job is the starting point
H-1B is the category to examine when a U.S. employer is offering specialty-occupation employment. The petition must address the qualifying nature of the work and the proposed employment; a worker’s education or experience alone does not turn any job into a specialty occupation. The position and the worker’s qualifications need to be considered together.
For that reason, an H-1B discussion should begin with the actual duties and requirements of the role, not just its title. A familiar-sounding professional title is not, by itself, proof that the job meets the classification’s standard. The employer’s petition must support the category sought.
Cap and duration figures need a date attached
USCIS’s FY 2023 report described an annual H-1B cap of 65,000 regular slots and an additional 20,000 exemption for certain U.S. advanced-degree holders. These are figures from that report, not a confirmation of the procedure, dates, or availability for a later cap season. Anyone planning a current filing should check USCIS’s latest cap-season information rather than rely on historical figures alone.
The same FY 2023 report described H-1B admission as generally limited to six years and an initial petition as generally approved for up to three years. Those are general report-era descriptions, not a guarantee of a particular person’s authorized stay or a complete account of exceptions. The petition and the individual’s immigration history matter; confirm current rules and the period authorized in the person’s case.
These figures provide context, not an estimate of whether a particular petition will be selected, approved, or filed on a specific date. Cap-season procedures and dates can change, so a historical report should not be used as a current filing calendar.
When might L-1 fit?
The corporate relationship and overseas employment matter
L-1 is for a qualifying intracompany transfer, not simply a job offer from a company that has offices in more than one country. USCIS policy guidance calls for evidence that the U.S. petitioner and foreign entity have a qualifying parent, branch, affiliate, or subsidiary relationship; that the organizations are doing business; and that the worker had qualifying employment abroad for at least one year during the three years preceding the petition.

The proposed U.S. position must also qualify under one of the L-1 role types. The employer’s case therefore needs to connect the organization’s structure, the worker’s history abroad, and the U.S. duties. A corporate relationship by itself is not enough if the required employment or role conditions are not established.
That makes L-1 an employer-structure and work-history question as much as a job question. A multinational presence alone does not answer it: the petitioner must document the qualifying relationship and business activity, the required prior employment abroad, and the role proposed in the United States.
L-1A and L-1B cover different roles
- L-1A: For a worker coming to the United States to serve in an executive or managerial capacity.
- L-1B: For a worker coming to perform services involving specialized knowledge.
For L-1B, USCIS says the petitioner should explain what the specialized knowledge is and why it is needed for the U.S. role. The case should make that connection clear rather than rely on a label such as “specialist” without explaining the knowledge and the work.
The L-1A/L-1B distinction is substantive: the petitioner needs to explain the qualifying nature of the proposed role, not just identify which subcategory it prefers. USCIS notes that L-1B requirements differ from other classifications, so evidence that might be relevant to another work-visa case does not automatically establish specialized knowledge.

A foreign company may petition to send an executive or manager to establish a U.S. office, subject to the applicable requirements. A new-office petition has additional evidentiary demands, including premises and the ability to support the proposed operation. A plan to open a U.S. location should not be treated as equivalent to an established operation; the petition must address the requirements for the new-office situation.
When might O-1 fit?
O-1 is for people who qualify under an extraordinary-ability standard in a covered field. USCIS’s Form I-129 instructions identify fields that broadly include the arts, sciences, education, business, and athletics. The category is not simply a label for someone who is highly skilled, successful, or experienced; the relevant legal standard must be met and supported for the field at issue.
The available official material summarized here establishes the category’s broad basis, but does not set out the detailed O-1 evidentiary criteria, stay limits, filing rules for employers or agents, or current fees. Those points should be checked against current USCIS guidance before deciding whether a particular record can support an O-1 petition. Do not infer that an impressive résumé, advanced degree, senior title, or strong job performance automatically satisfies the standard.

For an O-1 screening, the worker’s accomplishments need to be considered in relation to the relevant field and the current legal standard. This comparison cannot provide a checklist of qualifying evidence because the sources reviewed here do not establish the detailed criteria. Treat that as a reason to verify the rules, not as permission to assume that general professional success is enough.

For an H-1B screening
- Describe the role’s actual duties and why the position is being treated as specialty-occupation work.
- Identify the employer and the proposed employment covered by the petition.
- Check the current cap-season rules and filing timetable if the case may be subject to the cap; do not use FY 2023 figures as a current filing calendar.
For an L-1 screening
- Document the qualifying relationship between the U.S. petitioner and foreign entity, including the relevant parent, branch, affiliate, or subsidiary connection.
- Establish that the organizations are doing business.
- Show the worker’s qualifying employment abroad for at least one year within the three years preceding the petition.
- Explain whether the U.S. role is executive or managerial (L-1A) or involves specialized knowledge (L-1B).
- For L-1B, explain the knowledge and why the U.S. position needs it.
- For a new office, address the premises and the proposed operation’s ability to support the position.
For an O-1 screening
First identify the relevant field and then obtain current USCIS guidance on the evidentiary standard and petition rules for that case. The broad category description alone is not enough to determine eligibility. A person should not treat the O-1 as an alternative route merely because H-1B or L-1 appears difficult; each classification has its own requirements.
How to choose which category to investigate first
- Start with the job. Is the proposed position specialty-occupation work? If so, H-1B may warrant review, subject to applicable petition and cap rules.
- Check for a qualifying transfer. Is there a qualifying relationship between the U.S. organization and a foreign entity, and did the worker meet the required prior employment abroad? If so, assess whether the U.S. role fits L-1A or L-1B.
- Assess the worker’s field-specific record. Could the worker meet the extraordinary-ability standard for the relevant O-1 field? Confirm the detailed criteria in current USCIS guidance before drawing a conclusion.
- Verify the current filing mechanics. Check form editions, fees, filing procedures, cap timing, and applicable Department of State steps for the specific case. These details can change and are not interchangeable across categories.
This sequence helps narrow the questions, but it does not establish eligibility. A person might potentially fit more than one category, yet each petition is evaluated under the classification requested. USCIS notes that L-1B requirements differ from those of other classifications; a qualification under one route should not be assumed to satisfy another.
For example, a specialty-occupation job offer does not by itself show a qualifying L-1 transfer, because L-1 also depends on the corporate relationship and prior employment abroad. Conversely, a qualifying transfer relationship does not by itself establish that a role is specialty-occupation work or that a worker meets O-1’s extraordinary-ability standard. These are screening distinctions, not determinations about any individual case.
What happens after an employer petition?
Form I-129 is a central employer filing step for these temporary-worker classifications, but petition approval is not the same as receiving a visa or being admitted to the United States. USCIS’s FY 2023 H-1B report specifically notes that approval does not itself guarantee visa issuance or admission. The next steps and their applicability depend on the person’s circumstances, including where the person is and the relevant Department of State and U.S. admission procedures.
Before acting on an approval, confirm what it authorizes and what additional steps apply to the beneficiary. Do not treat the approval notice as a promise of entry or as a substitute for checking visa issuance and admission requirements.
What about family members?
USCIS employer guidance says dependent spouses and children may seek L-2 classification. It also states that spouses admitted with the L-2S class of admission are employment authorized incident to status. That statement applies to the L-2S evidence described by USCIS; it should not be extended to every family member or assumed to describe work authorization for dependents in the H-1B or O-1 categories.

Because family classification and employment authorization can depend on the person’s status and documentation, verify the applicable rules for each family member rather than infer them from the principal worker’s category.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Which route is best?
There is no universally best choice among H-1B, L-1, and O-1. H-1B turns on the specialty-occupation job and the applicable cap context; L-1 requires the qualifying corporate relationship, prior employment, and role; O-1 requires an extraordinary-ability case supported under the relevant field’s standard. The decisive facts are different, so comparing the categories as if they were three versions of the same work visa can lead to a poor fit.

Frequently Asked Questions
What is the main difference between H-1B, L-1, and O-1?
H-1B is based on specialty-occupation employment, L-1 on a qualifying intracompany transfer and prior employment abroad, and O-1 on extraordinary ability in a covered field. Each has distinct eligibility requirements and evidence.
Does an H-1B job offer guarantee a visa or admission?
No. An employer petition is a central step, but USCIS notes that petition approval does not itself guarantee visa issuance or admission. Additional steps depend on the beneficiary’s circumstances.
What does an employer need to establish for an L-1 petition?
The petition should document a qualifying relationship between the U.S. and foreign organizations, that they are doing business, the worker’s qualifying employment abroad for at least one year during the preceding three years, and a qualifying U.S. role. New-office petitions have additional requirements, including premises and the ability to support the proposed operation.

What are the H-1B cap and duration figures?
USCIS’s FY 2023 report described a 65,000 regular annual cap and a 20,000 additional exemption for certain U.S. advanced-degree holders. It also described a generally six-year maximum admission framework and initial petitions generally approved for up to three years. These are report-era figures, not current cap-season instructions or a guarantee for an individual case.
Is being highly skilled or successful enough for an O-1?
Not necessarily. O-1 is based on extraordinary ability in a covered field, not simply on being highly skilled, experienced, or successful. The detailed evidentiary criteria should be checked in current USCIS guidance.
Can a worker qualify for more than one of these categories?
Potentially, but eligibility for one category does not automatically establish eligibility for another. Each petition is assessed under the specific classification requested.
Can I compare the current filing costs for all three categories here?
No comparable current fee schedule is established by the sources summarized here. Check current USCIS and Department of State information for applicable fees, forms, and procedures before filing.
Can an L-2 spouse work in the United States?
USCIS states that spouses admitted with the L-2S class of admission are employment authorized incident to status. This specific statement should not be generalized to all family members or other visa categories; check the person’s status and documentation.
The Bottom Line
Bottom line: Start with the legal basis that matches the facts: the job for H-1B, the qualifying organization relationship and overseas work history for L-1, or the worker’s field-specific extraordinary-ability record for O-1. Verify current filing rules and do not treat petition approval as a guarantee of visa issuance or admission.
