The headline is real, but it describes a 2024 policy that was phased in over several years—not a new, across-the-board 2026 tariff. On May 14, 2024, the Biden administration announced higher Section 301 duties on selected Chinese electric vehicles, batteries, solar cells and semiconductors. Some increases took effect in 2024, others in 2025 or 2026.
The amount an importer actually owes depends on the product’s HTSUS classification, country of origin, entry date and any additional trade measures. The rates below are Section 301 duties only, not necessarily the total import duty.

These changes followed the U.S. Trade Representative’s statutory four-year review of existing China tariffs under Section 301 of the Trade Act of 1974. The final modification notice was published on September 18, 2024, in the Federal Register.

The United States did not impose one universal tariff on every Chinese import. It modified particular tariff lines covering strategic products. In addition to the categories above, the package included certain battery parts, critical minerals, permanent magnets, steel and aluminum products, ship-to-shore cranes, medical equipment, protective equipment, syringes and needles.

The Biden administration and USTR said the action responded to what they described as Chinese state support, excess industrial capacity, forced technology transfer, intellectual-property practices and strategic dependence in important supply chains. Those are the administration’s stated policy reasons, not a guarantee that the tariffs will create domestic jobs or reduce prices.
How the tariffs apply by product
Electric vehicles
The headline EV rate rose from an existing 25% Section 301 duty to 100%. That is an additional tariff for covered Chinese-origin electric vehicles under the relevant HTSUS provisions; it is not automatically the total duty in every case.
The measure does not formally ban Chinese EVs. A 100% additional duty can nevertheless make commercial imports uneconomic. Separate safety, emissions, customs, connected-vehicle, forced-labor and national-security requirements may also affect whether a vehicle can enter the U.S. market.

The tariff targets covered vehicles imported from China. It does not automatically apply to every EV containing Chinese components, and it does not automatically cover gasoline vehicles, hybrids, batteries or parts. A Chinese-brand vehicle assembled in another country requires a separate country-of-origin and substantial-transformation analysis.

Batteries
The battery provisions are not interchangeable. Lithium-ion batteries used in EVs rose from 7.5% to 25% in 2024. Lithium-ion batteries not used in EVs were scheduled to rise from 7.5% to 25% in 2026. Certain battery parts have their own tariff provisions, including a 25% rate for specified non-lithium-ion battery parts.
“Home battery,” “EV battery” and “battery pack” are commercial descriptions, not sufficient customs classifications. Chemistry, intended use, design and the precise tariff line can change the result.
Solar cells and modules
The Section 301 rate for Chinese solar cells, whether or not assembled into modules, increased from 25% to 50% in 2024.
That does not mean every solar-related product receives a 50% Section 301 duty. Cells, completed modules, wafers, polysilicon and manufacturing machinery may fall under different tariff provisions. Solar products can also be subject to separate Section 201 safeguard measures and antidumping or countervailing duties involving particular products or countries. Those measures should not be combined into one generic “solar tariff.”

Semiconductors and computer chips
The 2024 package scheduled the Section 301 semiconductor rate to rise from 25% to 50% in 2025. It does not mean that every finished electronic product containing a chip is subject to a 50% tariff. The legal tariff lines and product descriptions control.
USTR also began a separate Section 301 investigation into China’s targeting of the semiconductor industry on December 23, 2024. That proceeding is distinct from the 2024 four-year-review increase. Readers should not treat “computer chips” as a single tariff category without checking the applicable HTSUS subheading.
When did the increases take effect?
- 2024: Higher rates for Chinese EVs, EV batteries and solar cells.
- 2025: The semiconductor rate was scheduled to reach 50%.
- 2026: The rate for lithium-ion batteries not used in EVs was scheduled to reach 25%.
The announcement date is not necessarily the date a particular shipment becomes liable. Importers must check the applicable tariff line and entry-date rules in the final implementation notice.

No. Section 301 is only one possible layer. A shipment may also face its ordinary Most-Favored-Nation duty, other Section 301 measures, Section 201 safeguards, antidumping or countervailing duties, forced-labor-related restrictions or later country- and product-specific actions.

USTR’s Section 301 search tool requires an 8-digit HTSUS subheading and identifies the relevant action and additional-duty rate. An importer should not calculate its full liability from a product name or a headline percentage.
Do products made outside China avoid the tariffs?
Not automatically. Customs generally examines the product’s country of origin, not just the nationality of its manufacturer or the location of one component. Assembly in Mexico, Vietnam, Malaysia or another country may or may not result in a different origin, depending on whether the processing substantially transforms the product.
Examples include a Chinese-brand vehicle assembled abroad, Chinese battery cells incorporated into a foreign-made battery, or solar modules assembled in Southeast Asia using Chinese inputs. The answer depends on the manufacturing facts, classification and applicable origin rules. Transshipment or inaccurate origin declarations can create customs exposure.

The importer pays the duty when the goods enter the United States. The importer may absorb the cost, pass it to a distributor, raise the retail price, change suppliers or shift assembly. Domestic producers may also gain pricing power when competing imports become more expensive.

The consumer effect therefore varies by product. Chinese EV imports were already limited in the U.S. market, so the direct effect on U.S. vehicle prices may be smaller than the 100% headline suggests. Batteries and solar inputs could have wider supply-chain effects because China is a major global supplier. That is an economic inference, not a fixed price forecast.
For households, the practical questions are whether the tariff applies to the finished product or only an input, whether alternative suppliers exist, how much Chinese content is involved, and whether tax credits, local-content rules or other incentives matter more than the tariff.
Timeline through 2026
- May 14, 2024: The Biden administration announces higher Section 301 duties on selected strategic Chinese products.
- September 18, 2024: USTR publishes the final tariff-modification notice.
- 2025: The semiconductor increase is scheduled to reach 50%.
- December 23, 2024: USTR begins a separate investigation concerning China’s semiconductor-industry practices.
- November 26, 2025: USTR extends 178 existing China Section 301 exclusions through November 10, 2026.
- May 6, 2026: USTR begins a second four-year review of the China Section 301 actions.
- July 23, 2026: USTR announces a separate forced-labor Section 301 action affecting 60 economies, including a 12.5% rate for economies in the “all other” category under that action.
The 2026 review and forced-labor action are separate developments. They should not be presented as part of the May 2024 announcement. The outcome of the second review remains unresolved unless and until USTR issues a final action.
The 178 exclusions are also product-specific. An exclusion applies only when the merchandise matches the precise listed description; it is not a blanket exemption for all EVs, batteries, solar products or chips. Details are available in USTR’s exclusion-extension announcement.
How importers can check their exposure
- Identify the HTSUS subheading. Use the entry documentation and obtain a classification review where necessary.
- Confirm country of origin. Review the full manufacturing chain, not just the seller’s location or brand nationality.
- Check Section 301 treatment. Enter the 8-digit subheading in USTR’s tariff-search tool.
- Review exclusions. Confirm that the exact product description qualifies and that the exclusion remains effective on the entry date.
- Check other measures. Review ordinary duties, Section 201 safeguards, antidumping and countervailing duties, forced-labor restrictions and other applicable actions.
- Confirm the entry date. The rate in force depends on the legal implementation rules, not simply the date of purchase or shipment.
- Escalate material uncertainty. Consult a licensed customs broker or seek a binding classification or origin ruling when the potential exposure is significant.
Government resources from U.S. Customs and Border Protection can help with entry and compliance information. Commercial customs brokers and trade-compliance platforms may provide classification, origin, filing and audit support, but pricing and capabilities vary by provider.
