Its documented action was a letter and regulatory comments—not a lawsuit. The policy has since changed: EPA announced on March 27, 2026, that the half-value treatment will begin in 2028.
What API challenged
In August 2025, API urged the Environmental Protection Agency (EPA) to remove a provision in its proposed Renewable Fuel Standard (RFS) rule for 2026 and 2027. The proposal would have awarded half as many Renewable Identification Numbers (RINs) to an imported gallon of renewable fuel—or a gallon made from foreign feedstocks—as to equivalent fuel made in the United States from domestic feedstocks. It applied to RINs generated in 2026 or later; the proposal did not change treatment for RINs generated in 2025 or earlier. Reuters reported API’s opposition, and EPA’s proposed rule described the credit change.
API argued that the proposal was unworkable, could harm the RFS program and could put upward pressure on fuel costs. It also questioned EPA’s legal authority in its comments. Those are API’s claims and forecast, not established findings about the rule’s eventual effect on prices. Reuters’ account of the comments quoted API as saying: “As proposed, it is unworkable and would have significant harmful effects on the overall RFS program and could place upward pressure on fuel costs.”
How RIN credits work
The RFS requires regulated fuel suppliers to meet renewable-fuel obligations. Qualifying renewable fuel generates RINs, which function as tradable compliance credits that can be used toward those obligations. The proposal did not simply prohibit imports: it would have changed how many RINs qualifying fuel generated, depending on whether the fuel or its feedstock came from abroad. Why the policy drew opposition
The disagreement is about who benefits from the credit system, what supplies are available for compliance, and whether the proposed distinction is legally authorized.
- Domestic production: EPA said the proposal would direct more of the RFS’s economic benefits to U.S. fuel and feedstock producers and support energy independence. EPA’s proposal set out that rationale.
- Compliance supply and costs: API argued that limiting the credit value of import-based fuel could make compliance harder and put upward pressure on fuel costs. That is an industry forecast; the sources do not establish the direction or size of any actual price effect.
- Legal authority: API questioned whether EPA could adopt the approach under the Clean Air Act. The reported challenge was made through regulatory comments, and the available reporting does not establish a court ruling on the issue.
Views were not uniform across the renewable-fuels sector. Reuters reported that Clean Fuels Alliance America told EPA there was no consensus among its members about reducing RIN value for fuels produced domestically from foreign feedstock. Reuters quoted the group’s comments.

Did API sue EPA?
The August 2025 Reuters report described API’s letter and comments to EPA, including its legal objections; it did not report that API had filed a lawsuit. A challenge in a rulemaking comment is not the same as litigation, and the sources cited here do not establish a later court case.

EPA’s March 27, 2026, announcement of the final Set 2 rule says foreign fuels and feedstocks will receive half the RFS compliance value of American-made products starting in 2028. EPA said the delay gives American producers time to prepare. This final timing supersedes the 2025 proposal’s planned start for RINs generated in 2026 and later. Read EPA’s final-rule announcement.
