Trump’s Taiwan Chip Tariff Threat: What Changed for TSMC and U.S. Tech

Trump threatened tariffs on Taiwan-made chips in 2025, then imposed a narrower 25% levy on specified advanced computing chips in 2026. Here’s what that means for TSMC, importers and U.S. tech buyers.

Short answer: In January 2025, Donald Trump threatened tariffs on foreign-made semiconductors, floating rates of 25%, 50% or even 100%. That was a proposal, not an immediately effective 100% tariff on Taiwan-made chips. A narrower measure followed in January 2026: a 25% duty on specified advanced computing chips and certain derivative products, subject to significant exemptions. Taiwan later received preferential treatment linked to investment and production capacity in the United States.

What Trump said about Taiwan-made chips in January 2025

On January 27, 2025, Trump told House Republicans that the United States should impose tariffs on foreign-made computer chips, semiconductors and pharmaceuticals to encourage production at home. He criticized the CHIPS Act’s subsidy approach and argued that tariffs would give companies a stronger reason to manufacture in the United States. Contemporary coverage connected the remarks to Taiwan Semiconductor Manufacturing Company (TSMC), a crucial supplier of chips made in Taiwan for U.S. technology firms. PCMag’s report and Taiwan TechNews’ January 28 report describe the proposal and its possible supply-chain effects.

Trump cited possible rates of 25%, 50% or 100%. Those figures were a political warning, not a finalized tariff schedule: the remarks did not establish an effective date, covered customs classifications or a complete country-of-origin rule. A statement of intent is not itself an enforceable customs duty. The White House press briefing of January 2025 addressed the administration’s announced direction, but the 2025 remarks did not amount to an order imposing a blanket 100% tariff on Taiwan-made chips.

Why TSMC was central to the threat

TSMC is a contract chip manufacturer: companies such as Apple, Nvidia, AMD and Qualcomm design or sell chips, while TSMC manufactures many of them. A tariff on imported physical chips would therefore affect the supply chain used by U.S. firms even when those firms own the designs and are not the manufacturers. It would not, simply by being a tariff on a chip, tax a company’s American design work or apply to every product sold by that company.

Nor would a tariff aimed at goods of Taiwanese origin necessarily apply only to TSMC. The manufacturer, the chip’s legal origin, the importer and the product’s tariff classification are distinct questions. The January 2025 proposal had not supplied the customs rules needed to determine how each case would be treated.

Why a chip tariff would not automatically apply to every finished device

A chip can travel through several countries before a finished product reaches a U.S. port:

Chip design → wafer fabrication in Taiwan → packaging and testing elsewhere → board or device assembly → U.S. import

Customs treatment depends on what is imported and how it is classified, the legal country of origin, whether the semiconductor arrives as a standalone component or is incorporated into a finished product abroad, and whether the measure covers derivative products. Packaging, testing and assembly can complicate the origin analysis; the January 2025 proposal did not resolve how customs authorities would treat those supply chains.

As a result, a duty on a covered standalone chip would not automatically mean that an iPhone, laptop, graphics card, automobile or server containing a Taiwan-fabricated chip receives the same duty. A later measure may expressly cover derivatives, and an end-use exemption may also matter. Importers need to assess the actual product, classification, origin and applicable rules rather than multiply a device’s price by a headline tariff rate.

What took effect in January 2026

On January 14, 2026, Trump issued a semiconductor proclamation under Section 232 of the Trade Expansion Act. A 25% ad valorem duty took effect at 12:01 a.m. Eastern Standard Time on January 15 for covered imports entered for consumption, or withdrawn from a bonded warehouse for consumption, on or after that time. The measure covers specified advanced computing chips and certain derivative products—not all semiconductors made in Taiwan. The proclamation is the governing policy document; it also allows for negotiations and leaves open possible broader action later.

The tariff is additional to other applicable duties unless the proclamation provides otherwise. The proclamation also addresses foreign-trade-zone treatment and does not allow drawback of the duties it imposes. Those rules can affect an importer’s total liability and should be checked alongside the product-specific requirements.

Examples and limits of the covered category

The White House identified Nvidia H200 and AMD MI325X chips as examples of advanced computing chips covered by the action. Those examples do not define the full scope. Classification and coverage turn on the proclamation, its annex and applicable implementation guidance—not simply on a product’s brand or the fact that TSMC manufactured it. Exemptions depend on use and documentation

The proclamation provides exclusions for specified uses, including covered products used in U.S. data centers, repairs and replacements, U.S. research and development, startups, non-data-center consumer applications, civil industrial applications and public-sector uses. It also permits other qualifying uses determined to support the U.S. technology supply chain. Whether an import qualifies depends on the relevant classification, end use, documentation and implementing guidance. The same chip may receive different treatment in different applications; a stated 25% rate does not by itself establish the effective duty on every shipment.

How the U.S.–Taiwan arrangements changed the picture

The January 2026 policy was followed by U.S.–Taiwan arrangements that linked preferential tariff treatment with investment and U.S. production capacity. A January 15 Commerce Department fact sheet described terms under which Taiwanese companies developing U.S. capacity could import up to 2.5 times their planned new U.S. production capacity without Section 232 duties during the approved construction period. After completing new U.S. production projects, companies could import up to 1.5 times that new capacity without those duties. These are terms described by the department, not an automatic exemption for every Taiwanese chip or facility. The Commerce Department fact sheet sets out the capacity framework.

The February 2026 U.S.–Taiwan reciprocal-trade fact sheet also describes preferential treatment for Taiwan in future Section 232 semiconductor measures, taking account of the two sides’ economic and national-security alignment and technology partnership. It does not establish that all Taiwanese chips are tariff-free. The USTR fact sheet describes the agreement’s terms.

Who could bear the cost?

A tariff is collected from the importer, but the commercial cost can be distributed among several parties. The importer might absorb it, seek a lower price from a supplier, pass some of it to a system builder or customer, or change sourcing. Chip designers, manufacturers, distributors and enterprise buyers may all face pressure during price negotiations. How much reaches consumers depends on the product, contracts, supply alternatives and whether an exemption applies.

For covered advanced accelerators, higher landed costs or added compliance work could affect procurement decisions for AI servers and related systems. Companies may also accelerate orders, hold more inventory or delay purchases while they assess classification and end-use rules. These are possible responses, not a guarantee that retail prices will rise by 25%—or by the 100% proposed in 2025.

What tariffs can—and cannot—do for U.S. chip production

The administration’s stated goal is to increase U.S. fabrication and strengthen domestic supply chains. A tariff can change the relative cost of importing covered products, but it cannot quickly reproduce Taiwan’s manufacturing ecosystem. Expanding advanced chip production requires fab construction, specialized equipment, packaging and testing capacity, materials suppliers, skilled workers, reliable power and water, and customers to support high factory utilization.

Even when wafers are fabricated in the United States, the broader supply chain may still rely on overseas equipment, materials, packaging or testing. Domestic wafer production is an important part of capacity, not proof that the entire semiconductor chain has moved onshore.

What to check before assuming a product is affected

  • Identify the imported article. A standalone chip, a board and a finished device may be classified differently.
  • Check origin and classification. The chip’s manufacturing location alone may not settle the legal origin of a finished good.
  • Confirm the measure’s scope. The 2026 action covers specified advanced computing chips and certain derivatives, not all semiconductors.
  • Establish end use. The exclusions and eligibility requirements can turn on the product’s documented use.
  • Check preference eligibility. Taiwan-related treatment described by Commerce is linked to qualifying U.S. capacity and is not a universal waiver.
  • Use current implementation rules. Importers should consult the proclamation, its annex, HTSUS amendments and applicable CBP instructions or later agency notices for the shipment in question.

What could change next

The January 2026 proclamation preserved the possibility of broader semiconductor tariffs after negotiations. For businesses and buyers, the relevant developments are any further Section 232 action, changes to tariff classifications or implementation instructions, end-use documentation requirements, U.S. capacity milestones and revisions to the U.S.–Taiwan framework. Until a later measure changes the rules, the 2025 threat should not be used as the tariff rate for a current product or shipment.
