The October 30, 2025, meeting between President Donald Trump and Chinese President Xi Jinping in Busan, South Korea, did not publicly produce a completed TikTok sale or transfer of control. It kept a proposed U.S.-led divestiture moving: Treasury Secretary Scott Bessent said the administration had finalized terms, but Chinese approval was still needed. The distinction matters. A political understanding is not the same as approval, signed transaction documents, or a closed deal.
By January 2026, Axios reported that a U.S. divestiture had closed through a joint venture, and the Justice Department referred to the TikTok USDS Joint Venture in July 2026. The outcome is best described as U.S.-led private control of TikTok’s U.S. operation—not the federal government taking ownership of TikTok or a demonstrated transfer of the global platform’s recommendation technology.
What the Trump–Xi meeting did—and did not—settle
Trump and Xi met in Busan on October 30, 2025. Afterward, China’s Commerce Ministry said the two countries would work to resolve TikTok-related issues. That signaled continued engagement, not a detailed public confirmation that Beijing had approved final sale documents. Bessent described the administration’s terms as finalized but said Chinese approval remained necessary. The Associated Press account of the meeting and Ars Technica’s reporting both distinguish the negotiations from a completed transaction.
There are several steps between a diplomatic understanding and a sale: the governments can agree on a framework; China can approve the technology and transaction arrangements; the parties can sign and implement definitive documents; and the transaction can close. The meeting was important because Chinese approval was a practical obstacle to a transfer involving TikTok’s U.S. business and the recommendation technology. But the public statements did not establish that all those steps had occurred.

What “controlling TikTok” means
In this story, “control” can refer to different things. The evidence supports a distinction between the U.S. government and private U.S.-led investors, and between TikTok’s American business and the global platform.
- Federal ownership or operation: The cited announcements and later reporting do not show that the U.S. government bought or began operating TikTok.
- Private investor control: The proposed and later reported structure placed the U.S. operation in a U.S.-based joint venture led by private investors.
- Control of the U.S. business: This concerns corporate governance, local operations, data protections, security, and compliance for the American service.
- Control of the recommendation system: This concerns who owns, licenses, operates, audits, changes, or retrains the technology that selects videos for users. It is not automatically resolved by transferring shares in a U.S. company.
So the headline’s “closer to controlling TikTok” is defensible only in the narrower sense that a U.S.-led ownership structure for the American operation advanced. It should not be read as Washington taking over the company or controlling every part of global TikTok.

What the proposed U.S. ownership structure included
In September 2025, the White House described a proposed U.S.-based joint venture and called the planned arrangement a “qualified divestiture.” Under that proposal, ByteDance would own less than 20% of the venture, choose one of seven directors, and be excluded from its security committee. The administration said the structure was intended to remove foreign-adversary control. These were the White House’s announced terms and legal position, not by themselves proof that every element had been implemented or independently upheld. Axios reported in January 2026 that the U.S. divestiture had closed through a joint venture led by Oracle, Silver Lake, and MGX, with ByteDance retaining a minority interest. The reported terms described the three lead investors as holding 15% each and ByteDance as retaining 19.9%, alongside stakes held by other existing ByteDance investors. Those percentages are reported deal details, not a substitute for definitive transaction documents. In July 2026, the Justice Department’s Office of Legal Counsel referred to the “TikTok USDS Joint Venture,” confirming that a U.S. joint-venture structure existed by then. Axios’s account of the reported closing and the DOJ opinion support the later-status update.

Why the algorithm is the hardest control question
TikTok’s recommendation system is central to the product’s usefulness and commercial value. A transaction can transfer a U.S. company or grant it operating rights without transferring complete ownership of the underlying technology. The White House’s September proposal and the October meeting coverage identify the algorithm as a central issue, but the cited material does not establish that the U.S. joint venture acquired outright ownership of TikTok’s global recommendation technology.
The practical questions are more specific than whether the algorithm was “sold”:

- Does the U.S. venture own the relevant code, or use it under a license?
- Can its engineers independently audit, modify, retrain, or replace the system?
- Can it operate without ByteDance personnel, systems, or contractual dependencies that amount to a continuing operational relationship?
- Would Chinese export controls limit a transfer or modification of the technology?
- Does the U.S. service use a distinct recommendation system, and what happens to the experience if it does?
These details matter to both national-security arguments and the user experience. A separately managed system could offer more operational independence, but rebuilding or separating technology could affect recommendations, product consistency, and costs. Keeping the existing system may preserve continuity while leaving harder questions about licensing, influence, and technical dependence. The evidence cited here does not establish how those trade-offs have played out for users.

The Protecting Americans from Foreign Adversary Controlled Applications Act did not make a sale the only possible outcome. It restricts distribution, maintenance, or updating of covered applications controlled by a foreign adversary unless there is a qualifying divestiture. The central test is not simply whether ByteDance holds fewer shares: the arrangement must remove foreign-adversary control and meet the law’s requirements concerning operational relationships.

The White House’s September order said the qualifying arrangement had to prevent the application from remaining controlled by a foreign adversary and preclude a continuing operational relationship with the former parent or its affiliates. The administration’s determination that its proposed structure met that standard is an executive-branch position; it should not be confused with a blanket finding that every legal or technical question has been settled. The statutory text is available through the Federal Register.
Enforcement timing also shaped the negotiations. The September order extended the enforcement delay to December 16, 2025, according to the White House order extending the TikTok enforcement delay. That kind of delay can keep an app available while talks continue; it is not itself evidence that a divestiture has closed or satisfied the law.

What users, creators, and advertisers should watch
A change in ownership does not, by itself, tell users whether their feeds or data practices changed. To assess whether the arrangement represents substantive U.S. control, look for concrete evidence about governance and technical independence rather than relying on labels such as “sale,” “U.S.-owned,” or “qualified.”
- Who appoints directors and controls security decisions?
- Which entity controls access to U.S. user data and handles security and compliance?
- Can the U.S. venture independently modify, retrain, audit, or replace its recommendation system?
- What technology, services, personnel, and contractual rights remain connected to ByteDance or its affiliates?
- Are there observable changes to recommendations, moderation, creator reach, or cross-border content—and are those changes documented rather than assumed?
A minority ownership stake is not the same as a controlling stake, but it also does not by itself answer whether an investor retains practical influence. Voting rights, board powers, technology licenses, personnel overlap, data access, contractual vetoes, and dependence on shared systems all matter. Likewise, private U.S. ownership is not government ownership, and political claims about the direction of moderation or recommendations should not be treated as established outcomes without evidence.
