It is an allegation, not a court finding. A Coast Guard investigation chair was reported as saying investigators found “no evidence” that passengers were aware of their fate.
What the lawsuit alleges about Titan’s final moments
Nargeolet’s estate filed its complaint on August 6, 2024. It alleges that Titan’s occupants would have heard or otherwise detected cracking in the carbon-fiber hull through an acoustic safety system, understood the vessel was failing, and attempted to abort the dive. The plaintiffs further allege that the occupants knew they were going to die and suffered terror and mental anguish before the implosion. The complaint does not establish that an alert occurred or prove what anyone aboard perceived.
The complaint put its theory starkly: “Common sense dictates that the crew were well aware they were going to die, before dying.” It also claimed Rush’s “acoustic safety system” would have alerted the crew to hull cracking and prompted an attempt to abort. Those are the plaintiffs’ assertions, not verified recordings or findings about the occupants’ awareness. ABC News reported the complaint and the investigation chair’s counterpoint on August 8, 2024.
Why “tourists” is not an exact label for everyone aboard
The headline term “tourists” is imprecise for Nargeolet. His estate’s complaint identified him as a Titan crew member and OceanGate employee, and alleged that he helped guide navigation and assist others aboard. The complaint described him as an experienced Titanic explorer who had participated in 37 dives to the wreck; that figure is the estate’s statement in its 2024 pleading.

A 2025 federal court order recounts that OceanGate referred to people aboard as “mission specialists.” These descriptions do not settle the legal classification of each person as crew or passenger under any particular law. The federal order sets out the complaint’s allegations and the court’s procedural ruling.
What investigators said about passenger awareness
ABC News reported that Marine Board of Investigation chair Capt. Jason Neubauer said investigators had found “no evidence” that passengers were aware of their fate. That reported statement directly contrasts with the estate’s theory, but it should not be stretched into a claim that investigators established everything occupants did or did not perceive in the final moments.

What later investigations established—and what they did not
In October 2025, the National Transportation Safety Board attributed the implosion to faulty engineering. The NTSB’s final report described a carbon-fiber composite pressure vessel with multiple anomalies that failed to meet necessary strength and durability requirements, and said OceanGate had not adequately tested Titan. The NTSB finding addresses engineering and the vessel’s failure; it does not determine what occupants knew before the implosion. The Associated Press summarized the NTSB’s final report on October 15, 2025.
Separately, AP’s account of the Coast Guard investigation described inadequate design, certification, maintenance, and inspection processes and reported that the Coast Guard called the disaster preventable. Those safety findings concern how Titan was designed and operated, not whether its occupants recognized the danger before the implosion. AP reported on the Coast Guard investigation in August 2025.

Where the lawsuit stands in the cited court record
The estate’s August 2024 complaint sought more than $50 million and asserted wrongful-death, negligence, gross-negligence, products-liability, and related maritime claims. It named OceanGate, the estate of Stockton Rush, Tony Nissen, Electroimpact, Janicki Industries, and Hydrospace Group. These remain claims described in the pleading, not findings that the named parties are liable.
The federal court granted a motion to remand the case to state court, finding the pleaded Jones Act claim sufficient to warrant remand. That is a procedural decision about where the case should proceed, not a ruling on whether the alleged negligence occurred or whether the estate will win. The cited court record does not establish a later state-court outcome.
