A class-action application alleges about 500,000 customers received the message and values the prize at C$64,000 including taxes. In June 2025, a Quebec judge authorized a class action to proceed for Quebec residents; that procedural decision did not find Tim Hortons liable or award anyone a boat or compensation.
What the Tim Hortons email said
On April 17, 2024, Tim Hortons sent app customers a recap email about the 2024 Roll Up To Win promotion. The message incorrectly listed a Tracker Targa 18 WT 2024 boat and trailer among prizes recipients had won. It was an erroneous recap, not confirmation of a verified boat win.
A follow-up email attributed the incorrect information to a technical error and asked recipients to disregard the earlier message. Tim Hortons later described the error as human error and apologized.
What the class-action application alleges
The application filed on April 19, 2024, in Deschatelets v. Restaurant Brands International Inc., Restaurant Brands International Limited Partnership, and The TDL Group Corp. alleges that approximately 500,000 app customers received the email. It values the boat and trailer at C$64,000 including taxes. Those are figures asserted by the applicant, not independently verified recipient or prize counts.

The applicant argues that the prize notification bound the merchant. The application asks for delivery of the boat and trailer or, alternatively, damages, as well as other and punitive damages. These are requested remedies, not amounts or relief a court has awarded.
Did the Roll Up To Win class action get approved?
Yes—in the procedural sense that the action was authorized to proceed in Quebec. The Quebec class-action registry lists an authorization judgment dated June 27, 2025, under file 500-06-001306-246. The Canadian Press reported that Justice Donald Bisson authorized the action for Quebec residents only because it turns on Quebec consumer-protection law.

Authorization is not a decision on whether the allegations are true. It did not establish Tim Hortons’ liability or order the company to give class members a boat, damages, or other compensation. The registry entry identifies the authorization stage and proposed class wording; the record reviewed does not establish a later merits ruling or settlement.
What Tim Hortons and the judge said
Tim Hortons’ response
Communications director Michael Oliveira told Global News in May 2025, “Unfortunately, there was a human error that resulted in some guests receiving some incorrect information in their recap message.” In June, he told The Canadian Press: “We apologized last year after some guests received an email in which some prizes that they did not win were included in their contest recap.” Tim Hortons also said millions of prizes actually won in the contest were distributed accurately under the contest rules. The company declined further comment to The Canadian Press because the case was before the courts.

The judge’s comment at authorization
As quoted by The Canadian Press from the authorization judgment, Justice Bisson wrote that refusing to give the boats to people told they had won them—or offering them nothing else—“could destroy the public’s trust in mobile app contests and justifies the claim for requested punitive damages.” That comment explains why the requested punitive-damages claim could proceed; it is not a final finding of liability or an award of punitive damages.
