TikTok’s $92 Million U.S. Privacy Settlement: Who Qualified and What It Paid

TikTok’s $92 million privacy settlement funded valid claims and settlement costs. Here’s who was included, the court’s estimated shares, and why old claim instructions do not mean filing is still open.

The $92 million TikTok privacy settlement was a fund in a U.S. class action over allegations that TikTok collected and used users’ personal data without sufficient notice or consent. It was not a $92 million payout to each user: valid claimants shared the fund, which also covered settlement costs. The claims process is historical, and the settlement notice does not establish that new claims can be filed now.

What the $92 million TikTok settlement covered

The settlement resolved a private class action in the U.S. District Court for the Northern District of Illinois. Plaintiffs alleged that TikTok collected and used personal data without adequate notice and consent. TikTok and the other defendants denied the legal claims. The court-authorized notice stated, “The Court has not found in favor of either Plaintiffs or Defendants.” The settlement avoided a trial; it was not a finding that the defendants were liable. Who was eligible

The settlement notice defined a nationwide class as people who lived in the United States and used the TikTok app before September 30, 2021. It also included an Illinois subclass: Illinois residents who used TikTok in Illinois to create videos before that date. Settlement notice

Eligibility alone did not automatically produce a payment. A person had to submit a timely, valid claim form under the settlement’s historical process. The old notice includes deadlines and instructions for that process; it should not be treated as an invitation to file a new claim today. Settlement notice

How much an individual claim was estimated to receive

Under the court’s allocation description, each valid nationwide claim received one share, while each valid claim from the Illinois subclass received six shares. The court’s 2022 approval opinion gave estimated values based on the then-current estimate of valid claims:

What other relief the settlement included

In addition to the fund, the court described restrictions on certain TikTok practices, subject to the settlement’s disclosure terms. They addressed biometric information, geolocation and GPS data, clipboard information, certain transfers or storage outside the United States, and uploading user content before a user saves or publishes it. 2022 approval opinion

Can you still file a claim or check on an old payment?

The notice documents a past claims process with historical deadlines; it does not establish that claims are still being accepted. If you submitted a claim and need information about its status, use the settlement administrator’s records or contact details in the official notice. What the settlement release does—and does not—cover

A 2024 order described the class period as app use before September 30, 2021, and the release as covering claims arising from conduct on or before October 13, 2022. In later cases concerning TikTok’s in-app browser, the court declined at that stage to dismiss the claims on the basis of the earlier settlement. That ruling concerns the cases before the court; it does not mean the 2022 settlement covered every later privacy claim or that the allegations in the later cases were proven. 2024 order

Why some headlines mention a separate $400 million TikTok settlement

The $400 million figure refers to a different federal matter, not an increase to the $92 million class-action fund. The Federal Trade Commission lists a separate ByteDance/TikTok COPPA case filed August 2, 2024, in the Central District of California. On August 21, 2026, the U.S. Department of Justice announced a $400 million settlement in that matter and updated its release on October 2, 2026.
