Effective March 17, 2025, it restricts specified connected-vehicle hardware and software tied to China or Russia, with key restrictions phased in from model year 2027. It is not a blanket ban on every Chinese-made vehicle or auto part.
What “death sentence” meant—and what changed
The phrase came from Lei Xing, an independent analyst and former chief editor of China Auto Review, discussing the proposal’s effect on Chinese companies seeking to enter the U.S. market. In WIRED’s September 23, 2024 article, Xing said: “If the 100 percent tariffs on made-in-China EVs were a wall, the proposed ban on connected vehicles would be a death sentence for China EV Inc. aiming to enter the US.” It was his assessment of the proposal, not official legal terminology or a prediction that every Chinese EV would be barred.
The proposal is no longer merely proposed. The Commerce Department’s Bureau of Industry and Security (BIS) issued a final rule in January 2025, effective March 17, 2025. BIS says the rule prohibits certain transactions involving connected vehicles and specified hardware and software with a sufficient connection to the People’s Republic of China (PRC) or Russia. Its stated rationale is national security; the rule should not be read as proof that a particular vehicle has collected or misused U.S. driver data.
What the final rule covers
The restrictions turn on the technology, the relevant company’s connection to China or Russia, and the transaction—not simply the country where a vehicle was assembled. The rule applies to connected vehicles generally, not only electric vehicles.

Vehicle connectivity system hardware
Vehicle Connectivity System (VCS) hardware enables a vehicle to communicate externally. BIS identifies examples including telematics control units and Bluetooth, cellular, satellite, and Wi-Fi modules. The rule restricts importing covered VCS hardware, including when it is imported as part of a connected vehicle, if it has the specified PRC or Russian ownership, control, jurisdiction, or direction nexus.
VCS and automated-driving software
The software restrictions cover software integrated into VCS and Automated Driving Systems (ADS). ADS consists of components that collectively allow a highly autonomous vehicle to operate without a driver. The covered software must have the specified PRC or Russian nexus; the restriction is not a claim that all software developed in China is automatically covered regardless of its role or circumstances.

Completed vehicles and manufacturer nexus
The rule also restricts importing or selling completed connected vehicles that incorporate covered software with the specified PRC or Russian nexus. Separately, manufacturers themselves with a sufficient PRC or Russian nexus may be restricted from selling completed connected vehicles incorporating VCS hardware or covered software. That manufacturer restriction can apply even when the vehicle is made in the United States.
These categories do not amount to a simple prohibition on every Chinese-made car or every Chinese-origin automotive component. A vehicle’s treatment depends on the rule’s definitions, covered technology, relevant nexus, transaction, and applicable phase-in date.

The dates differ by technology and transaction; the rule’s effective date is not the same as the start date for every prohibition. BIS’s phase-in is specified by model year for the restrictions shown above.

How the proposal became a final rule
- March 2024: BIS issued an advance notice of proposed rulemaking.
- September 2024: BIS published the proposed connected-vehicle rule, the context for the WIRED article and Xing’s assessment.
- January 2025: BIS issued the final rule after public comment.
- March 17, 2025: The final rule became effective, with individual prohibitions phased in according to the dates above.
