What is the shady side of Temu?
The concerns are specific, and their legal status matters. U.S. regulators alleged that Temu failed to meet certain seller-information and reporting requirements. EU authorities notified the company of suspected consumer-law violations and later reported a preliminary finding on one Digital Services Act issue while continuing to investigate others. U.S. officials have also called for product-safety evaluation and sought information about forced-labor concerns.

What did the FTC allege about Temu?
On September 8, 2025, the Federal Trade Commission announced a proposed resolution under which Whaleco, Inc., Temu’s operator, would pay a $2 million civil penalty over alleged violations of the INFORM Consumers Act. The agency said the proposed order would require a usable telephone reporting mechanism and clearer disclosures, including names, addresses and contact details for covered high-volume third-party sellers.
According to the FTC complaint, some reporting mechanisms were missing, difficult to access or insufficiently clear in certain listing experiences, including gamified shopping flows and mobile interfaces. The complaint also concerned seller information required for covered high-volume sellers. These are allegations in the complaint, not a final court finding.

The FTC case page listed the matter as pending when checked on October 8, 2026. The final court disposition of the proposed consent order has not been verified here, so the proposed resolution should not be described as finally approved.
In the FTC’s release, Christopher Mufarrige, director of the agency’s Bureau of Consumer Protection, said: “The INFORM Act is designed to ensure consumers have the information and tools they need to not only report suspicious activity to online marketplaces, but to directly identify and contact high-volume third party sellers in many cases.”

What are EU regulators investigating about Temu?
Consumer-law notification: November 2024
On November 8, 2024, the European Commission said the Commission and the Consumer Protection Cooperation Network had notified Temu of practices they considered infringements of EU consumer law. One concern was “forced gamification”: users were reportedly required to play a spin-the-wheel game to access the marketplace while important conditions for rewards were hidden. This was a notification of suspected practices, not a final court judgment.
The same notice discussed the General Product Safety Regulation’s economic-operator and marketplace requirements, which applied from December 13, 2024.

Digital Services Act: July 2025 update
On July 28, 2025, the Commission reported a preliminary finding concerning Temu’s risk assessment for illegal or non-compliant products. It said other suspected DSA breaches remained under investigation, including the effectiveness of mitigation measures, addictive design features, recommendation-system transparency and researchers’ access to data. The update described ongoing proceedings, not a final resolution of those other issues.
Is Temu safe to shop from?
These records do not establish a blanket answer for every purchase. They document concerns about how a large marketplace identifies certain sellers, enables reporting, assesses product risks and designs parts of the shopping experience. A regulatory concern about platform oversight is not the same thing as a finding that a particular item is dangerous or that every transaction is fraudulent.

- For a covered high-volume third-party seller, look for the seller details required by law and use an available marketplace reporting channel if a listing appears suspicious.
- For an item where safety or compliance is important, assess that specific product rather than treating the marketplace’s overall reputation as a product-safety determination.
- Read reward terms before participating in games or promotions; EU authorities specifically raised concern about important reward conditions being hidden.
Is Temu safe for personal data?
Temu’s privacy policy is a company disclosure, not an independent audit. It says the company may share personal information with service providers and professional advisers, respond to public authorities when required by legal process, and share information with other parties for stated purposes such as fraud prevention, safety or enforcing agreements.
The policy says retention depends on the purpose, legal needs and risk; that user data is stored on cloud-service-provider infrastructure; and that recipients may be located in jurisdictions with different data-protection laws. It also says Temu uses technical and organizational safeguards and follows PCI-DSS in handling credit-card information. Those statements describe the company’s stated practices; they do not independently verify how data is handled in practice or certify the platform’s overall security.

Are Temu products safe?
On September 3, 2024, two Consumer Product Safety Commission commissioners called for agency staff to evaluate how foreign-owned e-commerce platforms, including Temu, meet obligations under the Consumer Product Safety Act. That request establishes scrutiny, not a completed CPSC finding about Temu or a conclusion that all products on the site are unsafe. Product risk must be evaluated at the level of the item and the evidence about it.
What is known about forced-labor concerns?
On August 16, 2024, Iowa Attorney General Brenna Bird’s office said she had joined a 21-state coalition letter seeking information from Temu about forced-labor and related concerns. The letter and state release document an inquiry and allegations. They do not establish that Temu or a particular product was found to involve forced labor.
How should a shopper read these claims?
Keep four distinctions in view: who raised the issue, what kind of concern it was, whether the record is an allegation or an assessment, and whether the matter has reached a final decision. The FTC matter involved alleged seller-transparency and reporting violations with a proposed resolution; the EU record includes a consumer-law notification and a preliminary DSA finding alongside continuing investigation; the CPSC commissioners requested evaluation; and the state coalition sought information. Temu’s privacy policy, by contrast, is the company’s own description of its practices.
