The claims are allegations in a civil complaint, not findings that Musk or SpaceX violated the law.
What the lawsuit alleges
The former employees say the dispute grew out of concerns about workplace conditions and Musk’s public behavior. In 2022, employees circulated an open letter to SpaceX management. The plaintiffs allege that employees were fired after the letter was shared and that Musk ordered their terminations.
The letter described Musk as the company’s public face, saying, “As our CEO and most prominent spokesperson, Elon is seen as the face of SpaceX – every tweet that Elon sends is a de facto public statement by the company.” The Associated Press reproduced that sentence from the letter; it is the employees’ statement, not a court finding.
Who filed the case and what claims are included?
The eight plaintiffs named in the complaint are Paige Holland-Thielen, Yaman Abdulhak, Scott Beck, Rebekah Clark, Deborah Lawrence, Claire Mallon, Tom Moline and Andre Nadeau. Their employment claims under California law include retaliation, wrongful termination, sex discrimination and sexual harassment. The AP reported that they sought unspecified monetary damages.

How the case differs from the NLRB matter
The civil lawsuit is separate from proceedings involving the National Labor Relations Board. In January 2024, the AP reported that the NLRB had filed a separate complaint concerning issues raised by nine fired employees. That matter and the employees’ state-court lawsuit have overlapping context, but they are not the same case.
