On 3 April 2025, the Supreme Court upheld the cancellation of West Bengal’s 2016 School Service Commission selection process for assistant teachers and Group C and D staff, while modifying parts of the Calcutta High Court’s directions. The consequences depended on whether a candidate was specifically found tainted: those candidates had to repay payments received, while other appointees lost their appointments but did not have to refund their pay. A later order temporarily allowed specified untainted assistant teachers to continue during fresh recruitment.
What the Supreme Court decided
The Supreme Court upheld the Calcutta High Court’s cancellation of the entire 2016 selection process, with modifications to the remedies the High Court had ordered. It concluded that serious irregularities and illegalities compromised the process as a whole, so the appointments were invalid even for appointees who were not individually found tainted. The Court said the process violated Articles 14 and 16 of the Constitution, which protect equality before the law and equality of opportunity in public employment. The ruling concerned appointments arising from this selection process; it was not a finding that every appointee had personally committed wrongdoing. The Court also stated that its observations and findings would not influence criminal proceedings, and reserved issues concerning the CBI investigation for separate consideration.

These are post counts stated in the judgment, not a court-verified total of appointment letters. The often-used “25,000” headline is rounded. Who had to repay payments received?
The remedy turned on whether a candidate was specifically found tainted. The Court upheld termination and repayment of salaries or other payments received for candidates found tainted. Appointments of candidates not specifically found tainted were also cancelled, but they were not ordered to repay payments they had already received. The judgment sets out the modified directions.

Could any teachers continue temporarily?
Yes, but only under a later, limited order. On 17 April 2025, the Supreme Court allowed assistant teachers for Classes IX–X and XI–XII who had not been found tainted to continue temporarily while fresh recruitment was conducted, subject to deadlines stated in that order. The Court did not extend that interim arrangement to Group C or Group D non-teaching staff. Read the 17 April 2025 order.
The deadlines in that order were set in 2025. The cited orders do not establish whether later proceedings changed the recruitment timetable or the affected teachers’ subsequent service status, so they should not be treated as confirmation of who is serving now.

What about appointees’ previous government jobs?
The 3 April judgment separately allowed certain untainted candidates who had worked in prior government departments or autonomous bodies to apply to return to those positions. Any return was subject to processing and service-continuity conditions in the judgment; it was not an automatic reinstatement for every affected appointee.

The selection involved examinations and later stages that included OMR sheets, interviews or personality tests, and rank lists. The case history records disputes over recruitment records, including unavailable original OMR sheets and discrepancies. In a 9 November 2023 order, the Supreme Court recorded that the CBI investigation was then ongoing and that parties disputed the authenticity and admissibility of scanned OMR copies. That order describes the position at that time, not the current status of the investigation.
