On April 10, 2024, the Supreme Court of India rejected fresh apology affidavits from Patanjali Ayurved and its managing director, Acharya Balkrishna, and declined Baba Ramdev’s apology affidavit in contempt proceedings over the company’s undertaking on advertising and public statements. The rejection was an interim step: on August 13, 2024, the Court accepted later apologies and closed the contempt proceedings.
Why was Patanjali before the Supreme Court?
The contempt proceedings concerned an undertaking Patanjali gave the Court on November 21, 2023, regarding advertisements and public statements about the efficacy of its products and other systems of medicine. The dispute was about compliance with that undertaking—not a scientific assessment of every Patanjali product.
In its later judgment, the Court recounted that Baba Ramdev and Acharya Balkrishna held a press conference the day after the undertaking, on November 22, and that advertisements were published on December 4. The Court found the statements and advertisements inconsistent with the undertaking and discussed provisions of the Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954, and its rules.
What did the Court reject on April 10?
The Court had issued notice to Patanjali and Balkrishna on February 27, 2024, and later issued notice to Ramdev. Balkrishna’s March 20 affidavit included an apology alongside an explanation of the advertisements; the Court rejected that conditional apology. Fresh affidavits dated April 6 described the apologies as unconditional and unqualified, but the bench rejected them on April 10. It also declined Ramdev’s apology affidavit.

LiveLaw reported that Justice Hima Kohli said: “Apology is on paper. Their back is against the wall. We decline to accept this, we consider it a deliberate violation of undertaking. Be ready for something next to rejection of affidavit.” India Today reported that the bench characterized the conduct as “wilful, deliberate and repeated violations.” Those descriptions were reported from the hearing; they should not be mistaken for quotations from the Court’s later written judgment.

The April 10 decision did not end the case. The Court continued hearing the matter, including oral apologies and later public apologies in newspapers and remedial steps. On August 13, 2024, it accepted subsequent apologies and closed the contempt proceedings.

The procedural distinction matters: the Court rejected the apologies submitted for the April hearing, then later accepted subsequent apologies when it closed the case. The April ruling should not be described as the final disposition.
