State Business Courts: Common Questions About Judges, Appeals, and Costs

State business courts are state-specific forums, not a single national system. Learn what to check about eligibility, judges, appeals, and filing costs.

A state business court is a specialized forum for certain commercial disputes, but the name does not describe one uniform court system. Each state sets its own court structure, case-eligibility rules, judge assignments, appeal route, and fees. Before filing or budgeting, check the current law, court rules, and fee schedule for the state and court where the case would be brought.

What is a state business court?

It is a state-level court or specialized docket that handles eligible business disputes. Depending on the state, it may be a separate statewide court, a business docket within an existing trial court, or a pilot program. Those arrangements are not interchangeable: the court’s authority and procedures come from that state’s statutes and rules, not from a nationwide business-court standard.

For example, Texas Government Code Chapter 25A establishes a Business Court with a judicial district encompassing the state and divisions within it. The statute addresses judges, case assignments, rules, and fees. That model does not establish how courts operate elsewhere.

Eligibility is also state-specific. The materials available here do not establish a single national list of qualifying claims or financial thresholds. Check the applicable statute and court rules to determine whether a dispute can be filed in, or transferred to, the business court.

Who are the judges, and how are cases assigned?

Judge selection, staffing, and assignment depend on the court’s local design. Do not assume that every business court has the same appointment process or that a specialist judge is assigned in the same way from state to state.

Texas’s statute provides for judges and case assignment as part of its statewide court structure. In Iowa, the Judicial Branch announced that Jeffrey Bert and David Nelmark would serve as full-time judges of the statutory Business Court, with six visiting judges appointed to assist as needed. Those details describe Iowa’s arrangement; they should not be generalized to other states.

Can you appeal a business court decision?

There is no established nationwide appellate route for business-court decisions. A secondary law-review discussion reproduced in a 2024 Wisconsin Supreme Court filing describes the ordinary civil appeal route as common, while noting that some states permit direct appeals to their highest court. That is a broad historical observation, not a current rule for any particular state.

For a specific case, verify the governing statute and appellate rules. In particular, check:

  • which appellate court hears the appeal and whether an intermediate appellate court exists;
  • the filing deadline and the event that starts the clock;
  • whether permission, certification, or another preliminary step is required; and
  • whether the rule differs by case type or procedural order.

A specialized trial court does not, by itself, mean an appeal goes directly to the state’s highest court or receives faster appellate review.

How much does business court cost?

Filing charges vary by state, court, and procedural posture. The examples below are jurisdiction-specific; they are not a national average. A listed filing fee is also only one possible litigation expense.

The three Washoe County charges reflect different filing situations. They are not amounts to add together as though every party owes all three. Texas law says fees should be set at amounts sufficient to cover administration while taking account of fee waivers necessary in the interest of justice. The Texas Supreme Court announced fees for the new court, but the current charge should be checked against its operative fee order or current filing information.

Iowa’s no-extra-fee statement applies to the original Business Specialty Court. The Iowa Judicial Branch says cases commenced on or after September 1, 2026 are governed by Iowa Code sections 602.6801–.6814, which establish a statutory Business Court; the original pilot stopped accepting new cases on that date, while pending matters may proceed. Confirm the fee rules that apply to the statutory court and to the date the case was commenced.

Do not treat a filing fee as the total cost of a dispute. Attorney time, expert work, discovery, and other court costs may add substantially to the bill. The cited court information does not quantify those overall litigation expenses, so it cannot support a reliable national cost estimate.

What should you check before choosing or filing in a business court?

  1. Confirm the court’s authority. Read the current state statute and court rules for eligible claims, thresholds, exclusions, and any transfer or assignment procedure.
  2. Identify the court model. Determine whether the forum is a separate court, a specialized docket, or a pilot, and whether it serves the relevant statewide or regional area.
  3. Verify judge and case assignment details. Use the court’s current information rather than assuming a staffing model based on another state.
  4. Map the appeal route early. Check the appellate court, deadlines, and any permission or certification requirement before a deadline is imminent.
  5. Budget from the operative fee schedule. Match the charge to the case’s procedural posture, check for applicable waivers, and budget separately for legal work and other litigation expenses.
