South Korea Proposed Rules for Seizing Crypto in Debt Cases, but November Start Is Unconfirmed

South Korea’s July 2026 draft would let courts target either a debtor’s claim to receive virtual assets or the assets themselves. The official notice does not confirm final adoption or a November start.

South Korea has proposed procedures for courts to seize and sell virtual assets in civil debt-enforcement cases, but the official notice available here describes a draft—not a confirmed final rule—and does not establish a November start date. The proposal, announced by the National Court Administration on July 2, 2026, covers both a debtor’s claim to receive virtual assets from a service provider and virtual assets themselves.

Are South Korea’s proposed crypto seizure rules already in force?

The National Court Administration announced a proposed partial amendment to the Civil Execution Rules on July 2, 2026, and set August 11, 2026, as the deadline for public comments. Its official notice explains the intended procedures, but does not establish that the amendment was finally promulgated or that it takes effect in November. The notice should therefore be read as a proposal, not proof that the described mechanisms are already available to creditors.

The National Court Administration said virtual assets have economic value and that their holding and trading are expanding, alongside cases in which they are targets of civil execution. That is the stated rationale for setting out procedures tailored to these assets; it is not a finding that every asset can be located or recovered.

How ordinary civil debt enforcement works

In South Korea, a creditor does not simply take a debtor’s Bitcoin because a debt is unpaid. The Supreme Court’s civil-enforcement explainer describes a court-backed process that generally requires an enforceable title, such as a final judgment, a provisionally enforceable judgment, or a notarial deed. Ordinary monetary enforcement proceeds through seizure, liquidation and distribution.

The Civil Execution Act version shown by the National Law Information Center took effect on February 1, 2026. Article 227 says that a seizure order for a monetary claim is served on the third-party debtor and the debtor, and that the seizure takes effect when it is served on the third-party debtor. The proposed crypto-specific procedures would add rules for virtual assets and claims to receive them; they do not eliminate the need for legal process. See Article 227 of the Civil Execution Act.

The draft describes two different enforcement paths

The procedure depends on what the creditor is asking the court to seize. A claim against a service provider is not the same thing as the virtual asset itself. The July 2 notice describes these as separate targets with different actors and seizure mechanics.

Claim held against a third party The debtor’s claim to receive virtual assets from a service provider The court may order the provider not to transfer assets to the debtor; the provider may be asked to report on the claim and assets The notice does not specify a separate effective moment for this proposed procedure Assignment, sale, or another appropriate method; proposed sale routes include a service-provider sale or transfer to an enforcement-officer account before sale
Virtual assets themselves The virtual assets The court orders seizure and restricts the debtor’s disposition; the assets are transferred to an enforcement officer When the enforcement officer receives the assets An assignment order, sale order, or another appropriate method, including a sale through a virtual-asset service provider

All procedures and liquidation routes in the table are proposed mechanisms described in the National Court Administration notice, not a guarantee that a particular court will use a particular method or that a creditor will recover the full debt.

1. Seizing a claim against a service provider

A debtor may have a right to receive virtual assets from a third party, such as a service provider. Under the draft, a creditor could ask a court to seize that claim. The proposed order could bar the provider from transferring the assets to the debtor and bar the debtor from disposing of or receiving them.

The creditor could also ask the court to require the provider to report whether the claim exists, the amount and type of assets held, and whether priority claims or other enforcement actions affect them. If the claim is seized, the draft would allow it to be converted to cash by assignment, sale, or another appropriate method.

2. Seizing virtual assets themselves

For virtual assets themselves, the draft describes a court seizure order, a restriction on the debtor’s ability to dispose of the assets, and transfer to an enforcement officer. Under the proposed sequence, seizure takes effect when the officer receives the assets. Liquidation could then proceed through an assignment order, sale order, or another appropriate method, including a sale through a virtual-asset service provider.

What the Supreme Court’s Bitcoin decision does—and does not—show

In an order dated December 11, 2025, the Supreme Court addressed Bitcoin seizure under criminal procedure. Its English summary says Bitcoin’s independent manageability and transferability can make it an item subject to seizure by a court or investigative agency under the Criminal Procedure Act, if the legal requirements are met. That decision concerns criminal-procedure seizure; it does not put the proposed civil debt-enforcement rules into effect or establish that a creditor can collect an unpaid debt by seizing Bitcoin. What debtors and creditors should take from the proposal

  • For creditors: the draft could provide court-directed routes to restrain and liquidate either a claim to receive virtual assets or the assets themselves. It does not make recovery automatic; an enforceable title and the applicable court process remain central to civil enforcement.
  • For debtors: the proposed restrictions would be court-ordered. The notice does not describe a general right for a creditor or service provider to bypass the court and take assets directly.
  • For anyone relying on a November date: the July 2 notice and August 11 comment deadline do not confirm final adoption or commencement in November. The timing claim should not be treated as established by that notice.
