The owners of Perth cafe business Sinamon were penalised $31,000 by Western Australia’s Industrial Magistrates Court in September 2025 after the Court found underpayment, unpaid superannuation and employment-record failures involving a casual worker. In a later statement reported by PerthNow, the business accused the department of having a “vendetta” and said the former worker sought revenge; those are the owners’ claims, not the Court’s findings.
Why were Sinamon’s owners fined $31,000?
The Industrial Magistrates Court of Western Australia found that Ahmed El Sayed Imam and Yan Woon Desiree Hui breached employment laws in their treatment of a casual worker at the Mount Lawley cafe. The Court recorded 62 contraventions: 29 involving underpayment, four involving superannuation and 29 involving employment records. The Government of Western Australia announced the $31,000 penalty in October 2025. Government of Western Australia; Industrial Magistrates Court reasons.
The $31,000 was the penalty, not the amount of wages the worker was found to have missed. The Court assessed total underpayment at $3,670.80. Its reasons set out the detailed penalty allocation and discussion of aggregation and course of conduct.
What did the Court find about the worker’s pay and super?
The worker was employed from 15 March to 3 November 2019, about seven and a half months. She served food and coffee, took orders and payments, worked as a barista and cleaned. The Court’s reasons say she also held several jobs while studying nursing full-time.

The Court found she was paid a flat $18 an hour regardless of when she worked, including weekends and public holidays. That amount was below the applicable minimum base rate, and the required loadings were not paid. The Court also found the owners failed to pay required superannuation, issue payslips and keep complete records of the worker’s hours and wages. The Court’s published reasons describe the findings and the legal obligations at issue.
What did the Sinamon owners say after the penalty?
In a statement reported by PerthNow on 15 October 2025, the business alleged that the department had a vendetta and that the former worker was seeking revenge after being fired. PerthNow reproduced this line from the statement: “The irony is that they are the ones who exploited a staff who is so desperate for revenge after being fired six years ago.” These allegations are the business’s account; the Court’s published decision records findings about pay, superannuation and records, not a finding that the department had a vendetta or that the worker acted out of revenge. The Government’s October 2025 release quoted Private Sector Labour Relations Director Cara Breuder describing the worker as a young person “doing it tough to put herself through university” and said hospitality is a high-risk sector for underpayments, including because it employs many young and overseas visa workers. The release also quoted the Court’s description of the respondents’ “blatant disregard” for compliance and their employment obligations.
How does the penalty fit with earlier enforcement?
The $31,000 case was part of a longer enforcement history described by the WA Government. Its releases reported $14,300 in penalties in 2022 relating to failures to produce records and obstruction, and $89,800 in 2023 for failing to comply with court orders to produce employment records. In October 2025, the Government said the owners had accrued more than $135,000 in penalties for WA employment-law breaches. That cumulative figure is the Government’s statement as of that date, not a calculation of the worker’s unpaid wages. October 2025 Government release; 2022 release; 2023 release.

What the case means for workers checking their pay
The Court’s reasons explain why employment records and payslips matter: they help workers check whether pay is correct. In this case, the findings concerned four distinct obligations:
- Pay the applicable award minimum rate, including required loadings for relevant shifts.
- Pay required superannuation.
- Keep accurate records of hours and wages.
- Provide payslips.
A 2023 WA Government account of an earlier proactive cafe and restaurant campaign said four out of five businesses in that campaign did not comply with State employment laws. That is a historical campaign result, not a current estimate for the hospitality sector. WA Government campaign release.
