The estate of Michael Virgil alleged that Royal Caribbean crew served him at least 33 alcoholic drinks and used force, pepper spray and a sedative during an incident aboard the Navigator of the Seas in December 2024. The Los Angeles County Medical Examiner reportedly classified Virgil’s death as a homicide, but that is a medical manner-of-death finding—not a criminal conviction or a court finding of cruise-line liability. The estate’s civil lawsuit later settled; the amount was not disclosed in the public sources reviewed.
What happened to Michael Virgil on the Royal Caribbean cruise?
According to the estate’s complaint, Michael Virgil, 35, boarded Royal Caribbean’s Navigator of the Seas on December 13, 2024, for a voyage from the Los Angeles area toward Ensenada, Mexico. The complaint alleges that he became disoriented and agitated while trying to find his cabin after crew served him at least 33 alcoholic drinks.
The pleading alleges that security personnel restrained Virgil using their body weight, that crew members used multiple cans of pepper spray, and that a Staff Captain requested an injection of haloperidol, a sedative medication. It claims those actions contributed to respiratory failure, cardiac arrest and Virgil’s death. These are allegations made by the estate, not facts established by a trial verdict. Read the complaint.
Was Virgil really served 33 drinks?
The figure of at least 33 alcoholic drinks comes from the estate’s complaint. The available sources do not establish it as an independently verified count or a finding by a court. It should therefore be understood as the plaintiff’s allegation, not a proven total.

Why was the death classified as a homicide?
The Associated Press reported that the Los Angeles County Medical Examiner classified Virgil’s death as a homicide and identified combined effects including mechanical asphyxia, obesity, cardiomegaly (an enlarged heart) and ethanol intoxication. In this context, “homicide” is the medical examiner’s classification of the manner of death. It does not, by itself, mean a crime was proven, identify a person legally responsible, or establish that Royal Caribbean caused the death. See the AP report.
Passenger Christopher McHale, quoted by AP, said, “He just needed some help.” That is his reaction to the incident, not independent proof of what happened or who was liable. Read AP’s report.

Did the family sue Royal Caribbean, and did the case settle?
Connie Aguilar, acting as personal representative of Virgil’s estate, filed a wrongful-death complaint on December 5, 2025, in the U.S. District Court for the Southern District of Florida. A public docket mirror records a notice of settlement dated January 8, 2026, followed by filings and court action concerning approval of the minor son’s share.
The reviewed public reporting says the settlement amount is sealed. No amount should be inferred from the settlement, and the settlement is not a public trial verdict or, on the available record, an admission of liability. What did Royal Caribbean say?
AP reported that a company spokesperson said: “We were saddened by the passing of one of our guests, worked with authorities on their investigation, and will refrain from commenting any further on pending litigation.” Read AP’s report.
