‘RHOBH’ Husband Tom Girardi Sentenced to 7 Years and 3 Months for Fraud

Former lawyer Tom Girardi received a seven-year-and-three-month federal prison sentence for wire fraud involving clients’ settlement money, along with restitution and a fine.

Tom Girardi was sentenced on June 3, 2025, to seven years and three months in federal prison for wire fraud involving clients’ settlement money. The court also ordered him to pay $2.3 million in restitution and a $35,000 fine, according to the Associated Press. Girardi, Erika Jayne’s estranged husband, appeared on The Real Housewives of Beverly Hills (RHOBH); the federal case was about his conduct as a lawyer, not the show.

Why was Tom Girardi sentenced to prison?

A federal jury found Girardi guilty in August 2024 of four counts of wire fraud. The case concerned money owed to clients from legal settlements. The U.S. Department of Justice (DOJ) says the scheme ran from October 2010 to late 2020.

According to DOJ’s account, Girardi operated his law firm, Girardi Keese, “like a Ponzi-scheme”: he used newly obtained settlement funds to make partial payments to clients who had already been defrauded, or to cover unrelated expenses. DOJ says he also lied about why clients were not being paid. The description is the government’s account of the conduct underlying the conviction.

What was the sentence?

U.S. District Judge Josephine L. Staton sentenced Girardi on June 3, 2025, to seven years and three months in prison. The court also ordered $2.3 million in restitution and imposed a $35,000 fine, the Associated Press reported. DOJ’s headline describes the term as “more than 7 years”; the AP report gives the precise sentence.

The AP reported that Girardi was ordered to surrender by July 17, 2025. The cited sentencing coverage does not establish his subsequent custody status or any later appeal outcome.

How did the case unfold?

  1. August 2024: A federal jury convicted Girardi on four wire-fraud counts. DOJ announced the verdict on August 27, 2024, in its conviction announcement.
  2. June 3, 2025: Judge Staton imposed the prison sentence, restitution and fine.

The U.S. District Court’s Central District of California publication describes a 13-day trial and the four-count verdict. It also notes that Girardi and Girardi Keese entered involuntary bankruptcies in December 2020 (Court News, October–December 2024).

What does the case have to do with RHOBH?

Girardi was Erika Jayne’s estranged husband and appeared on RHOBH dozens of times from 2015 to 2020, according to the Associated Press. That connection explains the show reference in coverage of the sentencing, but it is separate from the criminal case: the cited conviction was Girardi’s, for wire fraud involving clients’ settlement funds. The case did not convict Jayne, the show, or another cast member.

Why is Tom Girardi a familiar name outside reality television?

Before the federal fraud case, Girardi was known for representing plaintiffs in major litigation. The AP reports that his lawsuit against Pacific Gas & Electric led to a $333 million settlement and was portrayed in the 2000 film Erin Brockovich. That earlier litigation is background to his public profile, not part of the wire-fraud sentence.
