Kennedy Jr. did not clearly accept Senator Elizabeth Warren’s specific demand to give up all compensation from drug-company lawsuits. At his January 29, 2025 Senate Finance Committee confirmation hearing, he said only, “I will comply with all the ethical guidelines.” Public accounts then described changing plans for a 10% interest in fees from Gardasil-related cases referred to Wisner Baum: an amended agreement identified his adult son as the recipient, while Warren’s office later said HHS disclosed that Kennedy transferred the interest to Wisner Baum on February 11, 2025.
What the confirmation-hearing exchange established
Warren questioned Kennedy about a financial interest connected to Gardasil litigation referrals to the law firm Wisner Baum. Her request concerned a broader commitment: that he forgo compensation from drug-company lawsuits while serving as HHS secretary and for four years afterward.

Kennedy’s response, as reproduced in the transcript hosted by Warren’s Senate office, was: “I will comply with all the ethical guidelines.” That sentence indicates compliance with applicable ethics requirements; it does not, by itself, document an unconditional promise to abandon every current or future lawsuit fee. The hearing occurred on January 29, 2025, during his nomination to lead the Department of Health and Human Services.
What “the Gardasil stake” meant
The interest was described as a share of potential fees tied to cases referred to Wisner Baum. It was not ownership of Gardasil, Merck, or the vaccine itself. The sources reviewed also do not establish that Kennedy personally kept the interest after February 2025, that his son received settlement money, or that any settlement proceeds were paid to Kennedy or a family member.

Son or Wisner Baum? Why the accounts differ
Two descriptions concern the intended recipient of future fees:
- February 1 arrangement: the publicly described amendment directed the interest to a nondependent adult son.
- February 11 transfer: Warren’s office says HHS later disclosed that the interest was transferred to Wisner Baum instead.
Warren’s office said the February 11 change was not publicly amended or notified for 18 months. That is an account from a Senate oversight office, not a court finding. It also does not determine the legal effect of the transfer or whether anyone ultimately received proceeds.

What Kennedy’s promise did—and did not—say
What the record shows
- He answered Warren’s ethics question by saying he would comply with ethical guidelines.
- His August 1, 2026 statement, as quoted by Warren’s office, says he relinquished potential Gardasil fees to Wisner Baum before taking office.
What the record does not establish
- That he verbally accepted Warren’s requested four-year ban on all drug-company lawsuit compensation.
- That his son received settlement proceeds.
- That Kennedy personally benefited from a Gardasil settlement.
- That his HHS actions caused or influenced any particular litigation outcome.
Do vaccine-compensation figures prove anything about this stake?
No. The Associated Press reported that the federal Vaccine Injury Compensation Program’s cap for injury or death claims was $250,000, unchanged since 1986. It also reported that the program had paid about $5.4 billion in total and compensated roughly 40% of claimants. Those figures describe a federal compensation program, not the value of Kennedy’s referral-related interest or proceeds from Gardasil litigation.

Bottom line for readers
Kennedy’s hearing answer was a qualified ethics commitment, not a clear acceptance of Warren’s proposed blanket waiver. The publicly described plan first pointed to his adult son, while Warren’s office later said HHS disclosed a February 11, 2025 transfer to Wisner Baum. The available accounts leave payment, personal benefit, and the transfer’s legal effect unresolved.
