Regulatory Resilience: 10 Cryptocurrency Exchange Trends That Shaped 2024

Ten developments shaped crypto-exchange regulation in 2024, including detailed EU MiCA implementation, uneven global Travel Rule progress, stablecoin oversight and a clear distinction between Bitcoin ETP approval and exchange approval.

In 2024, cryptocurrency-exchange regulation became more detailed in the EU while global implementation remained uneven. The ten developments below are an editorial synthesis of regulator and standard-setter materials, not an official or independently verified ranking. Together, they show why an exchange’s regulatory resilience depends on adapting to the rules for each jurisdiction and service—not on a single global license or policy.

What were the 10 cryptocurrency exchange trends of 2024?

The most visible regulatory work involved the EU’s Markets in Crypto-Assets Regulation (MiCA), global anti-money-laundering implementation, and cross-border coordination. The themes below describe developments documented during 2024; they do not establish that every exchange had implemented a particular requirement by year-end.

1. EU authorization requirements for crypto-asset service providers took shape

In March, the European Securities and Markets Authority (ESMA) published its first MiCA final report on technical standards. It addressed information needed for authorization of crypto-asset service providers (CASPs), notifications by existing financial entities, assessments of qualifying holdings, and complaints handling. For a provider operating in the EU, authorization work therefore involved more than establishing that it offered crypto services: supervisors were also setting expectations for ownership information and customer complaint processes. ESMA’s March 2024 report documents those topics.

2. Investor disclosure and record-keeping became more detailed

ESMA’s July report covered transparency and disclosure for retail investors, provider record-keeping, and data standards intended to support supervision. These are related but distinct concerns: customers need understandable information, while supervisors need records and data they can use to oversee providers. The report describes part of MiCA’s implementation agenda, rather than evidence that every platform already met the resulting expectations. ESMA’s July 2024 release summarizes the package.

3. MiCA guidance addressed suitability and transfer services

In December, ESMA issued guidance concerning suitability when providing crypto-asset advice or portfolio management, as well as policies and procedures for crypto-asset transfer services. The scope matters: suitability guidance relates to advice and portfolio-management services, not automatically to every customer’s decision to buy or sell an asset on an exchange. ESMA’s December 2024 release describes these guidelines as part of the final policy work ahead of MiCA’s application from December 30, 2024.

4. Market-abuse surveillance entered the EU implementation agenda

ESMA’s December policy package included draft technical standards concerning the detection and prevention of market abuse under MiCA. That put surveillance on the implementation agenda alongside authorization and disclosure. Publication of draft standards does not show that every exchange had already built, tested, or deployed compliant surveillance systems; it establishes that the EU framework was specifying expectations in this area. The relevant documents are listed in ESMA’s December release.

5. Regulatory boundaries and reverse solicitation needed careful treatment

ESMA said reverse solicitation should be understood narrowly and not used to circumvent MiCA. It also issued criteria addressing when a crypto-asset may qualify as a financial instrument under other regulatory frameworks. For firms, this makes the nature of the service, the way a client relationship begins, and the classification of an asset relevant to determining which rules apply; simply describing a customer as having approached a provider does not settle the regulatory question. ESMA’s December 2024 materials set out this work.

6. Global AML/CFT implementation remained uneven

The Financial Action Task Force (FATF) reported that 75% of jurisdictions in a sample based on 130 mutual evaluation and follow-up reports were only partially or not compliant with Recommendation 15. The reports covered implementation since the revised recommendation was adopted in 2019; this is not a current estimate of compliance in 2026. FATF also identified continuing weaknesses in risk assessment and supervisory inspections. FATF sets standards for jurisdictions: countries implement and supervise them, rather than FATF directly regulating exchanges. FATF’s July 2024 update provides the assessment and its context.

7. The Travel Rule’s challenge shifted from legislation to effective implementation

The Travel Rule concerns required originator and beneficiary information associated with certain virtual-asset transfers. In its 2024 survey, FATF said nearly one third of respondents had not passed legislation to implement the rule. It also reported low supervision and enforcement even among jurisdictions that had passed legislation, while noting private-sector progress in using compliance tools. A law on the books, functioning oversight, and workable information-sharing processes are separate steps; progress on one does not prove completion of the others. 8. Stablecoin oversight and illicit-finance monitoring stayed in focus

FATF noted increased adoption and use of stablecoins, including use for illicit activities; that does not mean stablecoin activity as a whole is illicit. The Financial Stability Board (FSB) listed implementation of its global framework for global stablecoin arrangements among its priorities for 2024. The combined policy concern was how to monitor risks and put oversight frameworks into practice as use expands. See FATF’s update and the FSB’s 2024 work programme.

9. Operational and cyber resilience became part of implementation work

The European Commission described MiCA and Digital Operational Resilience Act (DORA) work that included information and communication technology (ICT) risk management, incident reporting, and resilience testing. ESMA also addressed systems and security access protocols in its MiCA policy work. These regulatory workstreams make technology controls and operational continuity part of the compliance conversation; they are not evidence of a particular increase in exchange incidents. 10. Cross-border coordination remained essential

The FSB emphasized effective implementation of global frameworks for crypto-assets and stablecoins, while FATF’s findings showed that national implementation was uneven. An exchange’s obligations therefore depend on where it operates, what services it provides, and which customer markets it serves. A policy or authorization in one jurisdiction should not be assumed to resolve obligations elsewhere. How did MiCA affect crypto exchanges in 2024?

MiCA moved from a general EU framework toward detailed implementation materials for CASPs, including authorization information, complaints handling, disclosures, records, suitability-related guidance, transfers, and market-abuse controls. ESMA said it had published more than 30 technical standards and guidelines during an 18-month preparation effort; that figure describes the scope of ESMA’s output, not the number of obligations applicable to an individual exchange. MiCA applied from December 30, 2024, according to ESMA’s December release. The specific requirements for a provider depend on its activities and circumstances.

MiCA is not a guarantee that a platform or asset is safe. ESMA Chair Verena Ross cautioned in December 2024: “Nevertheless, it is crucial to recognise that the new regime would not suffice to eliminate the inherent uncertainty and volatility in the crypto-assets market, and investors should fully understand the risks before engaging in this space.” The statement accompanied ESMA’s final policy documents.

Does SEC approval of a Bitcoin ETF mean crypto exchanges are regulated?

No. On January 10, 2024, the U.S. Securities and Exchange Commission approved the listing and trading of spot Bitcoin exchange-traded product (ETP) shares on regulated securities exchanges. SEC Chair Gary Gensler clarified: “Today’s action does not approve or endorse crypto trading platforms or intermediaries.” The approval concerned ETP shares holding bitcoin; it was not an approval of crypto-trading platforms, nor a general determination about the regulatory status of crypto-assets. Gensler’s January 2024 statement sets out the distinction.

What should you check when comparing exchanges?

Regulatory resilience is best assessed against the services and jurisdictions relevant to you. A useful checklist is:

  • Jurisdiction and authorization: identify the legal entity serving you, the jurisdictions in which it is authorized, and whether the authorization covers the service you intend to use.
  • AML/CFT and transfers: review how the provider handles customer checks and transfer-related information requirements, including the Travel Rule where applicable.
  • Complaints and customer information: look for a clear complaints process and disclosures that explain the service and its risks.
  • Governance and conflicts: understand how the provider describes its governance and the handling of conflicts of interest.
  • Market-abuse controls: consider what the provider discloses about surveillance and controls against abusive trading.
  • Technology and continuity: assess the available information about cyber controls, incident handling, and operational resilience.

These checks help frame questions; they do not establish that a particular exchange is suitable or compliant. Regulatory status can change and should be verified with the relevant regulator for the specific entity, location, and service. Regulation also does not remove volatility or other investment risks.
