What changed with red diesel?
President Donald Trump signed an order on October 5, 2026, easing limits on highway use of red-dyed diesel, according to The Associated Press. CBS News reports that the federal highway excise tax is deferred through the remainder of 2026 and says the White House is exploring ways to eliminate the repayment obligation. That is a temporary deferral as described in current reporting—not a confirmed permanent repeal. The executive-order text and agency implementation notices were not independently reviewed for this article.
Red diesel is diesel fuel marked with red dye and sold for nontaxable uses, commonly off-road work such as agriculture and construction. The dye helps enforcement distinguish fuel subject to different highway-tax treatment; it does not make the fuel more powerful or cheaper to produce. Historical explanations of the system appear in the Government Accountability Office’s 1996 report and a 2003 Federal Register proposed rule. Neither is current legal authority for the 2026 order.
Can I use red diesel on the highway now?
Not on the strength of this national summary alone. Contemporary reporting describes a federal change, but state restrictions or enforcement may still affect highway use, and the available reporting does not establish the rules state by state. Before using dyed fuel on a public road, check current guidance from the relevant state tax or transportation authority and ask the fuel seller what product and tax treatment apply. The distinction matters especially for operators who cross state lines: a federal tax deferral does not by itself establish that every state has adopted the same approach or that enforcement practices are uniform. CBS News identifies state restrictions as a possible limit, but does not provide a state-by-state tracker.
Is red diesel the same as regular diesel?
It is diesel fuel distinguished by its red dye and tax designation, rather than a different fuel benefit. The dye is a marker used to help identify fuel sold for nontaxable applications. The 2026 action concerns whether and how that fuel may be used on highways and taxed; the evidence cited here does not establish that dyed fuel offers a performance advantage.

How much could red diesel save?
CBS News reports the federal highway diesel excise tax as 24.4 cents per gallon. That figure is the tax amount reported for regular highway diesel, not a guaranteed discount at the pump or a guaranteed saving for every driver. The sources do not report measured post-order retail savings or establish that the change will be passed through to buyers.
Price context also matters. CBS News, attributing figures to AAA, reported a national diesel average of $6.53 per gallon at a record high the preceding month, $6.32 on October 6, 2026, and $3.76 before the Iran war. Those are dated national averages, not a forecast of what a particular driver will pay after the order.

Fuel supply and distribution can affect whether any tax change translates into a lower price. CNBC’s summary identifies distribution and pass-through as variables. GasBuddy petroleum expert Patrick De Haan told CBS News, “It might lead to savings for some, but there are a lot of details that will prevent this from having widespread relief.”

The administration’s savings figure is a claim, not a measured outcome. AP reports that Trump said, “The typical trucker will save more than $100 every time they fill up.” The reporting reviewed here does not show that truckers have realized those savings or that the full amount will reach them.

De Haan’s supply-side warning, quoted by AP, was: “Taxes aren’t the problem, supply is.” That is an expert’s assessment, not proof of the order’s eventual effect. To judge what an individual operator experiences, separate four questions:
- Federal tax treatment: whether the reported temporary deferral applies to the fuel and use in question.
- State rules: whether the relevant state permits the use and how it enforces its requirements.
- Fuel access: whether dyed diesel is available to the operator through a usable distribution channel.
- Realized price: whether the posted price actually falls, rather than merely reflecting a claimed tax saving.
Until those pieces are established, neither the 24.4-cent tax figure nor the more-than-$100 claim should be treated as a personal savings estimate.
