Re:

Received Money to Vacate Your Flat for Redevelopment? What the ITAT Actually Decided

A 2026 Mumbai ITAT order asks the tax appellate authority to reconsider redevelopment-related additions. It does not establish that all transit rent or hardship compensation is tax-free.

As of 4 August 2026, the short answer is: a payment received while vacating a flat for redevelopment is not automatically tax-free. In Asiha Ayub Gheewala v. ITO, the Mumbai Income Tax Appellate Tribunal (ITAT) sent the dispute back for a fresh decision; it did not rule that this appellant’s compensation was exempt.

The case is relevant if you received transit rent, hardship compensation or another payment during redevelopment, but its outcome depends on the payment’s purpose, your rights in the original property and the agreement’s terms. The Tribunal directed the Commissioner of Income Tax (Appeals), or CIT(A), to examine those matters and relevant precedents.

What the Mumbai ITAT decided

The order in Asiha Ayub Gheewala v. ITO, ITA No. 1337/Mum/2026, concerns assessment year 2018–19. The Mumbai ITAT issued it on 4 August 2026. The appellant and her husband jointly owned a flat in a Mumbai cooperative housing society, and a replacement flat was allotted under a registered redevelopment arrangement.

The Tribunal admitted additional evidence and remanded the matter to CIT(A) for a fresh, reasoned decision on the merits after hearing the assessee. It said it had “not expressed any opinion on the merits of either of the additions” and left both parties’ contentions open. The appeal was “allowed for statistical purposes,” which in this context reflects the remand—not a final finding that either amount was tax-free. The reproduced ITAT order records the decision and its limits.

Which two tax issues remain open?

The appeal involved two separate additions. They concern different tax questions and should not be conflated.

Issue Amount and tax treatment applied below What the assessee argued
Replacement flat ₹31,06,100 was added as income from other sources under section 56(2)(x), based on the difference between stamp-duty value and stated consideration. The assessee argued that the flat was allotted through redevelopment in place of a flat she already jointly owned, rather than acquired as an independent purchase at inadequate consideration.
Displacement payment ₹23,44,464 was treated as capital gains on alleged relinquishment of tenancy rights. The assessee said it was hardship or rent compensation for temporary displacement during construction—not payment for transferring or relinquishing tenancy rights.

For the compensation, the assessee’s account of the agreement stated a rate of ₹120 per square foot for 36 months. That figure describes her position in this case; it is not a general rate for redevelopment payments. The Tribunal directed CIT(A) to consider the agreements, rights arising from ownership of the old flat, consideration under the project, the permanent alternate accommodation and the relevant transfer question.

Why compensation for temporary displacement may receive different treatment

The assessee relied on the Bombay High Court’s 2024 decision in Sarfaraz S. Furniturewalla v. Afshan Sharfali Ashok Kumar & Ors. and the Mumbai ITAT’s decision in Delilah Raj Mansukhani v. ITO. As the Gheewala order recounts it, the High Court approved a Tribunal view that compensation for displacement under a development agreement was capital rather than revenue in nature for the issue before it. The Gheewala ITAT said CIT(A) had not dealt with these authorities and directed their consideration; it did not decide whether the appellant’s payment met the relevant tests. The precedent is discussed in the reproduced Gheewala order.

The issue in Sarfaraz was whether transit rent was a revenue receipt and whether tax deduction at source (TDS) was required under section 194-I. That is not the same as deciding whether a particular payment is taxable as capital gains. A ruling on the TDS treatment of another taxpayer’s transit payment does not create a blanket exemption for every sum described as “transit rent,” “hardship compensation” or “rent compensation.”

Temporary displacement is not the same as surrendering tenancy rights

A separate line of redevelopment cases involves a tenant surrendering tenancy rights in exchange for an alternate flat. A distinct Mumbai ITAT matter concerning Haresh Damji Shah discussed that kind of exchange under the capital-gains framework, including section 45 and a section 54F argument. That is analytically different from money asserted to compensate someone for temporary displacement while construction is under way. The distinction is noted in the reproduced order concerning Haresh Damji Shah.

To assess your own payment, examine what right you held before redevelopment and what the developer gave you in return. A payment may be connected to temporary relocation, surrender or transfer of a property right, or another contractual arrangement. The label on a payment clause alone does not establish its tax treatment.

What to check if you received redevelopment compensation

  • Purpose and payment terms: Read the redevelopment agreement and any separate transit-rent or hardship-compensation clauses. Check the payment period, calculation method and conditions.
  • Your original right: Gather ownership records or tenancy documents for the old flat. The analysis can differ depending on whether you owned the premises or held tenancy rights.
  • What you gave up and received: Compare the old-property rights, any rights surrendered, the replacement accommodation and each payment. Do not assume that a payment for temporary relocation and consideration for a transfer are interchangeable.
  • The tax issue involved: Identify whether the dispute concerns income from other sources under section 56(2)(x), capital gains, or TDS under section 194-I. A decision on one issue may not answer the others.
  • Assessment and appeal records: Keep the tax return, notices, assessment orders and appeal orders alongside the agreements and payment records. Have an Indian chartered accountant or tax lawyer review them before drawing a conclusion.

The Gheewala order is a remand in one taxpayer’s appeal, not an individualized ruling for everyone who has vacated a flat during redevelopment. Its practical value is that the appellate authority must consider the agreements, evidence and relevant authorities before deciding the merits.
