Buy from the original manufacturer or its authorized channel wherever possible; when that route is unavailable, qualify the supplier, assess the part and supply-chain risk, apply appropriate inspection and authentication, and have a documented way to contain, adjudicate, dispose of, and report suspect parts. The exact legal requirements depend on the contract and jurisdiction; government procurement clauses discussed below do not automatically apply to every automotive buyer.
Why counterfeit semiconductors matter to automotive manufacturers
A component can power up and pass a basic receiving check while still being counterfeit. The risk is authenticity and represented condition: a part may be unauthorized, altered, substituted, used but sold as new, or carry false claims about its grade, lot, date code, or performance. NASA’s counterfeit-part definition encompasses these forms of misrepresentation.
That distinction matters because semiconductors are used in safety-critical automotive systems, including braking and airbags. A counterfeit or misrepresented component can undermine the assumptions behind engineering qualification, traceability, and reliability controls. It also creates potential exposure to recalls, production disruption, warranty costs, regulatory scrutiny, and loss of customer or business-partner trust. Those are credible categories of risk, not a quantified estimate of automotive losses: the cited sources do not establish an automotive-specific counterfeit failure rate or revenue-loss figure.
NHTSA Administrator Jonathan Morrison’s prepared remarks to the Automotive Anti-Counterfeiting Council on September 23, 2026, warned that critical safety components offered online at a fraction of their normal value should be treated as a red flag, while also recognizing the role of safe aftermarket parts in affordable repair and maintenance. A low price is a warning signal, not proof by itself that a part is counterfeit.

Where counterfeit parts can enter the supply chain
Exposure rises when a buyer cannot obtain a needed part through authorized channels and turns to independent distribution or other non-authorized sources. This may happen when a device is no longer in production, authorized inventory is unavailable, lead times threaten production, or a buyer is seeking a replacement outside the original supply arrangement. The need to keep a line running does not establish that a source or a part is authentic.
In a complex chain, the practical challenge is preserving evidence that connects the component to a legitimate source and its represented identity. Supplier claims, packaging, labels, or apparently normal electrical behavior may not, alone, establish that chain. Treat source identity, traceability, part criticality, lifecycle status, and available authentication evidence as related inputs to a risk decision.
Build controls around the part’s risk and source
Prefer the original manufacturer or authorized channel
For in-production parts, direct sourcing from the original manufacturer or purchase through its authorized distribution network is the preferred control. Require procurement records and traceability appropriate to the part and the transaction, and verify supplier authorization rather than relying only on a seller’s description.

Qualify a non-authorized source before buying
If authorized supply is unavailable, document why an exception is needed and assess the alternative supplier before purchase. Review its prevention and detection processes, how it preserves traceability, how it handles suspect material, and whether it can provide credible evidence for the specific component offered. Consider audit or certification evidence, but establish what organization and scope it covers; neither certification nor a supplier’s general reputation proves that an individual component is authentic.

SAE ARP6178A, revised August 1, 2023, provides tools for assessing non-authorized suppliers. SAE AS6081A, revised April 21, 2023, addresses avoidance, detection, mitigation, disposition, and reporting for independent distribution of electrical, electronic, and electromechanical (EEE) parts. These are sector standards and guidance with defined scopes, not a blanket rule that every automotive buyer is legally required to follow them.
Assess the specific part and transaction
Scale controls to the part’s safety and functional criticality, lifecycle status, source, traceability, and the strength of authentication evidence. A hard-to-source, obsolete part from a non-authorized channel warrants a different level of scrutiny than an in-production component received through a verified authorized channel. Record the rationale for the chosen controls and any acceptance decision so engineering, quality, and procurement can work from the same risk picture.

Inspect and authenticate without relying on one test
Receiving controls should be set by competent engineering and quality personnel for the part and its risk. A documented plan may combine records and traceability review, visual examination, and appropriate testing or authentication. The cited standards support layered controls; they do not establish one universal test recipe for automotive semiconductors.
- Check purchase and traceability records against the supplier, manufacturer, part identity, and represented lot or date information.
- Examine packaging, labels, markings, and the component for inconsistencies or signs of alteration, using procedures appropriate to the device.
- Choose additional authentication or electrical testing based on the component, risk, and applicable requirements; define acceptance criteria before testing.
- Keep results tied to the lot and supplier, and escalate discrepancies for technical review rather than treating an isolated pass as proof of authenticity.
Visual inspection can identify warning signs but cannot establish authenticity on its own. Likewise, a functional test may show that a sample operates under the test conditions without proving its origin, history, grade, or long-term reliability. No single test or certification guarantees authenticity.
Contain, adjudicate, and report suspect material
Stop suspect parts from reaching production
When credible evidence creates reasonable doubt about authenticity, treat the material as suspect and follow a defined containment process. NASA’s procurement clause uses that reasonable-doubt concept in defining a suspect counterfeit part. Segregate and identify affected inventory, block it from production or shipment, and preserve packaging, labels, records, and test evidence. Trace the lot to determine whether related material has already been issued or installed.

Make a documented disposition decision
Have qualified engineering, quality, procurement, and compliance personnel review the evidence and decide whether the material can be authenticated, must be rejected or returned, or requires another controlled disposition. Do not release a lot solely to avoid a shortage or schedule delay. Document the decision, rationale, affected quantities, and corrective actions, including replacement sourcing where needed.
Report through the applicable channels
Use the organization’s incident-reporting and customer-notification procedures, and determine whether the contract, procurement clause, or other applicable requirement calls for external reporting. Maintain records that support traceability, investigation, disposition, and any required notification. Reporting obligations vary by contract and legal context; do not assume one framework applies to every private automotive transaction.

Procurement clauses and voluntary or sector-specific standards serve different purposes. The clauses below govern only acquisitions and contractors within their scope; the SAE publications provide frameworks or guidance for specified activities and do not by themselves make every automotive supplier subject to a legal obligation.

Before incorporating a publication or clause into a supplier requirement, verify its current edition, status, contractual applicability, and the scope of any claimed certification. A reference to a standard is not a substitute for deciding whether it fits the organization’s sourcing model and risk.
Make the program operational across procurement and quality
Counterfeit avoidance works best when responsibility is shared rather than left to incoming inspection. Procurement controls the approved-source decision and exception record; engineering defines criticality and appropriate technical checks; quality manages receiving, containment, and disposition; compliance determines contract-specific obligations and reporting; and brand-protection or legal teams support escalation where products may be misrepresented in the market.
- Maintain approved-source and supplier-qualification records, including the evidence supporting any non-authorized-source exception.
- Use part- and source-specific risk assessments to set inspection and authentication requirements.
- Ensure suspect inventory can be quickly identified, segregated, and traced to affected lots and downstream users.
- Train relevant teams on escalation paths and preserve investigation and disposition records.
- Review controls when a component becomes obsolete, authorized stock is depleted, the source changes, or a new authenticity concern emerges.
The Semiconductor Industry Association has warned that counterfeit semiconductors can jeopardize lives, citing contexts such as airbag deployment. That is an industry association statement, not a regulator’s finding or a measured automotive failure rate. Its separately cited historical figure that fewer than 0.01% of legitimate semiconductor products fail during operation is approximately from 2013, is not automotive-specific, and has no named underlying dataset in the available source context; it should not be used as a current automotive benchmark or as a direct comparison with counterfeit parts.
