How are prediction markets different from futures markets?
A prediction-market contract is tied to an event or outcome, such as whether a specified economic indicator reaches a threshold. A futures contract is a standardized agreement to buy or sell an underlying commodity or financial instrument at a later date under the contract’s terms. Both are derivatives, so they should not be treated as mutually exclusive legal forms in every circumstance.

An event contract defines the event or outcome that determines its payout. It might ask whether a specified condition will occur, offer several possible outcomes, or pay according to which range an eventual result falls within. The precise settlement terms matter: the contract should identify what counts as the outcome and how it will be determined.

Do not assume an event contract’s quoted price is an objective probability. Liquidity, fees, and the contract’s mechanics can affect the price and what a trader ultimately receives. Check the venue’s rules for the payout calculation and outcome-determination process.
What does a futures contract represent?
A futures contract is standardized and references a commodity or financial instrument. Its specifications establish what the contract covers and how it is settled. Some futures settle in cash; others may involve delivery, so it is incorrect to assume that every futures contract requires physical delivery.

Futures prices change with the market value of the underlying reference. Traders can use futures to hedge exposure to price changes or speculate on them. The CFTC identifies hedging price risk for producers and consumers as a key economic purpose of futures, while also noting that futures are traded by speculators.
Can traders exit either contract before settlement?
In both markets, a trader may be able to exit before the contract settles, but the mechanics and practical availability depend on the market. The CFTC says customers may trade out of event contracts before settlement at the then-current market price. It also describes offsetting futures positions before delivery.

An ability to trade out is not a guarantee of a willing counterparty at a desirable price. Liquidity and venue rules matter, and the price available before settlement may differ substantially from the eventual payout or the value of the underlying.
How do margin and clearing differ?
Futures have a well-established margin and clearing framework: traders post initial margin, exchange-traded futures pass through a clearing house, and accounts are adjusted to current market value. These adjustments make futures account balances responsive to price changes rather than leaving all gains and losses until contract expiration.

Event contracts do not have one universal collateral model. Their margin or collateral terms are contract- and venue-specific, so review the applicable rules rather than assuming they work like futures.

What rules apply in the United States?
Oversight depends on the contract, venue, and jurisdiction. CFTC materials discuss event contracts offered on CFTC-regulated exchanges and designated contract market registration; they do not establish that every event market everywhere has identical oversight. Commodity futures generally trade on regulated U.S. exchanges, subject to exceptions and relevant registration rules.

The CFTC’s April 2026 fact sheet advises readers to review exchange rulebooks and contract terms. A March 2026 proposed-rule document discusses designated contract market registration for public swaps or futures. A proposal is not a final rule, so it should not be read as settled law. For a specific product, check current rules and the law applicable to its venue and jurisdiction.
