Esse valor não era um piso universal para todos os motoboys do estado: outra convenção, firmada com o setor farmacêutico, estabelecia valores diferentes. As regras dependiam do empregador, da atividade, da função, do município e do período de vigência.
Qual era o piso previsto na convenção SINDIMOTO–SINDICARGA?
A Convenção Coletiva de Trabalho 2022/2023 entre o Sindicato dos Empregados Motociclistas do Estado do RJ (SINDIMOTO) e o sindicato patronal de transporte rodoviário de cargas e logística do Rio de Janeiro (SINDICARGA) fixou piso mensal de R$ 1.270 a partir de 1º de junho de 2022. A cláusula terceira também previu reajuste de 6,53% sobre os salários de novembro de 2021, sujeito ao piso mínimo ali estabelecido. O instrumento foi identificado como solicitação MR033486/2022, transmitida em 5 de julho de 2022. Consulte a convenção SINDIMOTO–SINDICARGA.
O piso se referia aos motociclistas e às funções descritas na cláusula, que incluem entregas de documentos, mercadorias, alimentos e remédios, além de atividades como mecânico socorrista, vendedor e instalador de produtos eletrônicos. A cláusula também estabeleceu adicional de periculosidade de 30% para empregados motociclistas, pago com o salário-base, nos termos da própria convenção.
Vigência e municípios cobertos
A convenção vigorou de 1º de junho de 2022 a 31 de maio de 2023, com data-base em 1º de junho. Sua abrangência territorial incluiu Araruama, Armação dos Búzios, Arraial do Cabo, Belford Roxo, Cabo Frio, Casimiro de Abreu, Duque de Caxias, Guapimirim, Iguaba Grande, Itaboraí, Itaguaí, Japeri, Magé, Maricá, Mesquita, Nilópolis, Niterói, Nova Iguaçu, Paracambi, Petrópolis, Queimados, Rio Bonito, Rio de Janeiro, São Gonçalo, São João de Meriti, São Pedro da Aldeia, Saquarema, Seropédica, Silva Jardim, Tanguá e Teresópolis. A presença do município na lista, por si só, não resolve todos os aspectos de enquadramento: também é preciso considerar a categoria econômica do empregador e a função abrangida.

Por que havia outro piso para motoboys no RJ?
O termo “RJ” não identifica sozinho qual convenção se aplica. No mesmo período, o SINDMOTO firmou instrumento separado com o SINCOFARMA, voltado à categoria econômica farmacêutica e com abrangência declarada no município do Rio de Janeiro. Essa convenção vigorou de 1º de julho de 2022 a 30 de junho de 2023 e estabeleceu dois valores mensais:

Os valores da tabela são pisos nominais previstos nos respectivos instrumentos coletivos, não médias salariais. Não se deve somar, combinar ou escolher entre eles apenas pelo cargo de motoboy: a convenção aplicável depende do enquadramento do empregador, da atividade econômica, da base territorial e das condições previstas para a função. O que a convenção principal dizia sobre moto própria e despesas?
A cláusula quinta tratava da locação ou manutenção para quem trabalhava com motocicleta própria. Previa R$ 700 mensais e relacionava esse valor também ao custeio de equipamentos de segurança, citando capacete, luvas, jaqueta, ferragens do baú e botas. Para contratação no regime especial por hora, mediante previsão expressa em acordo coletivo, o instrumento admitia a possibilidade de R$ 350 mensais, respeitadas a proporcionalidade e a natureza de reembolso. A convenção dizia que o valor de locação ou manutenção não integrava o salário.
O texto também continha regras sobre combustível, reembolso de pedágios, compensação adicional e tíquete em determinadas viagens longas, além de prever o fornecimento de colete refletivo, que deveria ser usado pelo empregado em trânsito.

Regime especial por hora
A convenção permitia contratação por hora de motociclistas e ciclistas, com pagamento proporcional às horas efetivamente trabalhadas. Previa mínimo de 22 horas semanais e repouso semanal remunerado proporcional de 1/6. A aplicação dessa modalidade deve ser lida junto às condições do instrumento e, no caso do reembolso reduzido para moto própria, à exigência de previsão expressa em acordo coletivo.
Os valores de 2022/2023 ainda valem?
Não como valores atuais: eram regras de instrumentos com vigência encerrada. Como referência posterior, a convenção SINDMOTO–SINCOFARMA 2023/2024 estabeleceu piso mensal mínimo de R$ 1.535 a partir de 1º de julho de 2023. Esse dado não atualiza automaticamente a convenção SINDIMOTO–SINDICARGA nem determina o piso aplicável em 2026 a um trabalhador específico. Consulte a convenção SINDMOTO–SINCOFARMA 2023/2024.

Como descobrir qual convenção se aplica ao trabalhador
- Identifique o empregador e sua atividade econômica. O instrumento do setor de transporte e logística e o instrumento do setor farmacêutico são convenções distintas.
- Confira o município e a base territorial. Compare o local de trabalho com a abrangência escrita na convenção, sem presumir que todo o estado esteja coberto da mesma forma.
- Verifique função e vínculo. Leia a cláusula de abrangência profissional e as regras específicas para a atividade e modalidade de contratação.
- Use o instrumento vigente para as datas do vínculo. Para um período histórico, consulte a convenção daquele período; para situação atual, procure a convenção ou acordo coletivo atual aplicável ao empregador.
As convenções citadas identificam categorias, períodos e regras, mas não determinam o enquadramento jurídico de cada caso.
