The Pineda formula calculates a wage-distortion adjustment by dividing the old minimum wage by the employee’s wage, then multiplying that ratio by the mandated wage increase. For example, using the inputs in a 2026 SweldoPH guide—an old minimum wage of ₱610, an employee wage of ₱700, and a mandated increase of ₱50—the adjustment is ₱43.57. That is a calculation example, not a current wage rate or proof that an employee is legally entitled to the amount.
How to calculate a Pineda wage-distortion adjustment
The formula is:
Wage-distortion adjustment = (old minimum wage ÷ employee wage) × mandated wage increase
Use the old minimum wage that applied before the wage order, the employee’s comparable wage before the increase, and the mandated increase. Keep the amounts on the same basis—for example, daily figures with daily figures—and confirm the applicable regional wage order and effective period. The SweldoPH guide’s worked example is:
- Divide the old minimum wage by the employee wage: ₱610 ÷ ₱700 = 0.8714.
- Multiply that ratio by the mandated increase: 0.8714 × ₱50 = ₱43.57.
- Add the calculated adjustment to the employee’s current wage in the example: ₱700 + ₱43.57 = ₱743.57.
The ₱610, ₱700, and ₱50 amounts are illustrative inputs from SweldoPH’s 2026 example. They should not be treated as rates currently in force in any Philippine region.

What the formula does—and does not—establish
Pineda allocates a smaller adjustment as an employee’s wage rises relative to the former minimum. It produces an arithmetic result for the inputs selected; by itself, it does not establish that a legally actionable wage distortion exists, determine which employees are covered, or settle which formula should govern a workplace.
In its summary of Prubankers Association v. Prudential Bank, SweldoPH identifies four considerations associated with wage distortion: an existing hierarchy of positions with corresponding rates; a significant change or elimination of pay distinctions because of a mandated increase; employees in the same region; and similar positions or ranks in the same establishment. This is a summary of the decision, not an independent legal analysis. The applicable wage order, current law, employee circumstances, and any collective bargaining agreement (CBA) should be checked before drawing a conclusion about a particular claim.

How Pineda compares with other suggested formulas
Several approaches appear in the formula references discussed by SweldoPH and Chan Robles. They distribute an increase differently; the names alone do not show which one applies to a particular employer or dispute.

When comparing approaches, focus on how each changes the adjustment as pay rises above the former minimum, whether it is intended to preserve proportional or peso differences, how it treats creditable increases and pay groups, and whether it fits a CBA, negotiated resolution, or applicable dispute process. The cited secondary references describe multiple methods and do not establish one formula as universally controlling.

What happens when a wage increase compresses pay distinctions
The Article 124 framework, as summarized by the Chan Robles legal FAQ, calls for the employer and union in an organized firm to negotiate when a government-prescribed wage increase distorts the establishment’s wage structure. The framework reproduced there says organized firms use the CBA’s grievance procedures and, if unresolved, voluntary arbitration.
For an unorganized firm, the same secondary-source summaries describe an effort between employer and workers, followed by conciliation through the National Conciliation and Mediation Board (NCMB) if needed, and compulsory arbitration through the National Labor Relations Commission (NLRC) if the dispute remains unresolved. These are secondary summaries; confirm the current Article 124 text, applicable regional wage order, official guidance, and any CBA before relying on a process description for a live dispute.

Before using a result for payroll or a claim
- Identify the wage order, region, covered employee category, and effective date that apply.
- Confirm the pre-increase minimum, the employee’s comparable pre-increase wage, and the mandated increase; use a consistent time and pay basis.
- Check the CBA or other applicable agreement for a chosen adjustment method, definitions, and dispute steps.
- Assess whether the facts meet the legal criteria for distortion separately from the formula arithmetic.
- Seek current authoritative guidance or legal advice when deciding entitlement, payroll treatment, or how to pursue a dispute.
