A partial disposition can let a U.S. taxpayer treat a retired portion of a larger MACRS asset—such as a building component—as disposed of for federal tax purposes. Many partial dispositions are elective, but some transactions require the treatment. When the election applies, report the disposition on a timely filed return, including extensions, for the year it occurs, using the applicable part of Form 4797 and identifying the asset with the words “Partial Disposition Election.” The tax result depends on the asset, transaction, basis, and depreciation records; replacing a component does not automatically establish a deduction.
What counts as a partial disposition?
MACRS property includes buildings and their structural components, as well as other tangible depreciable property used in a trade or business or held for the production of income. A partial disposition occurs when a portion of a larger MACRS asset is disposed of and is treated as disposed of for tax purposes. The rules do not mean every repair, replacement, or retirement automatically produces a deductible loss.
For a building, the IRS lists examples of structural components such as walls, partitions, floors, ceilings, permanent coverings, windows, doors, central heating and air-conditioning components, plumbing fixtures, electrical wiring and lighting, chimneys, stairs, elevators, sprinklers, and fire escapes. These are examples rather than a complete classification rule. Whether a particular item is a component of a building or a separate asset depends on the applicable rules and facts.
When is partial-disposition treatment elective or required?
Ordinary retirement or replacement
Many partial dispositions are elective. For example, when a depreciable building component is retired during replacement work, the taxpayer may be able to elect to recognize the disposition of that component. Do not assume that a roof, HVAC system, elevator, or other item qualifies solely because it was replaced; first establish the asset classification and the facts of its retirement.

Transactions that can require the treatment
The IRS instructions identify a sale of a portion of a MACRS asset and certain involuntary conversions as required partial dispositions. Regulatory materials also address casualty losses under section 165, certain nonrecognition transfers under sections 1031 or 1033, and specified transfers in which the transferee steps into the transferor’s shoes. The exact requirement depends on the transaction and applicable rules; a routine retirement should not be described as mandatory unless it falls within a required category.
General asset accounts and accounting-method rules
General-asset-account treatment and accounting-method rules can change how the ordinary partial-disposition description applies. Check the relevant regulations and the asset’s tax records before treating a component retirement as a standard election. The Form 4797 instructions discuss circumstances and rules beyond a simple elective retirement.

How do you report an elective partial disposition?
- Confirm the applicable tax year and transaction. Determine that the property is MACRS property, identify what portion was disposed of, and establish whether the event is elective or falls into a required category.
- Determine the amount and character from the records. Review the disposed portion’s unadjusted basis, depreciation allowed or allowable, the larger asset’s depreciation method and convention, and the date and nature of the disposition. The facts determine the amount and whether Form 4797 Part I, II, or III applies.
- Report it for the disposition year. Under the IRS Instructions for Form 4797 (2025), report any gain, loss, or other deduction on a timely filed federal return, including extensions, for the year of disposition. Use the applicable part of Form 4797.
- Identify the election in the asset description. For an elective disposition, include “Partial Disposition Election” in the description of the disposed asset, as the Form 4797 instructions direct.
- Keep the supporting records. Retain documentation identifying the larger asset and disposed portion, basis and depreciation history, and the retirement or disposition event so the reported treatment and amount can be substantiated.
The IRS practice unit says, “No specific form or election statement is required to be attached to the return.” That does not remove the Form 4797 instruction to identify an elective disposition in the asset description. The two points distinguish a separate attached election statement from the return’s asset-description wording.
How should you think about basis and the amount reported?
There is no universal deduction amount for a retired component. A defensible computation requires an allocation of basis to the disposed portion and its depreciation allowed or allowable, considered with the larger asset’s depreciation method, convention, and disposition date. The transaction also affects the applicable Form 4797 part and the character of any reported item. The cited IRS materials do not provide enough facts to calculate a particular taxpayer’s result.

Preserve the original asset detail and the basis-allocation method, not just invoices for replacement work. Keep depreciation schedules and records showing what was removed, when it ceased to be used or was otherwise disposed of, and how the reported amount was derived.
Does writing off the old component determine the tax treatment of new work?
No. The disposition of the old component and the capitalization or deduction of replacement or restoration costs are related but separate analyses. IRS revenue-procedure material on disposition method changes notes that such changes may affect whether restoration costs must be capitalized under the tangible-property regulations. Do not assume that recognizing a disposition settles how the new roof, equipment, or other work is treated.

Which tax-year and jurisdiction rules apply?
This article addresses U.S. federal income tax. The Form 4797 instructions linked above are for tax year 2025; use the instructions and rules applicable to the return year being filed, since forms and guidance can change. The IRS final-regulation material published in 2014 is historical rulemaking context and should be read alongside the current codified regulation. The 2023 revenue procedure is relevant to accounting-method context. No conclusion about state income tax follows from these federal rules.
