In general, a parent’s cash gift for a home down payment is not taxable income to the child. The donor may have a federal gift-tax reporting requirement if gifts to one person exceed the 2026 annual exclusion of $19,000, but crossing that figure does not automatically mean gift tax is due. Separately, the mortgage lender may verify that the funds are a genuine gift from an eligible donor and that repayment is not expected.

Is the money tax-free?

For federal income-tax purposes, a recipient generally does not report a genuine gift as income merely because a parent transfers down-payment money. The IRS says making or receiving a gift ordinarily does not affect federal income tax. Gift tax is a separate system that generally concerns the donor, not the recipient. IRS gift-tax FAQ

The IRS defines a gift generally as a transfer to an individual without receiving full consideration in return. Calling money a gift does not settle its treatment if it is actually a loan, payment for services, or another kind of transaction.

What the $19,000 figure means in 2026

The federal gift-tax annual exclusion is $19,000 per recipient for calendar year 2026, according to the IRS. It is used in determining taxable gifts; it is not a cap on how much a parent may give, and it does not mean every dollar above $19,000 is immediately taxed. IRS gift-tax FAQ

If one parent gives one child more than the annual exclusion in 2026, the excess may mean the parent needs to file a gift-tax return, Form 709. Whether any gift tax is ultimately due depends on the donor’s broader circumstances and applicable exclusions. A filing requirement and a tax bill are not the same thing. The donor should check the IRS’s current guidance or consult a tax professional about their own situation. IRS: Gift tax

The $19,000 exclusion applies per donor and recipient. If both parents give, the tax treatment depends on the gifts and the donors’ circumstances; do not assume a lender’s gift letter or the child’s tax return resolves the donors’ reporting obligations. The IRS’s Form 709 instructions provide filing details, but the 2025 instructions should not be used to replace the IRS’s stated 2026 exclusion. IRS Instructions for Form 709

Can a down-payment gift invite lender scrutiny?

It can prompt routine underwriting verification. That does not imply wrongdoing: the lender needs to establish that the funds meet the loan program’s rules, come from an eligible donor, and are not a loan that the borrower must repay. Tax treatment and mortgage underwriting are separate checks.

For a Fannie Mae conventional loan, the Selling Guide allows eligible personal gifts for a principal residence or second home, subject to minimum borrower-contribution requirements. Gift funds may cover all or part of the down payment, closing costs, or financial reserves. They are not allowed for an investment property under this guidance. A parent generally qualifies as a relative donor under the guide. Fannie Mae Selling Guide B3-4.3-04, Personal Gifts

These are Fannie Mae conventional guidelines, not a statement that FHA, VA, USDA, Freddie Mac, every lender, or every state uses identical requirements. Ask your loan officer for the checklist that applies to your specific loan before moving the money.

What documents are needed?

For a Fannie Mae-eligible personal gift, the lender needs a donor-signed gift letter and evidence that the donor has sufficient funds or that the gift was transferred. The guide allows several ways to document the money trail, so the exact records requested can vary with how and when the funds move. Fannie Mae Selling Guide B3-4.3-04, Personal Gifts

Gift letter

The letter must state the actual or maximum gift amount, identify the donor by name and provide the donor’s address and telephone number, state the donor’s relationship to the borrower, and confirm that no repayment is expected. Both donor and borrower should coordinate with the lender on its preferred form and timing.

Evidence of funds or transfer

Fannie Mae lists examples such as a donor’s check and the borrower’s deposit slip; donor withdrawal and borrower deposit slips; evidence of an electronic transfer to the borrower or closing agent; a donor’s check made payable to the closing agent; or a settlement statement showing receipt of the gift. These are examples, not a requirement that every borrower submit every item.

If the funds have not reached the borrower before settlement, the lender documents that the donor provided them to the closing agent by electronic transfer, certified check, cashier’s check, or another official check. Your lender may request additional records to meet its own process or applicable loan requirements; the guide does not prescribe a fixed number of bank statements for every case.

How the tax and mortgage questions differ

Question Federal gift-tax treatment Mortgage underwriting
Who is primarily responsible? Generally the donor, for any required gift-tax reporting and any gift tax. The borrower and lender must meet the loan program’s eligibility and documentation rules.
What is checked? The gift amount, annual exclusion, other gifts, and the donor’s overall tax position. Whether the donor and gift qualify, repayment is not expected, and the funds or transfer are documented.
Does exceeding $19,000 automatically mean tax is due? No. The 2026 exclusion is not an automatic tax-bill threshold. The tax exclusion does not determine mortgage eligibility; contribution and documentation rules apply instead.
What records may matter? Form 709 and related tax records if a return is required. A gift letter and records tracing donor funds or their transfer to the borrower or closing agent.

What to do before your parent transfers the money

  1. Ask your loan officer which program rules apply. Confirm the donor is eligible, whether borrower-contribution rules apply, and which transfer methods and records the lender accepts.
  2. Get the lender’s gift-letter requirements. Make sure the letter states the amount, donor’s contact details and relationship, and that repayment is not expected.
  3. Agree on the transfer route and timing. Coordinate whether funds should go to you or directly to the closing agent, and retain the relevant check, deposit, withdrawal, or transfer records.
  4. Have the donor consider tax reporting separately. If the donor’s gifts to you exceed the 2026 annual exclusion, they should determine whether Form 709 is required and whether any tax is due based on their circumstances.
