The right correction depends on the store’s policy and, in some cases, state or local law.
What to do when a price looks wrong
Before you pay
- Watch the checkout display. Pay particular attention to sale items, multi-item promotions, and higher-priced purchases. A promotion may not appear automatically at the register and could require a manual adjustment.
- Compare the amount with the offer. Check the shelf tag, posted sign, store flyer, or mailer. Keep the flyer handy or make a note or photo of the displayed offer when useful.
- Ask the cashier to check it. Say that the scanned price is higher than the posted or advertised price, and ask the cashier to verify the offer and apply any appropriate adjustment before you pay. You can also ask what the store’s pricing-error policy is.
After you pay
- Review the itemized receipt. Check the item description, quantity, and price, not just the total.
- Contact the store if you find an error later. Bring the receipt and identify the item and lower displayed or advertised price. Ask customer service or a manager to review the charge; correcting a price may still be possible after checkout, though it can take more effort.
- Keep a clear record. Note the store, date, item, amount charged, displayed or advertised amount, and any response from the store. Save the receipt and relevant flyer or photo.
Why shelf and checkout prices can differ
Price scanning depends on store computer records and the signs or tags shoppers see matching one another. The Federal Trade Commission’s 1998 Price Check II report described errors arising when computer prices were not updated correctly or when shelf tags and sale signs were not changed to match updated computer or advertised prices. A mismatch does not by itself establish why the price differed or what remedy applies.
The FTC report quoted the expectation that “Consumers expect and demand accurate pricing.” The statement appears in the 1998 report; it is not a measure of current error rates.
What historical scanner studies do—and do not—show
The FTC and state partners’ 1996 study reported average scanner error rates of 3.47 percent in food stores and 9.15 percent in department stores. Those are findings from that study, not estimates of present-day national checkout accuracy. The FTC’s 1998 report documented inspections of 1,033 retail stores in 36 states and the U.S. Virgin Islands by the FTC, participating state and local officials, and NIST. The inspected locations were not chosen through a statistically designed survey, so those results cannot be projected to the country as a whole. No current national scanner-overcharge rate is established by these cited studies.

When a price adjustment is a matter of state or local law
There is no single nationwide automatic entitlement to a free item, a multiple of an overcharge, or a fixed bonus for every shelf-price mismatch. Requirements and remedies vary by jurisdiction and may depend on the item category and the circumstances. Check current official guidance for the state or locality involved before relying on a deadline or a specific payment amount.
Michigan: a specific notice process and remedy
Michigan’s Attorney General describes a state scanner law with particular conditions: the shopper must complete the transaction and have a receipt identifying the item and amount charged, then notify the seller within 30 days. The seller may, within two days after notice, refund the difference plus ten times the difference, subject to a $1 minimum and $5 maximum. If the seller does not make that payment, the Attorney General’s page describes a possible lawsuit for actual damages or $250, whichever is greater, plus reasonable attorney fees up to $300, with a small-claims option. These are Michigan-specific rules, not general U.S. remedies.

Massachusetts: a grocery-price provision
Massachusetts General Laws, Chapter 94, Section 184B, says that when a grocery item has a discrepancy among its advertised, sticker, scanner, or display price and the checkout price, the food store or food department must charge the consumer the lowest price. This provision concerns grocery items; it should not be read as a rule for every retail product or every state.
Report repeated pricing problems
If a discrepancy appears to be part of a pattern, raise it with store management or headquarters and consider contacting the relevant state or local consumer-protection or weights-and-measures office. The FTC says consumer reports can help its monitoring work, but it usually does not intervene in individual cases. What an agency can do—and what a shopper can obtain as an individual remedy—depends on the issue and jurisdiction.

A late-added mandatory fee is a different issue
An item scanning above a shelf price is a price mismatch. A mandatory fee added late in an online or in-person transaction is a total-price disclosure question, not simply a scanner error.
In its May 2025 FAQ on the Rule on Unfair or Deceptive Fees, the FTC says covered businesses generally must include mandatory fees in the total price. The FAQ identifies exceptions including government charges, shipping charges, and fees for optional ancillary goods or services; excluded charges must be disclosed before payment and included in the final amount when applicable. It says handling charges are not shipping charges. A charge may be optional when a viable no-fee payment method is available, while a required fee may need to be included in the total price. Dynamic pricing is allowed if pricing information is not misleading. This is federal rule guidance, not a complete account of all federal, state, and local pricing requirements or a determination about a particular transaction.
