Usually, Ohio utility customers are not automatically entitled to reimbursement for spoiled food or an outage credit. But that does not rule out a fact-specific claim based on utility negligence or another legal ground. Start with the utility, document the loss and its cause, and use the Public Utilities Commission of Ohio (PUCO) for unresolved regulated-service complaints. PUCO can review utility matters, but it cannot award private damages.
What Ohio law does—and does not—guarantee
The Ohio Consumers’ Counsel (OCC) says there is no general legal requirement for an electric utility to compensate customers for food spoiled in an outage, and customers generally are not entitled to service credits for interruptions. “Generally” is important: the absence of an automatic payment does not decide whether a particular customer has a claim under specific facts. Ohio Administrative Code Rule 4901:1-10-02(E) bars an electric utility tariff from using an exculpatory clause that purports to limit or eliminate the utility’s liability for its own negligence in providing regulated service. That rule does not establish that a utility was negligent in a particular outage, or that a customer will recover a claimed amount. The facts, applicable law and the serving utility’s tariff matter. Check the current claim procedure and tariff terms for your own utility. For example, AES Ohio’s damage-claims page describes that company’s process and conditions; it should not be treated as the rule for other utilities.

The Ohio Supreme Court has explained that PUCO cannot judicially determine private legal rights and liabilities or award damages. It distinguishes PUCO’s regulatory role from contract and common-law tort matters that may be brought in common pleas court. How to document a loss before you file
No single statewide checklist for outage-loss evidence is established in the sources cited here. These practical records can help show what happened, what was lost and how the utility responded; they are not statutory prerequisites.

- Capture the outage timeline. Note your service address, account details, when the outage began and service returned, and how you confirmed those times. Save outage alerts, texts, emails, status-page captures and any incident number.
- Itemize the loss. List affected items, quantities, approximate purchase dates and reasonable values. Keep receipts, order histories, repair estimates, invoices or other available proof.
- Record visible damage safely. Take dated photos or video before discarding damaged property, when safe and practical. For food, note what you discarded and when; do not eat food if its safety is uncertain.
- Keep a complete claim file. Save the claim, submission confirmation, utility acknowledgment, information requests, denial and follow-ups. Record call dates and names, and ask for a written explanation if the claim is denied.
- Explain both the loss and the alleged cause. State the amount you are claiming separately from why you believe the utility’s conduct or service caused it, and attach records that support each point.
Follow the current process and any deadlines given by your utility. Procedures and tariff terms can differ by company.
How to dispute a denial or unresolved complaint
- Submit the issue to the utility. Use the serving utility’s official damage-claim or customer-complaint route. Identify the outage dates, describe and itemize the loss, explain the requested resolution, and keep a copy plus proof of submission. Customers outside AES Ohio’s service area should use their own utility’s process.
- Request an investigation and written response. Ohio’s electric utility complaint rule requires good-faith efforts to settle unresolved disputes. Generally, a utility must investigate a complaint and provide a status report within three business days after receiving it. Exceptions apply where a commission order or staff direction governs, including certain disconnection or emergency cases. Ohio Administrative Code Chapter 4901:1-10
- Contact PUCO if informal efforts fail. The consumer hotline is 800-686-7826. The Ohio Attorney General says PUCO staff may assist with a formal complaint under Ohio Revised Code § 4905.26 if an inquiry cannot be resolved informally. - Consider separate legal advice for a damages dispute. A PUCO complaint is a regulatory route, not a court judgment for compensation. If the loss is substantial or the dispute turns on negligence, a lawyer can assess whether a private legal claim is appropriate.
Restoration priorities and households with medical needs
Ohio requires electric utilities to maintain emergency plans for outage response and restoration. During an emergency or disaster, hospitals that are utility customers receive restoration priority. That planning requirement does not create a compensation right for a residential customer whose interruption lasts longer. Ohio Administrative Code Rule 4901:1-10-08

Restoration priority is typically not assigned simply because an older adult or young child lives at an address. Customers dependent on electrically powered medical equipment should arrange backup options and ask their utility about its critical-customer process. The OCC says utilities are required by law to maintain and update critical-customer lists annually; being listed should not be treated as a promise of a particular restoration time.
