No Taxes on Tips, Overtime and Social Security? Not Exactly

“No tax” on tips or overtime means a limited federal income-tax deduction for eligible workers—not an end to payroll taxes or Social Security benefit taxation.

For tax year 2025, “no tax on tips” and “no tax on overtime” refer to limited federal income-tax deductions—not blanket tax exemptions. Qualified workers may deduct eligible tips or overtime pay within annual caps and income limits. Overtime generally remains subject to Social Security and Medicare payroll taxes, and Social Security benefits can still be federally taxable under existing rules.

What the “no tax” provisions actually do

The tips and overtime provisions let eligible taxpayers deduct certain income when calculating federal income tax. A deduction can lower taxable income; it does not erase the income or automatically remove every tax on it. The deductions apply for tax years 2025 through 2028 and are claimed on Schedule 1-A with Form 1040. The federal rules described here do not establish how any particular state treats the income.

For most claimants, both deductions begin to phase out when modified adjusted gross income (MAGI) exceeds $150,000, or $300,000 for a joint return. They have separate eligibility tests and limits:

The limits and phaseouts are reported in IRS guidance for people who received tips or overtime during 2025 and the IRS’s overview of the overtime deduction. These figures are deduction limits, not estimates of tax savings.

When tips qualify for the deduction

Qualified tips are voluntary cash or charged tips received from customers, including tips shared with other workers. The worker generally must be in an occupation that customarily and regularly received tips on or before December 31, 2024. IRS examples include wait staff, bartenders, salon workers, personal trainers and gig-economy workers. A job involving tips does not by itself establish eligibility: the occupation, nature and reporting of the tips, income limit and filing requirements all matter. The maximum qualified-tips deduction is $25,000 per year, subject to the MAGI phaseout. For a self-employed person, the deduction cannot exceed net income, before this deduction, from the trade or business in which the tips were earned.

Which overtime pay qualifies

Not every payment labeled “overtime” qualifies. The deduction covers overtime compensation required under section 7 of the FLSA, and only the amount above the worker’s regular rate. For example, when a covered employee is paid time-and-a-half, the extra “half” portion—not the entire time-and-a-half payment—is generally the qualified amount. Whether particular hours or pay qualify depends on the FLSA rules and the worker’s circumstances. The IRS explains the definition and eligibility in its overtime deduction questions and answers.

The deduction is capped at $12,500 per return, or $25,000 for a joint return, and phases out above the applicable MAGI threshold. Crucially, the income-tax deduction does not generally exempt overtime wages from payroll taxes. The IRS states that overtime compensation is still generally subject to both the employer and employee shares of Social Security and Medicare tax in its 2025 Instructions for Schedule H.

Social Security benefits can still be taxable

The tips and overtime deductions did not repeal the federal rules for taxing Social Security benefits. Depending on a person’s combined income, up to 85% of benefits may be included in taxable income. The Social Security Administration identifies combined-income thresholds of $25,000 for an individual filer and $32,000 for a joint return. Combined income means adjusted gross income, tax-exempt interest and half of annual Social Security benefits. People married filing separately may also owe tax, depending on their circumstances. The separate deduction for eligible older taxpayers

For tax years 2025 through 2028, an eligible taxpayer age 65 or older may qualify for an additional deduction of up to $6,000. It can reduce taxable income and therefore may lower the federal tax some beneficiaries owe, but it does not change the underlying rules that determine how much of a Social Security benefit may be taxable. The IRS summarizes the senior deduction in Publication 17 (2025); the SSA’s 2026 actuarial discussion of law and policy changes describes a reduction in taxable income, not repeal of benefit taxation.

How to claim the 2025 deductions

  1. Check the eligibility rules. Confirm that your tips or overtime meet the relevant definition, that you meet the income limits and filing requirements, and that you have a valid Social Security number. Married taxpayers generally must file jointly to claim the tips or overtime deduction.
  2. Use Schedule 1-A with Form 1040. Eligible taxpayers may claim the deductions whether they itemize or take the standard deduction. Consult the current form and instructions for the entries and rules that apply to your filing status. The IRS announced the schedule in its Schedule 1-A guidance.
  3. Gather records supporting the amount. For 2025, employer information returns were not changed to separately identify qualified tips or overtime, and employers were not required to report the qualified overtime amount separately. Payroll statements and other substantiating records may help determine what qualifies. Keep relevant tip logs, pay statements and supporting records; the IRS describes documentation options in its 2025 guidance and Internal Revenue Bulletin 2025-50.

State income-tax treatment is a separate question. The federal sources cited here do not establish whether a state follows these deductions or what its filing requirements are. People with multiple jobs, self-employment income, uncertain FLSA coverage, or a married-filing-separately situation should check the applicable IRS instructions or consult a qualified tax professional.
