What New York alleges about Valve’s loot boxes
The People of the State of New York, acting through Attorney General Letitia James, filed the case against Valve Corporation in the Supreme Court of the State of New York, New York County. The complaint was filed February 25, 2026, under Index No. 450952/2026. The Attorney General’s announcement identifies three games: Counter-Strike 2, Team Fortress 2 and Dota 2. The complaint describes loot boxes as virtual containers that award randomly selected items, sometimes opened after a player pays for a key or opening.
The State’s theory is that players stake money on a chance-based outcome and may receive transferable or sellable items with monetary value. It argues that this combination makes the paid feature gambling under New York law. That is the State’s allegation, not a finding that the games or Valve violated the law.
What laws the complaint invokes—and what New York wants
The complaint invokes Article I, Section 9 of the New York Constitution and Penal Law §§ 225.05 and 225.10. It uses Executive Law § 63(12) as the enforcement vehicle. The state’s legal question is whether the mechanics it describes satisfy New York’s gambling prohibitions; the court would have to decide that question.

New York asks the court for an injunction, an accounting, restitution or disgorgement, fines where applicable, costs and other relief. These are remedies requested in the complaint, not penalties or changes a court has ordered. The filing sets out the State’s claims and requests.
How Valve responds to the gambling allegation
In a public response reported in March 2026, Valve rejected the State’s view that its containers constitute gambling under New York law. Valve compared mystery boxes with physical collectibles such as baseball cards and argued that the virtual items are cosmetic. These are Valve’s arguments as reported by PC Gamer; they do not resolve the legal dispute.

The central disagreement is not simply whether an item is digital or cosmetic. New York emphasizes payment, chance and the alleged monetary value of some outcomes; Valve disputes that this makes its system gambling under state law. A court ruling would be needed to decide the legal claim.
What the figures in New York’s announcement mean
The Attorney General’s February 25, 2026 press release says it was reported in March 2025 that the Counter-Strike skin market had surpassed $4.3 billion. That is a reported market estimate repeated in the release, not a valuation established by the court. The release also says a skin reportedly sold for more than $1 million in June 2024; it presents that transaction as reported, not as a judicial finding. Both figures appear in the Attorney General’s announcement.

The same release says research has shown that children introduced to gambling are four times more likely to develop a gambling problem later in life. The passage does not identify the underlying study, so this should be understood as a claim made in the Attorney General’s release, not an independently verified statistic in this account.

The available sources establish that New York filed the complaint and that Valve publicly disputed the State’s characterization. They do not establish a final court decision. A secondary case tracker labels the action active, but a current primary docket entry was not independently confirmed. For that reason, the case’s present procedural status should not be inferred from the filing date or the tracker alone.
