New York’s attorney general sued Valve on February 25, 2026, alleging that paid randomized loot boxes in Counter-Strike 2, Team Fortress 2 and Dota 2 constitute illegal gambling under state law. What New York alleges about Valve’s loot boxes
The People of the State of New York, acting through Attorney General Letitia James, filed the case in New York County. The complaint invokes New York Executive Law § 63(12) and alleges violations connected to the state’s gambling laws. It discusses loot-box features in Counter-Strike, Team Fortress and Dota, including Counter-Strike 2, Team Fortress 2 and Dota 2.
New York’s theory centers on paying for a chance to receive a randomized virtual item. The State alleges that some rare cosmetic items have monetary value and can be exchanged for money, even though they do not change gameplay. The New York State Office of the Attorney General said one virtual item was “reportedly” sold for more than $1 million; that is the office’s qualified account, not an independently verified sale or price.
Attorney General James described the State’s position in the office’s 2026 press release: “Illegal gambling can be harmful and lead to serious addiction problems, especially for our young people,” she said. “Valve has made billions of dollars by letting children and adults alike illegally gamble for the chance to win valuable virtual prizes. These features are addictive, harmful, and illegal, and my office is suing to stop Valve’s illegal conduct and protect New Yorkers.” Those are the plaintiff’s assertions, not findings by a judge.

How Valve contests the gambling claim
In a May 18, 2026 memorandum supporting its request to dismiss the case, Valve argues that each mystery-box purchase gives the buyer an item, so the transaction involves neither a stake nor a risk of receiving nothing. Valve also argues that the items do not qualify as “something of value” under the relevant law. Its memorandum compares digital mystery boxes with baseball-card packs and other collectibles, and says the items are aesthetic rather than gameplay-affecting.
The disagreement is about how the law applies to the transactions and items—not a settled decision that the loot boxes are legal or illegal. The complaint presents New York’s allegations; Valve’s memorandum presents the company’s advocacy. Neither is a court ruling.

What the lawsuit asks the court to do
New York’s complaint seeks a permanent injunction and monetary relief, including an accounting, restitution, disgorgement and fines. These are requests in the pleading. The available information does not show that any of them has been granted or awarded.
What the case means for players and spending
The filing itself does not establish that players are entitled to refunds, that Valve must immediately change or remove game features, or that a court has found the games’ loot boxes unlawful. Those outcomes would require further legal developments; the complaint’s requests are not orders.

For a player deciding whether to spend, the practical distinction is that buying a randomized box is not the same as buying a known item: the item received may differ from the one a buyer hoped for. The lawsuit raises a legal question about that paid chance and the claimed value of the resulting items. It does not, on the available information, establish what any individual player could recover or whether any game feature will change.
