New Data Shows How NYC’s Minimum-Pay Law Has Affected Delivery Drivers and Orders

NYC delivery apps reported higher worker pay and more completed deliveries in Q2 2025 than before the minimum-pay rule, while per-delivery fees increased and reported worker counts declined.

New York City’s app-reported data shows delivery workers earning more and completing more deliveries after the city began enforcing its minimum-pay rule. Per-delivery fees also rose, while tips and the number of app-reported workers moved differently. The figures compare periods before and after enforcement; they do not prove the law alone caused those changes.

What changed in pay and deliveries?

The latest explicit before-and-after comparison in the NYC Department of Consumer and Worker Protection’s December 26, 2025 final-rule statement is between Q3 2023—the last full quarter before minimum-pay payments began—and Q2 2025. The underlying app-submitted data was last updated in September 2025.

All figures and reported percentage changes in the table are from the NYC Department of Consumer and Worker Protection’s Q3 2023-to-Q2 2025 comparison, published in its December 26, 2025 final-rule statement. The $24.03 figure includes tips; the $21.04 pay figure is the pay component. The agency reports fee increases per delivery, not a complete change in the final price of a typical order.

Did customers place fewer orders?

Not in the delivery-volume comparison above: completed deliveries per week were higher in Q2 2025 than in Q3 2023. A separate year-over-year snapshot in DCWP’s Q4 2024 report found 2.72 million completed deliveries per week, 2% more than in Q4 2023. These are counts of completed deliveries, not a measure of unique customers, order value, or demand across every NYC restaurant and delivery service.

The Q4 2024 report covered DoorDash, Fantuan, Grubhub, HungryPanda, and Uber Eats. DCWP notes that covered apps’ submissions can include non-restaurant deliveries and are not adjusted to account for workers using multiple apps.

What did workers receive—and what happened to tips?

The law’s minimum-pay measure is distinct from total earnings: tips are additional to pay. In the Q4 2024 year-over-year comparison, DCWP reported average total earnings of $22.28 per hour, 84% above Q4 2023. Average pay was $19.78 per hour, up 166%, while tips averaged $2.50 per hour, down 47%. Average tips per delivery were $0.99, 70% lower year over year.

DCWP said some apps changed their interfaces in ways that discouraged tipping. The reported tip decline therefore should not be read simply as evidence that customers became less generous; the app’s tipping design can also affect what workers receive.

Why did app-reported worker counts fall?

DCWP counted 71,404 workers making at least one trip per week in Q2 2025, compared with 75,865 in Q3 2023. That is a count of app-reported workers, not necessarily distinct people: a worker who delivers through more than one platform may appear in multiple app submissions. The agency says reduced multi-apping could explain part of the decline, so the figures do not establish that the same number of individual workers left delivery work.

On-call time also changed substantially. The Q3 2023-to-Q2 2025 comparison showed a 75% drop in weekly on-call hours. In earlier Q1 2024 data, weekly on-call hours were 39% lower year over year. DCWP’s early report said pay per hour was below the nominal minimum rate in part because some apps had excessive uncompensated on-call time during the phased implementation; protections addressing that situation took effect after the quarter covered by that report.

What does the NYC minimum-pay rule require?

DCWP began enforcing the minimum-pay rate for restaurant delivery apps on December 4, 2023. The city’s current FAQ says restaurant and grocery delivery apps must pay the minimum rate; other delivery-app categories are not all subject to the same requirement. The rule generally covers workers classified as independent contractors who deliver through a covered app, not directly employed restaurant or grocery-store workers.

The rates and coverage summary are from NYC DCWP’s current rate information and FAQ. The $22.13 rate applies to applicable pay periods beginning on or after April 1, 2026.

How apps can calculate pay

  • Standard method: The payment for an individual trip must meet the rate multiplied by that worker’s trip time. The app’s total payments must also meet the rate multiplied by the worker’s combined trip and on-call time.
  • Alternative method: Individual trip time is paid at a higher rate calculated by dividing the base rate by 60%. Use of this method is subject to a utilization-rate threshold and limited exceptions.

DCWP’s December 26, 2025 Statement of Basis and Purpose of Final Rule says: “Under both the Standard Method and Alternative Method, a food delivery service assumes financial responsibility for time that it permits workers to seek and fulfill delivery opportunities on the food delivery service’s platform, including all trip time and on-call time.”

Do the before-and-after figures prove the law caused the changes?

No. The city’s reports describe app-submitted totals across different quarters; they are not a controlled estimate of what would have happened without the rule. Other changes over that time—including platform design and shifts in how workers use multiple apps—can affect the measures. The data supports saying that reported pay and completed deliveries were higher, fees rose, and on-call hours fell in the comparison periods. It cannot isolate the law’s effect on each outcome.

For a household, the clearest practical trade-off in these reports is that higher reported worker pay coincided with higher per-delivery consumer and merchant fees. Those fee measures do not reveal the full price of a particular order: the total can also depend on the restaurant’s prices, delivery charges, service charges, promotions, and tip.
