The Netherlands expanded licensing requirements for selected advanced chipmaking equipment, with the latest identified changes taking effect on April 1, 2025. The move is not a blanket export ban: exporters must seek authorisation for covered equipment, and Dutch authorities assess applications case by case. Although the rules apply to exports from the Netherlands to destinations outside the European Union—not only China—their strategic significance is tied largely to limiting access to advanced chipmaking capabilities.
What changed in the Dutch export rules?
The Netherlands has tightened its controls in stages. The measures add national licensing requirements for defined categories of advanced semiconductor-manufacturing equipment that are not necessarily covered by the EU’s common dual-use list. The exact scope depends on technical specifications in the applicable control entries, not simply on whether a supplier markets a product as a chipmaking tool.

The control categories identified in EU-published Dutch lists include advanced lithography equipment, equipment for making EUV pellicles, certain atomic-layer-deposition tools, selected epitaxial-growth equipment, and specified measuring and inspection technologies. A technical entry may set limits for characteristics such as wavelength, resolution or overlay. For instance, the EU compilation lists specified epitaxial-growth equipment under 3B1001.a.4 and certain atomic-layer-deposition equipment for work-function metals under 3B1001.d.12. Is this an export ban?
No. The central mechanism is an export-authorisation requirement. A company exporting covered equipment from the Netherlands to a destination outside the EU must apply for permission; Dutch authorities review applications individually and may grant or refuse them. The measure is more restrictive than ordinary trade, but it does not automatically prohibit every covered shipment or every sale to a particular country. The government’s January 2025 explanation.

A licensing system can still constrain trade in practice if permission is denied, delayed or limited by customer or end use. It is also important not to confuse a licensing requirement for certain products with a ban on all semiconductor machinery: the controls are narrowly defined and not every DUV tool, ASML system or machine made in the Netherlands is necessarily covered.
Why the Netherlands matters—and why ASML is central
The Netherlands has unusual influence because it is home to ASML, the dominant supplier of advanced lithography systems. ASML makes equipment used to print tiny circuit patterns onto silicon wafers; it does not manufacture chips. Lithography is one part of a larger manufacturing process that also depends on deposition, measurement, inspection and other tools.
The most advanced extreme-ultraviolet (EUV) systems were already subject to severe export restrictions. Dutch controls have also covered certain advanced DUV systems and other specialised equipment. The 2025 addition of measurement and inspection technologies broadens the story beyond lithography alone: controlling other steps in the production chain can matter where equipment from multiple countries is combined to make advanced chips. ASML is the best-known company affected by the policy discussion, but the equipment ecosystem is broader. Other equipment makers, metrology and inspection firms, specialist suppliers, service organisations and chipmakers may also need to determine whether a particular product or transaction is covered.

Why did the Netherlands tighten controls?
The Dutch government gives national security as its rationale. It argues that advanced manufacturing equipment can be difficult to replace, that it can be combined with technologies from other countries, and that the resulting capabilities may have military applications. It also points to the pace of technical change: equipment that did not previously raise the same concerns may create new risks as capabilities advance. The January 2025 announcement.
The policy sits within a broader effort by the United States and allies to limit access to advanced semiconductor capabilities, with China the principal strategic focus. But the Netherlands has adopted its own national measures and publicly grounded them in its own security assessment; describing the action simply as an American order would miss that distinction.

What does the policy mean for China and the chip industry?
China is central to the strategic context, but the Dutch measure is formally described as applying to covered exports from the Netherlands to destinations outside the EU generally—not exclusively to China. The restrictions may reduce access to some advanced foreign tools and make it harder or more expensive to expand leading-edge production using imported equipment.
They cannot, by themselves, stop China’s semiconductor progress. Possible responses include developing domestic equipment, using older-generation tools, applying complex multi-patterning techniques, and building stocks of equipment or parts. Restrictions can raise costs, complicate production and slow particular capabilities, while also increasing the incentive to find substitutes. Their results depend on technical scope, enforcement, allied coordination and how quickly alternatives become viable.

A covered transaction cannot proceed without the required authorisation, and the need to classify equipment and screen customers may add documentation and planning work. Customers may delay purchases or consider alternative tools; equipment makers and suppliers may have to adapt sales plans or compliance processes. A company’s financial exposure depends on its product mix, destinations, licence outcomes and demand elsewhere, so the policy alone does not establish a particular firm’s likely revenue impact.

How does the Dutch measure fit with EU and other rules?
The national Dutch controls operate alongside the EU dual-use framework, including Regulation (EU) 2021/821. The European Commission has described national controls as a way for Member States to address critical technologies not yet listed across the EU, while also warning of the need for coordination so national lists do not produce incoherent or ineffective outcomes. On April 8, 2025, the EU published a recommendation on coordinating national control lists. It encourages Member States, where appropriate, to use objective technical parameters, identify controlled items clearly, and share information about proposed national controls with other Member States and the Commission. Coordination can reduce gaps that might otherwise invite diversion through another jurisdiction, but it can also make restrictions more consistent across the single market. The Netherlands’ national measure is described as applying to exports from the Netherlands to destinations outside the EU. That does not mean an intra-EU transfer is automatically free of controls: EU rules or another national regime may still apply. Nor is the Dutch measure the only rule that might govern an international transaction. Depending on the product and transaction, U.S. rules may also matter, including where U.S.-origin technology or software is involved. Destination, end user, end use, corporate structure and re-export plans can all change the compliance analysis.

What companies should check before a shipment
Equipment exporters and customers should treat classification and authorisation as transaction-specific work. A practical review should include:
- Classify the exact item. Compare its technical specifications with the current Dutch national list and applicable EU dual-use entries; a broad label such as “DUV tool” is not enough.
- Map the transaction. Confirm where the item is exported from, its destination, the consignee and end user, and the intended end use.
- Check overlapping rules. Review applicable Dutch, EU, U.S. and other jurisdictional requirements, including sanctions or end-use controls and any relevant re-export rules.
- Secure required authorisation before proceeding. Do not assume that a prior sale, a familiar customer or a past licence resolves a new transaction.
- Review activity after delivery. Servicing, upgrades, software, spare parts, technical assistance, brokering, transfers and re-exports can raise separate compliance questions under the relevant rules.
- Build time for review. Allow for classification, documentation and licensing decisions in transaction and factory-planning schedules.
For an individual shipment, the controlling legal text and the facts of the transaction matter more than a general summary. The Dutch government’s strategic-goods export-control information and its overview of relevant laws and rules provide official starting points; complex classifications or overlapping jurisdictional questions may require specialist advice.
What to watch next
The next practical questions are whether controls become more coordinated across the EU and other equipment-producing countries, whether China can develop substitutes at scale, and how licensing decisions affect particular suppliers and customers. Those outcomes are not established by the announcement itself. The rule’s immediate reach is defined by its technical entries and authorisation process; its broader impact will depend on how governments apply and coordinate those controls, and how industry adapts.
