Possibly, but “joint account” alone does not settle who owns the money after a partner dies. The outcome depends on the account’s ownership terms, the account agreement and the law that applies. In the United States, an account with rights of survivorship usually passes to the surviving owner; a tenancy-in-common arrangement may leave the deceased owner’s share to their heirs. Ask the bank or credit union to confirm the account’s exact designation and required process.

What happens to the money depends on how the account is titled

The Consumer Financial Protection Bureau (CFPB) distinguishes between joint accounts with rights of survivorship and accounts held as tenants in common. With survivorship rights, the surviving owner usually receives the funds when the other owner dies. With tenancy in common, the deceased owner’s share may pass under their will or the applicable inheritance law. The CFPB recommends checking the account agreement or asking the bank or credit union: CFPB guidance on joint accounts after an owner’s death (last reviewed August 28, 2026).

Do not assume that a will automatically overrides survivorship terms—or that survivorship terms resolve every possible claim by heirs. The account documents and local law matter, and the CFPB’s general explanation is not a substitute for determining how your specific account is titled.

Access to the account and ownership of the funds are separate questions

A bank’s decision to let a surviving account holder transact does not necessarily settle who is ultimately entitled to every dollar. For example, Bank of Israel guidance says a survivorship clause permits ordinary account management but does not replace a will or determine heirs’ rights; it also describes circumstances in which probate documents may be requested. In the United States, Alaska provides one jurisdiction-specific example of what may happen when an account has no survivorship terms: the deceased owner’s share goes to the estate, and a personal representative’s estate documents or another permitted collection document may be needed to transfer it. See the Alaska Court System’s guidance on transferring ownership of assets. This is an Alaska example, not a nationwide rule.

Check the account terms and the bank’s required process

  1. Contact the bank or credit union. Tell it an account owner has died and ask how it records the death and what documents it requires. Ask whether the account is classified as having rights of survivorship, as tenancy in common, or under another designation.
  2. Request the governing documents. Ask for the signature card and account agreement, or copies if you do not have them. Confirm that the designation on file matches your understanding of how the account was opened or changed.
  3. Ask what happens to transactions and funds. Get the institution’s instructions for ordinary account access and any transfer or closure process. Do not treat permission to transact as a final ruling on heirs’ or estate claims.
  4. Seek local probate advice if the terms are unclear or disputed. This is especially important if the agreement does not show survivorship rights, a personal representative is involved, or heirs contest ownership.

Local inheritance and tax rules can change the result

Joint-account terminology and legal consequences vary by jurisdiction. In the UK, GOV.UK explains that joint tenants automatically inherit the jointly owned asset, while tenants in common own separate shares. Inheritance tax may apply to the deceased person’s share depending on the estate and applicable rules. Deposit insurance does not decide who owns the money

In the United States, FDIC guidance provides a six-calendar-month grace period for its deposit-insurance treatment after an account owner dies, assuming the account’s titling remains unchanged. That period concerns how deposit insurance is calculated; it does not determine beneficial ownership of the funds or resolve heirs’ rights. See the FDIC’s joint-account guidance.
