My Dad Died With $3 Million; I Found Proof He Had a Third Child He Wanted to Leave $1 Million. What Now?

A late discovery of a possible child does not settle heirship or the effect of a stated gift. Here are the records to secure and the jurisdiction-specific questions to raise before further distributions.

Do not divide or transfer more estate assets—or promise anyone a fixed share—until the estate’s jurisdiction, documents, and administration status have been reviewed. Preserve the evidence and contact a local probate or trusts-and-estates lawyer promptly: proof of biological parentage, legal heirship, and whether your father’s stated $1 million wish has legal effect are separate questions, and the answers depend on local law and the estate’s facts.

What should you do first?

Start by finding out where the estate is being administered and whether it is still open. The reported $3 million may be the amount left to your family, not necessarily the full estate or the amount governed by one will. The father’s domicile, the location of property, and any pending probate case can affect which rules apply.

  1. Identify the case and decision-maker. Ask whether probate or another administration has begun. If it has, obtain the case number and the name of the appointed executor, administrator, or personal representative.
  2. Preserve the documents and evidence. Gather copies of the will and codicils, trust papers, probate filings, asset and distribution records, relevant correspondence, and the newly found proof. Keep originals intact, note when and where each item was found, and retain communications about it.
  3. Get jurisdiction-specific legal advice promptly. Ask a local probate or trusts-and-estates lawyer what steps are time-sensitive and what evidence is legally useful. Do not assume a deadline or procedure from another state or country applies.
  4. Keep interim communications factual. Avoid informal settlements, admissions that a particular sum is owed, and asset transfers until the estate representative has obtained advice. Do not alter or destroy evidence, or circulate sensitive material more widely than needed to preserve it and seek counsel.

Does proof that he fathered another child make that person an heir?

Not automatically. Biological parentage and legal heirship are related but distinct: the applicable law determines how parentage must be established and what inheritance rights follow. The nature of the proof matters, too; the facts here do not establish whether paternity was previously acknowledged or legally determined, or what the newly discovered evidence consists of.

Jurisdiction-specific court materials illustrate why a local answer is necessary. New York court guidance says a non-marital child can inherit from a male decedent if paternity is established under New York law, and that distributees must be listed in a probate petition. Texas Estates Code §202.002 provides for heirship proceedings in specified circumstances, including some situations involving omitted property or property without a final disposition. Neither example determines what law governs this estate or whether its conditions are met.

Does the reported wish to leave the child $1 million control?

A reported intention is not enough on its own to show that the estate must pay that amount. The answer depends on whether the wish was put into an effective legal document or carried out before death, and on the document’s terms and governing law.

Review the executed will and any codicils, trust instruments, beneficiary designations, and records of completed transfers. A lawyer can assess whether any of them address the child or the stated gift, and whether a separate legal route may be relevant. The facts given do not establish that the $1 million wish was documented or completed.

Can an estate distribution be changed after probate?

The stage of administration matters. A possible child’s next steps may differ depending on whether probate has not started, is pending, or has concluded; whether a representative has been appointed; and whether assets remain undistributed. The available routes and any filing or notice deadlines are jurisdiction-specific, so do not infer that an estate can—or cannot—be reopened from the fact that new evidence has surfaced.

For example, Texas law authorizes heirship proceedings in certain circumstances, while the Civil Procedure Rules of England and Wales, Part 57, address probate claims, will rectification, substitution or removal of personal representatives, and claims under the Inheritance (Provision for Family and Dependants) Act 1975. Those are examples of different legal frameworks, not a determination of this person’s eligibility or a procedure to use elsewhere.

What should you ask the lawyer and estate representative?

  • Which jurisdiction governs the estate, and are any out-of-jurisdiction assets relevant?
  • Has a probate or administration case been filed, who is appointed, and what has already been distributed?
  • What is the required way to establish legal parentage and heirship here?
  • Does the possible child need formal notice, and are any court filings or limitation periods approaching?
  • Do the will, trust, beneficiary records, or transfer documents address the stated $1 million wish?
  • What should happen to undistributed assets while those questions are reviewed, and what communications should the representative send?

The facts that decide these questions are not yet known: where your father lived and held property, whether a will or trust exists, what the evidence shows, the possible child’s age, the administration status, and whether distributions have occurred. Until those details are checked under the controlling law, neither a specific inheritance amount nor an available remedy can be reliably determined.
